Box 6400 Sunset Beach, NC, 28470 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Morrison: You have our approval, in accordance with the attached conditions and the condition listed below, to place fill 0.028 acre of wetlands in order to construct a bulkhead at Lot 13 Block 40-C on Northshore Drive West on Sunset Beach in Brunswick County as described in your application dated 2 May 2000. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3112. This Certification allows to use your CAMA Permit when the NC Division of Coastal Management issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the following condition: 1. Vegetation outside the immediate footprint of the bulkhead shall not be removed. This remaining vegetation shall be allowed to remain and stabilize the slope. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY - Applicant proposes to fill 0.028 acres within the CAMA AEC, construct a 50 linear ft bulkhead to contain fill and construct single family residence. A.L. Morrison Page Two 9. PROJECT DESCRIPTION The project site is a single family lot, located at Block 40-C, lot 13 on Northshore Drive West across from the street-end of 29th Street on Sunset Beach in Brunswick County, NC. Northshore Drive West is adjacent to the marshes of Blane's Creek which is a tributary connected to the AIWW. The lot is approximately 0.22 acres with an elevation of zero to fourteen feet above sea level. There are currently no manmade features on the site. Types of vegetation on the site include but are not limited to wax myrtles, yaupon, greenbriar, and Spartina patens. The site is characterized by an embankment which extends the width of the property at a distance ranging from approximately 25 to 50 feet from Northshore Drive West. Federal 404 wetlands extend waterward from the creekside toe of the embankment and gradually transition to a composition of both federal and coastal wetlands. The waters of Blane's Creek adjacent to the site are classified as SA waters by the Division of Environmental Management and are designated as Primary Nursery Area by the Division of Marine Fisheries. All adjacent waters are closed to the taking of shellfish. The applicant proposes to construct a single family residence partially within the CAMA 75 ft Area of Environmental Concern (AEC). Impervious coverage of the proposed residence has been calculated to be 17% of the estuarine shoreline AEC. The applicant has already applied for and received a Nationwide 18 permit from the US Army Corps of Engineers to fill 0.028 acres of 404 federal wetlands on the site. The applicant has also received a 401 Water Quality Certification from the NC Division of Water Quality. Receipt of those permits necessitated application for a CAMA major development permit as per NCGS 113A-118 (d) (1). The applicant proposes no fill within coastal wetlands and has aligned the proposed 50 linear foot bulkhead landward of all coastal wetlands. The applicant proposes an individual septic system for wastewater treatment and use of the municipal water system as the source for drinking water. Both adjacent neighbors are opposed to the proposed project and have hired an attorney to contest the development. A letter has been received from the attorney, whereas several concerns were listed. However, most of the concerns were technical in nature and have since been rectified. Other concerns were not deemed to be of sufficient validity to deny the project. 10. ANTICIPATED IMPACTS The placement of fill on the lot will result in the loss of 0.028 acres of federal wetlands. Since all fill is proposed within federal wetlands, there should be no net loss of coastal wetlands. The construction of a bulkhead prior to the filling activities should also limit the impacts to the adjacent coastal wetlands. The construction of the single family residence with associated parking will increase stormwater runoff, but the project is beneath the 30% maximum impervious coverage within the estuarine shoreline AEC allotted to development without an engineered stormwater plan.
