You have our approval, in accordance with the attached conditions and those listed below, to impact 760
linear feet of unnamed intermittent stream in order to construct the Monroe Retail Center in Union County, as
described in your modified application received by the Division of Water Quality (DWQ) on July 26, 2004. After
reviewing your application, we have determined that this project is covered by Water Quality General
Certification Number 3402, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. The
General Certification allows you to use Nationwide Permit Number 39 when it is issued by the U.S. Army Corps
of Engineers (USACOE). Please note that you should get any other federal, state or local permits before
proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-
Discharge, and Water Supply Watershed regulations.
This Certification will expire when the associated 404 permit issued by the USACOE expires unless
otherwise specified in the General Certification. This approval is only valid for the purpose and design that you
described in your application. If you change your project, you must notify us in writing, and you may be required
to send us a new application for a new certification. If the property is sold, the new owner must be given a copy
of the Certification and approval letter; and is thereby responsible for complying with all conditions.
If the total wetland fill for this project (now or in the future) exceeds one acre, compensatory mitigation
may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached Certification, as well as the additional conditions listed below:
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and
waters or areas within 50 feet of all streams and ponds on the property. These mechanisms shall be put in
place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample
deed notification format can be downloaded from the 401/Wetlands Unit web site at
http://h2o.enr.state.nc.us/ncwetlands;
2. A final written stormwater management plan shall be approved in writing by this Office before the impacts
specified in this Certification occur. The stormwater facilities must be designed to treat the runoff from the
entire project, unless otherwise explicitly approved by the DWQ. Measures such as plunge pools, level
spreaders, and/or other velocity dissipaters will be constructed at all stormwater discharge points.
Also, before any permanent building is occupied at the subject site, the stormwater facilities (as approved
by this Office) shall be constructed and operational, and the stormwater management plan (as approved by
this Office) shall be implemented. The structural stormwater practices as approved by this Office as well as
drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall
o. be made without written authorization from the DWQ.

3. The culverts required for this project shall be installed in such a manner that the original stream profiles are
not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing
stream dimensions (including the pattern and profile) are to be maintained above and below locations of each
culvert. The culvert shall be designed and installed to allow for aquatic life movement as well as to prevent
head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream
grade shall be re-established, or if the pipes are installed in a perched manner then the pipes shall be
removed and re-installed correctly;
4. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the Preconstruction Notification application. All construction activities,
including the design, installation, operation, and maintenance of sediment and erosion control Best
management Practices (BMP) shall be performed so that no violations of state water quality standards,
statutes, or rules occur.
5. Erosion and sediment control practices must be in full compliance with all specifications governing the proper
design, installation and operation and maintenance of such BMP:
a. The design, installation, operation, and maintenance of the erosion and sediment control measures (the
measures) must be such that they equal, or exceed, the requirements specified in the most recent version
of the North Carolina Sediment and Erosion Control Planning and Design Manual (the Manual).
b. The measures shall be maintained on all construction sites, borrow sites, and waste pile (spoil) sites,
including contractor-owned or leased borrow pits associated with project.
c. The reclamation measures and implementation of these measures must be in accordance with the
requirements of the Sedimentation Pollution Control Act.
6. Sediment and erosion control measures should not be placed in wetlands or waters. However, if placement
of sediment and erosion control devices in wetlands and waters is unavoidable, the devices shall be removed
and the natural grade restored within six months of the date the Division of Land Resources has released the
project
7. Continuing Compliance. Mr. Poplin shall conduct his activities in a manner consistent with state water quality
standards (including any requirements resulting from compliance with section 303(d) of the Clean Water Act)
and any other appropriate requirements of state and federal law. If DWQ determines that such standards or
laws are not being met (including the failure to sustain a designated or achieved use), or that state or federal
law is being violated, or that further conditions are necessary to assure compliance, DWQ may reevaluate
and modify this certification to include conditions appropriate to assure compliance with such standards and
requirements in accordance with 15 A NCAC 2H.0507(d). Before codifying the certification, DWQ shall notify
Mr. Poplin and the USACOE, provide public notice in accordance with 15A NCAC 21-1.0503 and provide
opportunity for public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall
be provided to Mr. Poplin in writing, and shall be provided to the USACOE for reference in any permit issued
pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404 Permit for the
project.
8. Upon completion of the project, the applicant/responsible party shall complete and return the enclosed
"Certificate of Completion" form to the Division of Water Quality's 401/Wetlands Unit. Please send
photographs, upstream and downstream, of each culvert site to document correct installation along with the
Certificate of Completion form.

If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714
Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless
you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.

WATER QUALITY SECTION
Our client, RL Horvath Associates, requests modification to a recent Nationwide Permit 39
approval for the proposed "Monroe Retail Center" in Monroe, NC. The C _ I:d---
number for the project is 200430312 and the DWQ project number is 3-}82 The approval
dates for the PCN were February 6, 2004 and February 19 for the 404 an 401, respectively. The
request for modified permits are due to changes in the project limits and proposed site plans.
Specifically, the project will encompass approximately 2 additional acres along Highway 74 and
the placement of buildings/parking areas has changed. Proposed impacts to wetlands remain the
same while proposed stream impacts will be lessened by 6 linear feet. Proposed impervious
percents are 32%. The project engineer proposes extended detention wetlands that meet DWQ
storm water requirements.
The additional area for the project has been reviewed in the field by S&EC. No jurisdictional
wetlands or streams were identified in the area. S&EC sent a notification of our findings to the
USACE with a letter and supporting documentation.
During the initial 401/404 review period S&EC met with representatives from the USACE and
NC DWQ on site to evaluate jurisdictional features and determine compensatory mitigation
requirements. Based on those meetings both agencies determined the proposed impacts did not
require compensatory mitigation. Upon completion of the project approximately 270 linear feet
of stream channel will remain undisturbed.
Due to the minor changes in proposed impacts we are requesting the existing permits to be
modified based on the current plans. The proposed changes, in our opinion, will have no effect
on mitigation or storm water requirements. We request modified permits to accurately reflect
final project construction for compliance inspections. Proposed site plans are attached.

Staff visited the site on October 24, 2003. Applicant requests approval to pffipe approximately 700 ft
of stream for the constriction of a retail center on Highway 74 in Monroe.
Historically the land tract (42 acres, flat/level topography) has been utilized for agricultural purpogps
and is currently being row cropped As in most cases with land that has been farmed, the channel
has been ditched and straighten No discernable stream features or aquatic life were observed. The
berg of the channel was checked for hydric soil None was observed. Recommend approval. Issued

On December 31, 2003 the Division of Water Quality (DWQ) was notified by receipt of your application
regarding your plan to fill wetlands or waters for the purpose of construction of a commercial retail center in
Union County. Approval from DWQ is required to disturb these areas. Please provide 7 copies of the following
information and refer to the DWQ # listed above in your reply. Please show these on maps of suitable scale (for
instance 1" = 100 feet) so we can begin to determine your projects' compliance with 15A NCAC 2H .0500.
1. Please provide a signed and dated copy of page 12 of the application.
2. The proposed stormwater pond will need to be redesigned as a constructed wetland since this project
is in a water supply watershed.
Please telephone Mike Horan at 919-715-3404 if you have any questions or would require copies of our rules or
procedural materials. This project will remain on hold as incomplete in accordance with 15A NCAC 2H.0505(c).
The processing time for this application will begin when this information is received. If we do not hear from you
by writing or by fax at (919) 733-6893 within three (3) weeks we will assume you no longer want to pursue the
project and will consider it withdrawn.

Our client, RL Horvath and Associates, requests the use of Nationwide Permit 39 for the
proposed "Monroe Retail Center" in Monroe, NC. The current landowners are Thomas Ray
Poplin and Ruth Poplin. The subject property totals 42 acres and is adjacent to Hwy 74
approximately 2.5 miles west of Monroe. The site is shown on the attached USGS Topo Quad
vicinity map. Surface waters on the property flow to Stewarts Creek in the Yadkin/Pee Dee River
Basin.
The applicant proposes to impact 766 linear feet of intermittent channel for construction of the
proposed Monroe Retail Center. In addition 1226 square feet of open waters (drained pond) is
proposed for impact. S&EC has met representatives from the USACE and NC DWQ on-site to
confirm our delineation and determine stream mitigation requirements. Both agencies classified
the stream in question as intermittent and not subject to mitigation. It appeared to all parties the
stream channel has been straightened in the past for agricultural purposes. Additional past
impacts appeared to result from construction of an existing sewer line. Currently the property
supports agricultural fields as well as two homes.
Site plans for the proposed development include construction of a large retail center and
supporting parking areas. The project engineer has dedicated areas for required storm water
management facilities. In addition to construction of storm water facilities the project will avoid
impacts to approximately 270 linear feet of stream channel.
Attached please find: 1) A completed Pre-construction Notification 2) signed Agent
Authorization Form, 3) USGS topo quad vicinity map, 4) Union County Soil Survey map, 5)
Construction Plans, 6) Cross section view of proposed pipe, 7) Justification letter from the project

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwettands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,

Please accept the attached submittal for wetland impacts to the intermittent channel
located on existing farmland totaling approximately 43 acres south of US Highway 74,
west of Monroe, NC. This location is found on. the "Bakers" USGS Topographic
Quadrangle. The footprint shown for this economically viable retail center has been
adjusted and adapted to minimize the amount of impacts necessary. This layout will
preserve approximately 25% of the existing channel adjacent to US 74 without impacts.
The major portion of the channel that will be impacted due to this project is located in an
existing sanitary sewer easement and could therefore already be considered impacted.
While this intermittent channel is considered jurisdictional, a previous field visit by the
Corps and DWQ have declared the quality of the waters to have no mitigation
requirements.
