PROJECT SUMMARY: The applicant, Ocean Hill Joint Ventures, would like to install a concentrate waste line from an existing Reverse Osmosis Water Plant to a diffuser pipe located along mean low water on the ocean front in the Villages at Ocean Hill Planned Unit Development. A four inch pipe will be buried in a trench within the right-of- way of Ocean Trail, North Beach Access Road, Head Wind Wayand a beach access off Sandcastle Drive and terminate in the Ocean ten feet below the surface of the beach at mean low water. Ocean Hill Joint Ventures Bio Report Page 3 PROJECT SETTING The applicant's project is located in the Villages of Ocean Hill, a 263 lot Planned Unit Development (PUD), on the Currituck Outer Banks, north of Corolla Village on Ocean Trail. The subdivision is accessed by Ocean Trail (NC 12) at the northern end of Corolla and is the last subdivision accessed by a paved road system. Development within the subdivision is primarily residential, but includes a large undeveloped commercial parcel along NC 12. Lots within the Villages at Ocean Hill are supported by a 224,000 gpd reverse osmosis water treatment facility and an 80,000 gpd. waste treatment facility. The existing water system uses raw water from deep wells located throughout the PUD and is routed to a Reverse Osmosis Treatment Plant. The process produces approximately 20,000 to 25,000 gallons of concentrate waste. Originally the concentrate was routed to the waste treatment facility, diluted with the effluent from the waste treatment plant and pumped to a low pressure subsurface disposal system. Over the years this method of disposal tainted the existing wastewater disposal system resulting in excessive amounts of chlorides being pumped into the subsurface system, putting the facility out of compliance with state groundwater standards. In December of 1988, a temporary disposal permit was issued by the Division of Environmental Management, as a result, the concentrate was removed from the effluent stream and rerouted to the subsurface disposal area as a separate waste stream. Under the terms of the permit, a permanent disposal system was to be in place by July 1, 1999. Both the water treatment plant and the wastewater treatment plant are located on the west side of Ocean Trail and are accessed by a dirt service road adjacent to Corolla Landscaping. The project area involved is along an alignment from the treatment plant along the dirt (unimproved) roadway, within the treatment and drainfield area, and along the property line of a 10.7 acre commercial tract (as shown on the enclosed plans) situated on the west side of Ocean Trail. This alignment continues north along the east side of Ocean trail and the North Beach Access Road to Head Wind Wav. From North Beach Access Road the project site turns east along the right-of-way of head Wind Way, crosses Sandcastle Drive and continues through the Villages at Ocean Hill's Community Pool lot. The project site continues along the southern edge of the lot and through the dune and ocean beach immediately east of the lot. Utility easements running along the existing private road system are sandy with sparce vegetation. The dune within the beach access is an irregularly shaped frontal dune approximately nine feet at its highest point with a wooden walkway over. Vegetation on the dune is sparse and includes seaside panic grass, (Panincum amarum), sea oats (Uniola paniculata) and seashore elder (Iva imbricata). The annual erosion rate for the site is six feet per year, with a 25 recession line, for a 385' Area of Environmental Concern (AEC). The Atlantic Ocean is classified as coastal waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. In addition, review indicates that there are no known archeological sites or geological formations associated with the applicant's property. The ocean front lot involved with the applicant's project is a heavily used recreation area and beach access. The waters adjacent to this beach are regularly used for both commercial and recreational fishing. Existing development within the subdivision consists of single-family residences, most of which are used as vacation homes and seasonal rentals. Approximately 158 lots in the Villages at Ocean Hill remain undeveloped, and will not qualify for Building Permits until the effluent disposal problem has been resolved. Occupancy Certificates are also being withheld on twelve dwellings within the Villages pending Ocean Hill Joint Ventures Bio Report Page 4 resolution of the problem. In addition the existing Reverse Osmosis System is not sufficient to supply the Villages at Ocean Hill at build-out. PROJECT DESCRIPTION Ocean Hill Joint Ventures, propose to construct an ocean outfall to discharge RO concentrate into the Atlantic Ocean. The applicant also proposes to expand the existing RO facility from its present capacity of 80,000 gpd to 224,000 gpd, which will raise the waste stream from a maximum of 25,000 gpd to 75,000 gpd. The process will include piping the concentrate from the expanded water treatment facility north to an ocean front lot. The pipe will follow an existing utility easement along Ocean Trail and North Beach Access Road, to a community pool lot between lots 167 and 168 on Sandcastle Drive. The pipe will be placed along the southern side of the pool, pool house, and a wooden beach accessway. On the west side of the frontal dune the pipe will cross under the beach access, turn back to the east and continue through the dune, past the First Line of Stable Natural Vegetation, under the beach, and terminate at approximate mean low water level. The concentrate pipe will be four inches in diameter and buried in a three foot wide by three foot deep trench along the dirt access at the treatment site, existing utility easements and the beach access for a distance of approximately 4,600' to mean low water. The pipe will run under the beach 147' east of the FLSNV and terminate at a "T" head at approximate mean low water (MLW). The "T" head of the pipe will be a 4"x 40', 20 slot well screen encased in two feet of gravel surrounded by a porous fabric mesh (to prevent the gravel from migrating through the sand), and buried six feet below natural grade. A 10'x 60'x 10' trench will be excavated for the 40' well screen diffuser. Based on a 385' Ocean Hazard AEC and the placement of the pipe under the walkway for an additional four feet, approximately 1,167 square feet of land disturbing activity will occur within the Ocean Hazard AEC. Approximately 90' of pipe will be placed in the dry ocean beach landward of mean high water (MHW), resulting in 290 square feet of disturbance. Trenching of the pipe between mean high and mean low water will involve 456 square feet, and approximately 300 square feet of disturbance will occur below mean low water (The plans show that the pipe will terminate at MLW, but excavation for the installation will extend an additional five feet below MLW, resulting in the disturbance of 300 square feet below MLW). A total of 13,629 square feet of disturbing activity will occur landward of MHW and 756 square feet will be below MHW. A breakdown of the areas of excavation within the Ocean Hazard AEC are as follows: High ground excavation landward of the FLSNV = 13,339 sf High ground excavation seaward of the FLSNV, but landward of mean high water = 290 sf Excavation between mean high water to approximate mean low water = 456 sf Excavation below MLW = 300 sf Total Disturbance within the Ocean Hazard AEC = 14,385sf Ocean Hill Joint Ventures Bio Report Page 5 The applicant submitted a revised Environmental Assessment (EA) which is currently going through the State clearinghouse for review. It is also important to note that the EA states that the disposal system being proposed is the first of its kind. ANTICIPATED IMPACTS • Release of 12 dwellings for occupancy that have already been constructed in the Villages at Ocean Hill that have no water source. • Release of the remaining residential 158 lots within the Villages at Ocean Hill for development. • Release of the 10.7 acre commercial phase for development. • Excavation and backfill of 1.167 square feet of high ground within the Ocean Hazard AEC. • Excavation and backfill of 1,046 square feet of beach. • Excavation and backfill of shallow water bottom in the Atlantic Ocean, as well as the placement of 13 cubic yards of gravel fill around the diffuser. • Temporary increase in turbidity along the surf zone during installation of the diffuser pipe. • Based on average erosion rate of six feet per year, the structure will have to be replaced in the future. • At this time additional impacts cannot be documented since this is the first application of the diffuser system in the Atlantic Ocean.
