APPROVAL of Tar-Pamlico River Riparian Buffer Protection Rules MINOR VARIANCE [15A NCAC
2B.0259(9)(b)] with ADDITIONAL CONDITIONS
Dear Mr. & Ms. Mason,
You have our approval, in accordance with the conditions listed below, to impact ± 300 ft2 of Zone 2
of the protected riparian buffers for the purpose of constructing the proposed single family residential
dwelling. This letter shall act as your Minor Variance approval as described within 15A NCAC 2B
.0259(9)(b). In addition, you should get any other required federal, state or local permits before you proceed
with your project including (but not limited to) Sediment and Erosion Control and CAMA permits.
This approval is only valid for the purpose and design that you described in your Minor Variance
Request dated 11/8/00. If you change your project, you must notify us and you may be required to send us a
new request for approval. If the property is sold, the new owner must be given a copy of this approval and is
thereby responsible for complying with all conditions. For this approval to be valid, you must follow the
conditions listed below.
1. No impacts shall occur to Zone 1 of the protected riparian buffers.
2. Stormwater shall be directed to sheetflow at non-erosive velocities through the protected
stream buffers as identified within 15A NCAC 2B .0259(5). Roof drainage from the house
shall be directed to vegetated areas at non-erosive velocities prior to entering the protected
riparian buffers.
s Any additional stormwater located on the remainder of the property shall be directed to
sheet-flow at non-erosive velocities prior to entering the protected riparian buffers. No new
ditching or piping of stormwater through the protected buffers is allowed.
4. A mitigation plan to compensate for impacts to the protected riparian buffer per 15A NCAC
2B .0260 must be approved by this office ?rior to construction. The required amount of
mitigation for the Zone 2 impacts is 450 ft- [300 ft2 x 1.5 (required mitigation ratio)].
5. If restoration or enhancement or donation of property per 15A NCAC 2B .0260 is not an
option, another suitable method to meet this mitigation requirement is to make a payment
into the Riparian Buffer Restoration Fund administered by the NC Wetlands Restoration
Program (WRP). In accordance with 15A NCAC 2B .0260(7), this contribution will satisfy
our compensatory mitigation requirements under 15A NCAC 2B .0259(10) and (7)(C).
Until the WRP receives and clears your check (made payable to: DENR - Wetlands
Restoration Program), buffer impacts shall not occur. Mr. Ron Ferrell should be contacted
at (919) 733-5208 if you have any questions concerning payment into the WRP. You have

one month from the date of this approval to make this payment. For accounting purposes,
this Certification authorizes payment into the Riparian Buffer Restoration Fund to
compensate for 450 ft2 of required riparian buffer mitigation for impacts to 300 ft2
(and 20 linear feet) of protected riparian buffers; 03-03-07 river and subbasin. "
If you do not accept any of the conditions of this certification, you may ask for and adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
%Witten petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, PO Box 27447, Raleiah, N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Tar-Pamlico River
Riparian Buffer Protection Rules [15A NCAC 2B .0259(9)(b)]. Please call Bob Zarzecki at 919-733-9726 if

On November 20, 2000 the Division of Water Quality (DWQ) was notified by receipt of
your application regarding your plan to fill wetlands and estuarine buffers for the purpose of
constructing a home at Lot 1, David Tolson Heirs subdivision Section 1 in Hyde County.
Approval from DWQ is required to disturb these wetlands. The enclosed application needs to be
completed and returned to us with 3 copies of the Major Variance application (enclosed) for
impacts to Zone 1 (within 30 feet of the estuarine shoreline) or a Minor Variance application
(enclosed) if you only plan to impact Zone 2 (outer 20 feet of the buffer). Please clearly show all
appropriate buffer Zones on the required map.
Please call Bob Zarzecki of my staff at (919) 733-9726 if you have any questions or
would require copies of our rules or procedural materials. This project will remain on hold as
incomplete in accordance with 15A NCAC 2H .0505(c). The processing time for this application
will begin when this information is received. If we do not hear from you by writing within three
(3) weeks we will assume you no longer want to pursue the project and will consider it
withdrawn.
