Dear Mr. Karath.
On November 28. 2000, the Division conducted a site visit on the subject property to determine the
applicability of the Neuse River Riparian Buffer Protection Regulations (15A NCAC 2B .0233) and to
provide you with information on ho\\ the regulations would potentially effect the proposed house and pool
construction.
The Division has determined based on this meeting that the stream feature located east of the property
appears on the Cary. USGS topographic quadrangle map and is at least an intermittent stream. Therefore.
the stream is subject to the buffer rules. However. it appears based on the plat map provided with your
letter that the proposed project lies greater than 50 feet from the subject stream. If this is the case. then the
State riparian buffer protection rules would not apply within the location of your proposed project. For
your convenience I have sketched the approximate location of the State 50-foot protected riparian area on
the attached plat map.
.This letter only addresses the applicability of I5A NCAC 2B .0233(3) and does not authorize any activity
within the protected buffers. Nor does this letter address any other State or Local regulations including the
Town of Cary Riparian Buffer Protection Rules. Thank you for your attention to this matter and if this
