Box 672 Rocky Mount, NC, 27802 APPROVAL of 401 Water Quality Certification Dear-Mr. Kincheloe: You have our approval, in accordance with the attached conditions, to place fill material in 0.008 acre of shallow bottom in order to restore a rock groin along the shoreline on your property in Carteret County, as described in your application dated 28 August 2000. After reviewing your application, we have determined that this work is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA-Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. NARRATIVE DESCRIPTION: The project site is located in Carteret County, within the Town of Morehead City. The property is adjacent to Bogue Sound, and is essentially vacant but for a small block building at the road side of the lot. There is a bulkhead existing, and a pier that has been reconstructed westward of its original position (shown on the photography). The lot is approximately 100' wide and 250' deep, with 110' along the sound, or 125' following shoreline contours. Along the eastern property line, the shoreline recedes approximately 150' landward, and consequently, the property experiences erosion along two sides. This has been stabilized along the applicant's side line with a bulkhead and reinforced with rock. This area of Morehead City is residential, although it is in close proximity to the business district to the east. The property is cleared and vegetated with lawn grasses, and is serviced by municipal water and sewer. In recent months, the owner has been having repairs done to the bulkhead and pier, to maintain the lot in a buildable condition. There is an existing rock groin extending to ±50' from the nhw contour, located about two thirds along the shoreline to the west; additionally, there are the remains of a previous rock groin in the location of the pre-existing pier, along the eastern property line. This structure is non-functioning, and is submersed at normal high tides. The waters of Bogue Sound at the project site are classified SA by the Division of Water Quality. The waters are not designated Primary Nursery Area by the Division of Marine Fisheries, and Bogue Sound at this location is closed to the taking of shellfish for consumption by the Division of Health Services. The Land Use Plan for the Town of Morehead City classifies this area as Developed, with all AEC's classified as Conservation. The bottom composition in the area is sandy, with no indications of a shellfish presence. Sparse and scattered SAV beds can be seen in various locations along this shoreline, although none are within the project area. The applicant is proposing to re-construct the relic rock groin along the eastern property line (waiver on file). Because of the shoreline configuration, the property is exposed to elements along two sides, and the applicant and his contractor feel additional measures are needed to keep the property stable. This attempt is to capture shore parallel sediments. Rock groins are common structures along this shoreline, most having been constructed prior to the CAMA, and having been maintained through the years. The proposed groin will be 10' in bottom width, with 2:1 side slopes, extending to 35' from the nhw contour. The groin will extend to approximately 1' above the nhw level, and will be located approximately 80' east of the existing groin. 10. ANTICIPATED IMPACTS: As proposed, the project will fill ±350 sf of sandy bottom area within Bogue Sound. There should be no hazard to navigation posed by the structure. The little amount of sand movement along this shoreline appears to be in an easterly direction, and because of the shoreline configuration, beyond the applicant's property the sediment settles offshore. Consequently, there should be little sediment starvation to the shoreline to the east. T.
