In addition, you should get any other required federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control and Non-Discharge. This approval is only valid for the purpose and design that you described in your application including the 10/26/00 revisions. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this authorization and approval letter and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below as well as any other conditions identified within 15A NCAC 2B .0233. 1. Diffuse flow of all stormwater at non-erosive velocities shall be obtained prior to entering the protected stream buffers as identified within 15A NCAC 2B .0233(5). Stormwater controls described within the 10/26/00 revisions reviewed by Mr. Todd St. John shall be . put in place to ensure the diffuse flow requirement of the rules. 2. Deed notifications or similar mechanisms shall be placed on remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the State in order to assure compliance for future wetland, buffer and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. The flow has been split to at least 3 outlets per our letter of August 28, 2000. The applicant has made use of a level spreader that is about 40 feet long that would receive 7 cfs. The applicant will construct a stilling pool of 20' x 10' feet for 30 cfs that will discharge to a "natural swale" above the buffer. The applicant will discharge about 9 cfs into a "natural swate'3 at a third location via a dissipator. The splitting of the flows appears to be reasonable. I assume that your letter was sent before you received our August 28, 2000 letter (copy attached). As stated in that letter, your proposed design is unacceptable since it will not result in sheet flow. Our August 28, 200 letter specifically describes what you will need to do to get approval for this project. I would suggest that if rapid approval is important for your client and this project, then you redesign the stormwater management devices as outlined in our August 28, 2000 letter. If this is not acceptable, we will deny the application and your client may then appeal this decision through the office of Administrative Hearings. John: As you may know, our encroachment permit submittal for the above-referenced project was placed on hold. The reasons for the hold status were the lack of a USGS Quad Map, Wake Co. Soils map, and the location of a storm drain outlet in zone two of the Neuse River Riparian Buffer. We revised the plan and resubmitted to John Hennesey. He referred us to Todd St. John for technical review and approval of our revised storm drainage configuration. Our revision included removal of any storm pipe from buffer zone 1 and zone 2, and the installation of a level spreader at the end of the relocated storm outlet. We designed the level spreader in accordance with the DENHR erosion control manual. The manual specified a 24' weir length for the level spreader given the flow volume (28 cfs) exiting our storm pipe. We proposed a level spreader with a weir length of 58'. We also provided calculations for depth of flow and velocity of our storm runoff when it exited the level spreader. The calculations showed that the velocity of the runoff was 1.3 fps when it left the proposed level spreader and entered zone 2. We feel that this configuration adheres to the policy in DENHR erosion control manual section 0233.5a. We have encountered a difference of opinion with Todd St. John regarding the requirements for the level spreader. He has based his review on his own perception of the problem without performing or providing any calculations to support his contention. He refuses to approve the current plan that he has before him. His main objection is that the storm water released will create gullies in the buffer area. This condition, based on our calculations, does not seem likely. However, in the event that gullies do occur, section 0233.5b provides for the periodic corrective action to impede the formation of erosion in the buffer area. The DENHR Neuse River Riparian Buffer Manual offers several ways to approach runoff through the buffer area. The first recommendation is to reduce.density and impervious surface. Please note the property is currently zoned for 10 units per acre by The City of Raleigh and that we have reduced the design density to 5 units per acre in the affected drainage area. The second recommendation is to a install level spreader to disperse concentrated flow from storm outlet pipes. The level spreader we proposed more than doubled in length the requirement of the level spreader detail in the DENHR erosion control manual. As a result of Todd St John's decision, I am appealing to you to review his decision and to approve our request so that this project can move forward. I have enclosed a copy of the level spreader detail found in the DENHR erosion control manual for your information. Your application was not-complete since there is not enough evidence in our files to show that the stormwater outlet between'lots 68 and 69 will achieve diffuse flow. This information is needed by DWQ in order for us to decide whether this project is approvable. In follow-up to the August 24, 2000 meeting with you, Harold YeIle, one of his associates, and Mr. Todd St. John of this Office, I am offering the following response: In reference to the proposed level spreader design and subsequent calculations, the information provided does not appear to support that diffuse and non-gully forming flow will be achieved: Based on the NC DENR Stormwater Best Management Practices Manual, April 1999, and advice from Bill Hunt of the Biological and Agricultural Engineering Department of North Carolina State University, this Office does not believe that the proposed 57 foot level spreader will achieve diffuse flow in this instance. Flows from level spreaders typically tend to re-concentrate rather than continue to spread. The information presented at the above meeting suggested the flow would continue to spread after leaving the level spreader. Also, based on information in the file and information presented at the above meeting, the level spreader would discharge to an 11% slope over disturbed soil. The level spreader would serve about 5 acres (per my conversation with the engineer) that would discharge about 30 cfs to an I I% slope resulting from a ten year event (per the engineer). Originally, the engineer proposed a 36' level spreader. I contacted Bill Hunt of NCSU and gave him some of the details, and he, subsequently, recommended general design recommendations of about 10 cfs of discharge along 70 to 100 feet of level spreader that discharges to "slight" slopes. The engineer vehemently objected to these parameters indicating that he based his design on DLR's Erosion and Sediment Control Manual. However, Mr. Hunt's parameters more closely match the requirements for diffuse flow based on the Stormwater BMP Manual's forested filter strip (which would be about 100 feet of spreading for every 6 to 7 cfs, based on my calculations). The engineer presented a design with a 57 foot level spreader with some calculations to show that diffuse flow would be achieved in the buffer. Some problems that I have with his design are that the level spreader would discharge over recently disturbed ground (i.e. a new sewer line) and buffer slopes that exceed 10%. (Also, I have some questions about the engineer's calculations that purportedly show sheet flow through the buffer.) The Wake County Soil Survey map does show evidence of a streambed on a portion of this property. As you have stated that with the current rules of the Neuse River Riparian Buffer the above referenced sources are used exclusively to determine the buffer areas and if there is a creek on your property and it is not shown on either map than the stream bed is not subject to the buffer rules. We have chosen to accept the delineation as shown on Wake County Soil Survey map without benefit of the on site inspection. Upon inspection of the soils map you note that the map shows a power line easement to the northwest which we used to determine, by scale, the extent of the affected area of the Neuse River buffer. This buffer location is accurately shown on the drawings submitted. We have place the sewer line as required by the City of Raleigh to serve the entire basin. The existing sewer, shown as ex. mh, which we must tie to is not located on our property. As a result we must encroach into zone 2,see mh # 13, as shown on our site plan.
