Box 27687 Raleigh, North Carolina 27611 Dear Ms. Moffitt: We are non-resident owners on Sunset Beach, and are extremely concerned about the CAMA Permit Application submitted by Edward and Dina Gore to bulkhead 1435 linear feet of shoreline on the feeder canal adjacent to Jinks Creek. There are large numbers of serious issues that have not been addressed, and remain unresolved as of this writing. Every one of these should be resolved before such a potentially detrimental project is even considered for approval. 1.This location is a nursery area. We are very concerned that activities in the area are a real threat to the reproduction of marine life in general. Marine animals use the grass to raise their young, as protection,and as a food source. When bulkheads are built, the grass usually dies leaving no nursery area. We feel strongly that this bulkhead will contribute further to the depletion of our already declining marine population. The SBWSA map declares the 4 finger canals that lead off this feeder canal as primary nursery areas. Should we not protect the only access to these areas from desecration? This also brings into serious question whether this feeder canal should also be declared as a nursery area. Regularly, people fish, crab, and catch shiners for use as bait out of this canal. This stands as proof that this is a nursery area, or at the very least is the only access to crucial nursery areas. What happens when the only access to and from the nursery areas and the ocean is compromised? 2. According to the Corps of Engineers files, 404 Wetlands have not been marked by this agency in the area to be bulkheaded. We have evaluated the area that is to be bulkheaded according to the criterion used by them to designate wetlands. We feel very strongly that 404 wetlands exist in the area, and that the Corps of Engineers should make an official determination as to whether or not 404 wetlands exist in the area. This should be done before any further action is taken. In Janet Russell's report, she stated that "Native trees and vegetation would be removed for the entire length of the shoreline." The application prepared for Mr. Gore by Land Management Group lists vegetation on the tract as "Salt marsh fringes the canal, wax myrtle, yaupon, and pines." There is no mention of live oaks which are in the area and are protected by town ordinance. Some of these plants are used to determine 404 wetlands. How will this removal affect runoff , flooding and erosion? 3. Mr. Gore was informed by letter on 12-20-99 that he must post a notice "CAMA Permit Applied far" at the proposed location. This has not been done at the writing of this letter. We believe this notice should and must be posted for the required period of time before any further action can be taken, The homeowners in this area are united in opposing any action that will endanger the environment or stability of the island or surrounding areas, They deserve the public notice requirement be enforced to provide them time to communicate their concerns to each other and to you. 4. This report lists the Land Classification from the land use plan as "Urban Transition." The area in question is one of the areas that SBTA and BEAT challenged the Land Use Plan Update in September 1998. The CRC ruled that all Areas of environmental Concern in Sunset Beach are classified as "Conservation." This area is beyond any doubt an AEC area. It is classified as "Conservation" in the Sunset Beach Land Use Plan. Bulkheading the 29 fifty foot lots will open the area to intense development contrary to the LUP definition of "Conservation." 5. We bring into question the total disturbed area as calculated in the application. It is listed as .82 acres. This does not take into consideration possible stockpile areas or access points to and from the site. These are not included. As you are aware, once the land disturbance exceeds 1 acre, other permits are required. When these areas are included in the disturbed area calculation the area disturbed will well exceed 1 acre. 6. Tubbs inlet is eroding and Jinks Creek is filling at an alarming rate, not to mention the devastating erosion on the West end of Ocean Isle. We believe this project will adversely impact our property as well as all these other endangered areas. It proposes to remove all vegetation and will leave us susceptible to erosion, flooding and filling. It will also endanger and deplete marine life, and destroy nesting and food supplies for birds and other animals. 7. The road right of way on North Shore Drive E is an unsettled issue. This project is directly influenced by the determination of a 30 foot Vs 60 foot right of way along the portion of North Shore Drive E that borders all of these lots along the feeder canal involved in this permit application. Walter Marley of the Brunswick County Health Department (on the advice of the attorney general's office)has frozen all percing activity until a settlement as to the road right of way in the area is resolved. At this writing, Mr. Gore has not contacted Mr. Marley as requested concerning the dispute. The 50 foot wide lots cannot contain 5000 square feet as stated in the permit application unless the ROW is 30 feet rather than 60 feet. (All the rest of North Shore Drive E has a 60 foot ROW.)30 feet of the ROW in this part of North Shore Drive E is included in the lot footage to make the lots contain 5000 square feet. This ROW dispute will most likely be settled in court. 8. Janet Russell has a paragraph in her recommendation, page T15A:07H.0208(7)(E), "Where possible, sloping rip-rap gabions, or vegetation shall be used rather than vertical sea walls." We do not believe this project should be permitted However: If all of the unresolved issues that we have raised are satisfactorily resolved, could this entire project not be stabilized with a sloping rip-rapped gabion, leaving all vegetation in place to control runoff, to preserve marine life, to preserve the vegetation in the area for nesting and feeding of birds and other animals, and to protect the surrounding areas from erosion. There are many issues that must be resolved. Questions that must be answered, agencies that must be employed and their input added to the equation, legal litigation, and environmental impact must be addressed before the permit in question is approved. This application is premature. Thank you in advance for your consideration of all our concerns. PROJECT SUMMARY: The applicant is applying to bulkhead 1435 linear feet of shoreline on a man-made canal adjacent to Jinks Creek. No other development is proposed at this time. Gore / North Shore Drive Bulkhead Page Two 9. PROJECT DESCRIPTION Mr. Gore's property is located on North Shore Drive, at the east end of Sunset Beach in Brunswick County. The property is located within the Estuarine Shoreline Area of Environmental Concern, just outside of the Inlet Hazard Area. There are 29 existing, vacant lots within the project area. The tract is listed on the application as being 67 acres in size, with the 29 lots representing only a portion of the total tract. Each lot is approximately 5,000 square feet in size. The 29 lots border a man-made canal on one side and North Shore Drive on the other side. The man-made canal connects to Jinks Creek, near Tubbs inlet. The applicant is proposing to construct a bulkhead along the rear of 28 of the lots bordering the man-made canal. The bulkhead would be approximately 1435 linear feet long. The length of the bulkhead is what makes this application a Major Permit submittal. Lot #1 is already bulkheaded. The lots and the shoreline are in a relatively natural state. The shoreline is sandy and is vegetated sporadically with a Spartina al =aflera marsh fringe. Just landward of the marsh fringe is a 3' vertical escarpment onto the high ground. The high ground lots are vegetated with trees, shrubs, and grasses - species common to barrier islands. There are two existing spots being used as boat ramps (unimproved). These areas will be bulkheaded across, doing away with the boat ramps. Alignment of the proposed bulkhead wall is landward of all wetlands and would be staked in the field prior to any work commencing under a permit. No wetland fill is being requested. No other type of construction or development is being applied for under this application. Any land-disturbance or construction (outside of the bulkhead installation) would require separate permitting. The waters of the canal are classified as SA by the Division of Water Quality. The area is not primary nursery area and is closed to shellfishing. However, the area is situated directly adjacent to Jinks Creek which is partially open to shellfishing with the adjacent marshes being primary nursery areas as determined by the Division of Marine Fisheries. 10. ANTICIPATED IlVIPACTS This project would result in the disturbance of at least .82 acres of high ground for the installation of the bulkhead. Native trees and vegetation would be removed for the entire length of the shoreline. The proposed work is being done as a processor to development of the 29 lots. Janet M. Russell / December 20, 1999 / Wilmington PROJECT NARRATIVE Purpose: Mr. Ed Gore proposes to install a wooden bulkhead above coastal wetlands on the canal side of lots 1 through 29 (1201-1701), North Shore Drive, Sunset Beach. This section of North Shore Drive extends from the intersection with Cobia Street to just past the intersection of 19' Street. A man-made canal is present at the rear of the lots so that the lots are situated between North Shore Drive and the canal. Total length of bulkhead proposed is 1,4351ft. Current Conditions: The bulkhead would be placed above the upper limit of wetlands which fringe the canal. Wetland type present is tidal marsh and vegetation includes Spartina alternflora and Spartina patens. There are no additional 404 jurisdictional wetlands on the site. A steep slope exists between the marsh and the adjacent upland, with an approximate 6' rise over several feet. Aerial photography from 1966 suggests the canal was excavated, in large part, through coastal marsh. The slope and upland which now exist is likely an artifact of spoil deposition. This relatively extreme slope for a coastal area prevents any natural marsh transgression. Given this landscape morphology, no wetland gain would be expected even over years of sea level rise. These same features subject the slope to erosion and the loss of upland area. Construction Methods: In an effort to stabilize the site and prevent further erosion, installation of the bulkhead will utilize good construction techniques. Filter cloth will be installed landward of V-groove sheeting to help retain soil and water behind the bulkhead over a long-term period. In addition, installation of the bulkhead will be reviewed by a licensed engineer. Stormwater Permit Status: Lots along the length of the proposed bulkhead have been platted since 1976. North Shore Drive is an existing road along this length, and both water supply and utilities are currently available. As the installation of bulkhead is the only proposed work, and no other State or Federal permits are required, a single-family exemption is requested. Measures to control stormwater run-off will include an elevational decline from the backfill behind the bulkhead to a roadside swale along North Shore Drive.
