Dear John,
I have enclosed seven (7) sets of the application materials for a Nationwide 18 Permit and
401 Certification to authorize a driveway entrance to the interior of lots 9 and 10 on
Towles Road. I met with Jim Gregson of DCM and we marked the upper extent of their
Coastal Wetland AEC with pin flags. Our planned driveway alignment remains outside of
that area. The driving surface for the driveway has been reduced to a 12' width based on
consultation with the Corps of Engineers. The resulting footprint of the 404 wetland fill
area is now 1096 square feet (0.025 acre). We have also identified two wetland creation
areas on site that will provide a total of 1137 square feet of mitigation (>1:1). The
mitigation areas will be graded down to the elevation of the neighboring wetlands and
planted with Eleocharis spp, Iva frutescens, Cyperus spp and other wetland species found
in the area. These plants in the adjacent wetlands will be transplanted into the re-graded
areas on a 2' average spacing. An as-built report will be prepared and submitted to the
Corps to document the wetland creation areas and monitoring/reporting will be
performed on an annual basis for two years thereafter. Please contact me with any

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
In order to provide a stable and safer lot entry while avoiding impacts to the Coastal Wetland
AEC, the driveway crossing is proposed as shown. The crossing is located beyond the limits of
the flagged AEC as delineated by DClyf. The proposed entry site allows an easier turning angle
off of Towles Road and a 12' wide usable driving surface. The former crossing, now bordered
with Coastal Wetland AEC has a marginal -9' surface and a perpendicular alignment with
Towles Road producing a sharp turn into the property. This condition may prove hazardous for
emergency vehicles and trucks delivering concrete and lumber to the future home construction
site The proposed driveway will feature vertical concrete retaining walls as it crosses the ditch
near Towles Road to help minimize the total fill footprint within this lower area. An 18"
reinforced concrete pipe will be aligned with the ditch location to prevent backup during storms
above this location. An 8" PVC pipe will be installed at the driveway midpoint to provide for an
outlet for sheetflowing water in that relatively flat location. Driveway width was reduced from
an original 20' planned surface width following consultation with the Corps. Prior to placement
of the driveway fill silt fencing will be installed outside the perimeter of the fill work area to
prevent sediment movement into the adjacent wetland. The silt fencing will remain in place until
stabilization of the driveway edges is accomplished with the planned concrete retaining walls
and riprap side slopes.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.ne.tis/newet]ands/strm,ide. html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
On site mitigation in the form of creation is proposed in two shown locations on the western
side of the property. The upland in these areas will be graded down to adjacent wetland
elevations and planted with Fleocharis y Iva f-utescerns Cyperus shp and other wetland
species found on the site These plants found in the adjacent wetlands will be transplanted
into the regraded areas on a 2' average spacing An as-built report will document the wetland
creation areas and monitoring will be performed on an annual basis for two years afterward

with reports sent to the Corps Supplemental planting or site work will be performed as
needed to maintain an 80% plant survival rate.
