Comments: The Application Fee you requested for the subject project is enclosed.
Please see attached Telephone Memorandum with Ian McMillan for further
information. Since our conversation with Ian, we learned from Crystal Amschler,
US Army Corps. Of Engineers, that because the proposed stream crossing is within
a flood area, the Corps will require a Nationwide Permit 14 be instead of the
Nationwide Permit 29 suggested in our telephone conversation.

Discussion: The attached response from Ian's office requires a $240 Permit
Application fee for the 404-404 Permit review since the Application was made under a
Nationwide 14 Permit. The Application should have been made under Nationwide 29,
Single Family Residences. We will call Crystal Amschler (USACE Wilmington Office)
at [phone] or email her (crystal.c.amschlerkusace.army.mil) to confirm prior to
resubmitting the Application. Ian agreed that the Permit Application could probably be
made under Nationwide Permit 29, however he cannot make an official recommendation
nor a decision on the matter. He stated that the decision should be made by the US Army
Corps of Engineers.
Ian also questioned the Stormwater Management Status, and we pointed him to Item 6b
"PHASE 1 SECTIONS 1 & 2 PREVIOUSLY DEVELOPED- PHASES 1,2, & 3 PLAN APPROVED BY
HARNETT COUNTY PRIOR TO AUGUST, 2004 - PHASE 3 HAS VESTED RIGHTS ACCORDING TO
MIKE RANDALL, NPDES STORMWATER PERMITTING UNIT.,, And Item E. 2c. which
references Item 6b. We explained that we had already spoken to Mike Randall, Division
Head of NC NPDES Phase II, and that he had conveyed this information to our office.
Ian said that he would communicate with Mike Randall on the matter, in lieu of requiring
wriiten documentation from Mike.

On November 3, 2009, the Division of Water Quality (DWQ) received your application dated
October 13, 2009 for the above referenced project. The DWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below. Please provide the following so
that we may continue to review your project.
Additional Information Requested:
1. Application fee missing: Water Quality Certification 3704 states: "any proposed fill or
modification of wetlands and/or waters, including streams, under this General Certification
requires application to, and written approval from the Division of Water Quality (the
"Division")."
2. "In accordance with North Carolina General Statute Section 143-215.3D(e), written approval for
a 401 Water Quality General Certification must include the appropriate fee." Please remit $240
made payable to Division of Water Quality (DWQ).
