The Development Services Department Site Engineering Division has reviewed the subject erosion and
sedimentation control plan. We find the plan to be acceptable and hereby issue this Letter of Approval.
This plan shall expire one (1) year from the date of approval, as required by the City of Asheville Unified
Development Ordinance Section 7-12-2(c)(2)f.
As of April 1, 2019, all new construction activities are required to complete and submit an electronic
Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCG010000
Construction Stormwater General Permit. This form MUST be submitted prior to the commencement of
any land disturbing activity on the above named project. The NOI form may be accessed at
deq.nc.gov/NCG01. Please direct questions about the NOI form to Annette Lucas at
Annette.lucas ate_ ncdenr.gov or Paul Clark at Paul.clark(o)ncdenr.gov. After you submit a complete and
correct NOI Form, a COC will be emailed to you within three business days. Initially, DEMLR will not
charge a fee for coverage under the NCG01 permit. However, on or after May 1, 2019, a $100 fee will
be charged annually. This fee is to be sent to the DEMLR Stormwater Central Office staff in Raleigh.
A pre -construction meeting is required to be scheduled with the City of Asheville, at which your permits
will be issued. Please bring a copy of the NCDEQ Certificate of Coverage and shop drawings to the
pre -construction meeting. Contact Nancy watford at NWatford(a)ashevillenc.gov to schedule your
pre -construction meeting.
Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to
insure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring protection of
existing natural resources and adjoining properties. If, following the commencement of this project, the
erosion and sedimentation control plan is inadequate to meet the requirements of the Sedimentation
Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this office may
require revisions to the plan and implementation of the revisions to insure compliance with the Act.

Erosion & Sediment Control I Grading Permit Conditions:
1. The following documentation be kept on file at the job site:
a. City of Asheville Permit
b. The approved E&SC plan as well as any approved deviation.
c. The NCG01 permit and the Certificate of Coverage.
d. Records of inspections made during the previous 30 days.
e. Records of third party inspections.
Per Title 15A NCAC 4B .0118(a), City of Asheville UDO, and the NCG01 permit.
2. Site must stay in compliance with all federal, state and local regulations. Failure to maintain
compliance for any of the agency's stated above may result in issuance of a Notice of Violation
against the project or revocation of the Grading Permit.
3. If any of the minimum best management practices fail to adequately keep sedimentation or
stormwater on the site, it shall be the responsibility of the professional designer of record to
supply the Contractor/Owner with a correction, as well as submit correction to the Development
Services Department for approval.
4. For sites with greater than 25,000 square feet of disturbance, a contract is required between the
person financially responsible and a licensed professional for the initial inspection ensuring
erosion and sediment control measures have been installed consistent with the approved plan.
A notarized certificate of inspection agreement on a form has been received and approved by
the Stormwater administrator and a copy is included as part of this grading and stormwater
permit is issued.

a. The initial and signed inspection report must be filed with the DSD Site Engineering
Division prior to the commencement of any land disturbing activity.
b. A licensed professional shall conduct weekly inspections for all sites where Hillside,
Steep Slope and/or Mountain Top Protection regulations apply and bi-weekly for all other
sites.
c. All weekly inspections and bi-weekly inspections must be kept on inspection logs and
retained at the site.
5. For constructed slopes with a grade of 50% (2:1) and greater than five feet in height, inspection
and submittal of a Slope Stability Certificate are required by a North Carolina registered
professional engineer with geotechnical expertise sufficient to perform the inspection and
stability analysis.
6. Please note that Temporary Ground Cover must be established, prior to release of grading
approval for issuance of a Temporary Certificate of Occupancy. Permanent Ground Cover must
be established, prior to grading approval for the issuance of a Certificate of Occupancy.
7. Contractor must provide proof of active grading permits for any offsite borrow or waste areas.
8. Inspection request should be called into 828-259-5946, or can be scheduled via web at
www.develop.ashevillenc.gov
9. Grading Permit expires in one (1) year from the date of permit issuance. A one-time, one-year
extension can be granted. Please drop off or mail the extension application form at the Permit
Application Center, 161 S. Charlotte Street, Asheville NC 28801, within 60 days prior to permit
expiration.

Please note that this approval is based in part on the accuracy of the information provided in the
Financial Responsibility Form, which you provided. You are requested to file an amended form if there
is any change in the information included on the form. In addition, it would be helpful if you notify this
office of the proposed starting date for this project. Please notify us if you plan to have a
preconstruction conference.
