Dear Mr. Sadd:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.047
acres of wetlands, and 230 linear feet of streams for the purpose of constructing a residential development at Breezeway
subdivision, as you described in your application dated February 22, 2000. After reviewing your application, we have decided
that this fill is covered by General Water Quality Certification Numbers 3101 and 3108. These certifications allows you to use
Nationwide Permit Numbers 12 & 26 when the Corps of Engineers issues them. This approval is also valid for the !reuse River
buffer rules (15A NCAC 2B .0330). In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed
in the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas within 50
feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These
mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later).
2. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream buffers.
3. Lots 16. 17 and 23 must be constructed without impacting the protected stream buffers.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

An additional condition is that a final, written stormwater management plan for stormwater runoff from this project shall be
approved by this Office before the impacts specified in this Certification occur. The stormwater management plan must include
plans and specifications for stormwater management facilities designed to remove 85% TSS according tot he most recent version
of the NC DENR Stormwater Best Management Practices Manual. Also, before any permanent building is occupied at the subject
site, the stormwater facilities, as approved by this Office, shall be constructed and operational, and the stormwater management
plan, as approved by this Office, shall be implemented.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of
the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina

Dear Mr. Dorney and Mr. Tugwell:
The purpose of this letter is to request authorization to use Nationwide Permits (NWP) 12
and 26 for wetland and jurisdictional waters impacts associated with the construction of
Breezeway Subdivision. The property is owned by Magda Saad (See attached Agent
Authorization Form) and located in Garner, North Carolina (Figure 1).
Authorization to use NWP 12 is requested to cover impacts associated with installation of
a sanitary sewer line connecting the subdivision to the municipal sanitary sewer system.
Approximately 30 linear feet of Buck Branch (0.003 acre) and 130 linear feet (0.09 acre)
of jurisdictional wetland will be temporarily impacted. As the aforementioned
jurisdictional wetland consists of mixed forest, 0.047 acre will be impacted permanently
due to corridor maintenance. I b b
Authorization to use NWP 26 is also requested to cover impacts ciated with
construction of Street 2 within the subdivision. Approximate) l ear feet (0.006) of 3
unimportant/insignificant intermittent channel will be perman impacted by filling
and culvert placement.
Note that Mr. Steve Mitchell of NCDENR DWQ visited the site on October 4, 1999
and determined the extent of the "Neuse Basin Riparian Aicas" (See attached
November 22, 1999 letter with attachments)
Current DWQ criteria for impacts to areas subject to Neuse River Riparian Buffer Rules
do not require mitigation for impacts due to non-electric utility lines if the crossing is

streams (intermittent and permanent) on the property must be shown on the
map. Map scales should be 1 inch equals 50 feet or 1 inch equals 100 feet or
their equivalent. Site plan showing impacts attached as Figure 2
b. If available, representative photograph of wetlands to be impacted by project.
C. If delineation was performed by a consultant, include all data sheets relevant
to the placement of the delineation line. Four data sheets provided
d. Attach a copy of the stormwater management plan, if required.

On October 4, 1999. I met with Bob Zaraecki at the subject property. An evaluation of the stream
features were performed to determine whether the site would require compliance with the Neuse Buffer
Rule. This specific project is referenced by the Raleigh Regional Office as NBRRO-250.
The features represented on the Wake County Soils and the USGS maps were evaluated to determine
their subjectivity to the Ncuse Buffer Rule. It was determined as a result of the site visit that there are
two features depicted on the maps that are subject to the Neuse River Basin: Nutrient Sensitive Waters
Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code
T15A:02B.0233 (NCAC 0233).
Buck Branch runs through the property to the west and there is an unnamed tributary to the east that is
subject to protection under the Rule. These streams and the required buffer are delineated on the map
received by this Office on October 6, 1999.

We are submitting through S&EC the above referenced project for your review.
The Town of Garner has approved this plan.
The project has only one point at which Street 2 crosses a drainage feature that
has been classified as a stream. This occurs on Street 2 at lots 17, 22 and 23.
Breezeway Subdivision is made up of two tracts of land, which were purchased
at different times. A subdivision layout for the first tract (Lots 1-8 and 28-35)
which does not have any Neuse River Buffers was prepared and approved by the
Town of Garner before the second tract of land was purchased. At that time the
layout for the second tract of land was begun. In order to comply with Town of
Garner and NCDOT standards, the two intersections with Thompson Road have
to be 400 feet apart. Moving Street 2 to avoid the buffer would not allow the
proper separation between the intersections at Thompson Road and any other
street layout for this subdivision would not allow the number of lots needed for
this land to be developable- We believe this subdivision design, as submitted,
complies with good planning principles and that there are no other practical
alternatives in complying with the subdivision standards for the Town of Garner
and the NCDOT Minimum Construction Standards for Subdivision Roads.

Section 218. Street Intersections.
(a) Streets shall intersect as nearly as possible at right angle , card no two streets rncxy
