This office has reviewed the subject Sedimentation and Erosion Control Pen -nit Application.
We find the application to be acceptable and hereby issue this letter of approval. If any
stipulations or recommendations are applicable, a list is attached and is incorporated as a part
of this letter of approval. Pursuant to Section 3.8.5 of the Durham City -County Unified
Development Ordinance, plans for which no permit has been issued shall expire one year
from the approval date.
Please be advised that a copy of the approved plan must be on file at the job site, and a land -
disturbing permit must be obtained and prominently displayed. Pursuant to G.S. 113A-61 (d)
and Section 15.5.1 of the Durham City -County Unified Development Ordinance, you are
hereby notified that the Sedimentation and Erosion Control Office has the right to inspect the
site over the life: of the pi-cject to inslure Complia -Ce w th the nAnroved elan and ordinance.
The Sedimentation and Erosion Control Program is perfonnance oriented, requiring
protection of the natural resources and adjoining properties. If following the commencement
of this project it is detennined that the sedimentation and erosion control plan is inadequate
to meet the requirements of the Durham City -County Unified Development Ordinance, this
office may require revisions in the plan and its implementation to ensure compliance with the
Ordinance.
Pursuant to .Section 12.10.E of the Durham City -County Unified Development Ordinance,
prior to initiating land -disturbing activity, the person conducting such activity must notify the
sedimentation and erosion control office of the date that such activity will begin.

NCG010000 Requirements —
As of April 1, 2019, all new construction activities are required to complete and submit an
electronic Notice of Intent (NOI) form requesting a Certificate of Coverage (COC) under the
NCGO10000 Construction Stormwater General Permit. This form MUST be submitted prior
to the commencement of any land disturbing activity on the above -named project. The NOI
form may be accessed at deq.nc.gov/NCGOl. Please direct questions about the NOI form to
Annette Lucas at Annette. lucasgncdenr. gov or Paul Clark at Paul. clarkkncdenr.gov. After
you submit a complete and correct NOI Form, a COC will be emailed to you within three
business days. There is a $100 annual fee for coverage. This fee is to be sent to the DEMLR
Stormwater Central Office staff in Raleigh.
Title 15A NCAC 4B .0118(a) and the NCGO1 permit require that the following
documentation be kept on file at the job site:
1. The approved E&SC plan as well as any approved deviation.
2. The NCGO1 permit and the COC, once it is received.
3. Records of inspections made during the previous 30 days.
It should also be noted that approval of an erosion control plan does not in any way
indicate approval of, or authorization to begin installation of Stormwater infrastructure
without City/County approved Construction Drawings.

3. LAND LEFT EXPOSED SHALL BE STABILIZED WITHIN THE TIME PERIODS SPECIFIED BELOW FOR
ANY PHASE OF GRADING IN ACCORDANCE WITH THE FOLLOWING SCHEDULE DEPENDING ON THE
SLOPE OF THE LAND:
• AREAS WITH SLOPES OF 3H:1V OR GREATER SHALL BE STABILIZED
WITHIN 7 DAYS;
• AREAS WITH MODERATE SLOPES THAT ARE FLATTER THAN 3H:1V SHALL
BE STABILIZED WITHIN 10 DAYS;
• AREAS WITH MINIMAL SLOPE, GENERALLY FLAT IN NATURE SHALL BE
STABILIZED WITHIN 14 DAYS.
4. FOR ANY AREA OF LAND -DISTURBING ACTIVITY WHERE GRADING ACTIVITIES HAVE BEEN COMPLETED,
TEMPORARY OR PERMANENT GROUND COVER SUFFICIENT TO RESTRAIN EROSION SHALL BE
PROVIDED AS SOON AS PRACTICABLE, BUT IN NO CASE LATER THAN SEVEN DAYS AFTER
COMPLETION OF GRADING.
5. ALL STREETS ADJACENT TO THIS PROJECT MUST BE KEPT CLEAN AT ALL TIMES OR A
WASH STATION MAY BE REQUIRED.
6. TOPSOIL STOCKPILING SHALL OCCUR AT A SITE APPROVED BY DURHAM COUNTY.
EROSION CONTROL MAINTENANCE NOTES:
1. ALL EROSION AND SEDIMENT CONTROL MEASURES SHALL BE CHECKED FOR STABILITY AND
OPERATION FOLLOWING EVERY RUNOFF -PRODUCING RAINFALL, BUT IN NO CASE, LESS THAN
ONCE EVERY WEEK. ANY NEEDED REPAIRS SHALL BE MADE IMMEDIATELY.
2. SEDIMENT SHALL BE REMOVED FROM SEDIMENT TRAP DEVICES WHEN STORAGE CAPACITY
HAS BEEN APPROXIMATELY 50% FILLED. GRAVEL SHALL BE CLEANED OR REPLACED WHEN
THE SEDIMENT POOL NO LONGER DRAINS PROPERLY.
3. SEDIMENT SHALL BE REMOVED FROM BEHIND THE SILT FENCE WHEN IT BECOMES ABOUT
6 INCHES DEEP AT THE FENCE. THE SILT FENCE SHALL BE REPAIRED AS NECESSARY
TO MAINTAIN A BARRIER.
4. INLET PROTECTION DEVICES SHALL BE INSPECTED AFTER EVERY RUNOFF -PRODUCING
RAINFALL EVENT. ANY DAMAGE TO MESH SHALL BE REPAIRED IMMEDIATELY, AND GRAVEL
SHALL BE REPLACED OR CLEANED TO ENSURE PROPER DRAINAGE.
DURHAM COUNTY EROSION CONTROL ENFORCEMENT NOTES:
1. Failure to follow this construction sequence may result in local enforcement actions, including but not limited to civil 9 penalties
to $5000 per violation per day, injunctive relief, criminal penalties, and permit revocation. Additionally, off -site sedimentation may result in
restoration requirements.

6. Obtain an approved (stamped) S&E control plan and keep it on site, either in the inspection box, construction office or with the contractor.
% 7. Install construction egress/exit, silt fencing, sediment traps/basins, diversion ditches, check dams, and other initial erosion control measures as
specified in the plan. Remove only trees and ground cover necessary to install these devices.
- / 8. If a stockpile is necessary due to excavation of the sediment trap/basin, place a double row of silt fence 10 feet apart at the limits of the
r stockpile area shown on this plan. Trees and groundcover may be removed only as necessary for this stockpile.
9. Temporary ground cover shall occur within the timefrome specified per #3 of the erosion control notes. Permanent ground cover shall be

ANY PHASE OF GRADING IN ACCORDANCE WITH THE FOLLOWING SCHEDULE DEPENDING ON THE
SLOPE OF THE LAND:
• AREAS WITH SLOPES OF 3H:1 V OR GREATER SHALL BE STABILIZED
WITHIN 7 DAYS;
• AREAS WITH MODERATE SLOPES THAT ARE FLATTER THAN 3H:1V SHALL
BE STABILIZED WITHIN 10 DAYS;

4. FOR ANY AREA OF LAND -DISTURBING ACTIVITY WHERE GRADING ACTIVITIES HAVE BEEN COMPLETED,
TEMPORARY OR PERMANENT GROUND COVER SUFFICIENT TO RESTRAIN EROSION SHALL BE
PROVIDED AS SOON AS PRACTICABLE, BUT IN NO CASE LATER THAN SEVEN DAYS AFTER
COMPLETION OF GRADING.
5. ALL STREETS ADJACENT TO THIS PROJECT MUST BE KEPT CLEAN AT ALL TIMES OR A
WASH STATION MAY BE REQUIRED.
6. TOPSOIL STOCKPILING SHALL OCCUR AT A SITE APPROVED BY DURHAM COUNTY.
EROSION CONTROL MAINTENANCE NOTES:
1. ALL EROSION AND SEDIMENT CONTROL MEASURES SHALL BE CHECKED FOR STABILITY AND
OPERATION FOLLOWING EVERY RUNOFF -PRODUCING RAINFALL, BUT IN NO CASE, LESS THAN
ONCE EVERY WEEK. ANY NEEDED REPAIRS SHALL BE MADE IMMEDIATELY.
2. SEDIMENT SHALL BE REMOVED FROM SEDIMENT TRAP DEVICES WHEN STORAGE CAPACITY
HAS BEEN APPROXIMATELY 50% FILLED. GRAVEL SHALL BE CLEANED OR REPLACED WHEN
THE SEDIMENT POOL NO LONGER DRAINS PROPERLY.
3. SEDIMENT SHALL BE REMOVED FROM BEHIND THE SILT FENCE WHEN IT BECOMES ABOUT
6 INCHES DEEP AT THE FENCE. THE SILT FENCE SHALL BE REPAIRED AS NECESSARY
TO MAINTAIN A BARRIER.
4. INLET PROTECTION DEVICES SHALL BE INSPECTED AFTER EVERY RUNOFF -PRODUCING
RAINFALL EVENT. ANY DAMAGE TO MESH SHALL BE REPAIRED IMMEDIATELY, AND GRAVEL
SHALL BE REPLACED OR CLEANED TO ENSURE PROPER DRAINAGE.
DURHAM COUNTY EROSION CONTROL ENFORCEMENT NOTES:
1. Failure to follow this construction sequence may result in local enforcement actions, including but not limited to civil penalties
to $5000 per violation per day, injunctive relief, criminal penalties, and permit revocation. Additionally, off -site sedimentation may result in
restoration requirements.
2. If the Durham County S&E staff determines that excessive sediment is leaving the site, a revised sedimentation and erosion
control plan may be required, with associated requirements for additional S&E measures.
COSNTRUCTION SEQUENCE:
1. Install tree protection fencing in accordance with the approved Site Plan.
2. Inspect tree fence and submit a Tree Protection Fencing Certification form to Durham County S & E Office, fox: (919)560-0740.
3. Call Durham County S&E office for inspection of tree fence installation, (919)560-0735.
4. Schedule and hold a pre -construction conference prior to beginning any land -disturbing activities. This conference should be attended by a
representative of the financially responsible party and/or the general contractor, grading sub -contractor, erosion control sub -contractor and the
Durham County S&E office.
5. Obtain Land Disturbing Permit and placard, and post the placard on site.
6. obtain an approved (stomped) S&E control plan and keep it on site, either in the inspection box, construction office or with the contractor.
7. Install construction egress/exit, silt fencing, sediment traps/basins, diversion ditches, check dams, and other initial erosion control measures as
specified in the plan. Remove only trees and ground cover necessary to install these devices.
8. If a stockpile is necessary due to excavation of the sediment trap/basin, place a double row of silt fence 10 feet apart at the limits of the
stockpile area shown on this plan. Trees and groundcover may be removed only as necessary for this stockpile.
9. Temporary ground cover shall occur within the timefrome specified per #3 of the erosion control notes. Permanent ground cover shall be
provided as soon as practical but in no case later that 7 days after completion of grading (see sheet 3.0 for seeding schedule).
10, Notify the Durham County S&E site inspector after measures have been installed and project has started.
11. Remove all erosion control measures after the Durham County S&E office approval of permanent stabilization.

Seedbed Preparation:
