The recent plan for the remediation of the riparian buffer will be revised to show the full 50' buffer as requested despite being on state right-of-way. DWQ # 03-1524 Granville County DWQ Project No. 03-1524 Granville County APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Tar- Pamlico River Buffer Protection Rules (15A NCAC 2B.0259) with ADDITIONAL CONDITIONS Dear Mr. Ellington: You have our approval, in accordance with the attached conditions and those listed below, to place fill within or otherwise impact, 40 linear feet of stream, impact 4000 square feet (ft2) of riparian buffers (associated with installation of the road crossing), remove an unauthorized 40 linear foot culvert, and the after the fact impacts to approximately 225 linear feet relocated stream as you described in your application dated November 4, 2003 and in the additional information dated May 6, 2004. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3404. The Certification(s) allows you to use Nationwide Permit 14 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0259. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, and Non-discharge regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. Erosion and Sediment Control Practices : Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation, and operations and maintenance of such Best Management Practices: a. The erosion and sediment control measures for the project must be design, installed, operated, and maintained in accordance with the most recent version of the North Carolina Erosion and Sediment Control Manual. b. The design, installation, operation, and maintenance of the erosion and sedimentation control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Erosion and Sediment Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste (spoil) projects, including contractor- owned or leased borrow pits associated with the project. c. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwater routing and treatment shall be on site at all times If land disturbance area is below the threshold, where a Division of Land Resource (DLR) or a DLR delegate program approved Erosion and Sedimentation Control Plan is not required or the land use does not trigger an Erosion and Sediment Control plan requirement (e.g. Agriculture or Forestry), then measures, construction sequencing, and control practices must be installed such that sedimentation to waters is prevented. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwater routing and treatment shall be on site at all times. 4. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, streams or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 5. Construction Stormwater Permit NCGO10000 Upon the approval of an Erosion and Sedimentation Control Plan, issued by the Division of Land Resources (DLR) or a DLR delegate local erosion and sedimentation control program, an NPDES General stormwater permit (NCGO10000), administered by DWQ is automatically issued to the project. This General Permit allows stormwater to be discharged during land disturbing construction activities as stipulated by conditions in the permit. If your project is covered by this permit [applicable to construction projects that disturb one (1) or more acres], full compliance with permit conditions including the sedimentation control plan, self-monitoring, record keeping and reporting requirements are required. A copy of this permit and monitoring report forms may be found at http://h2o.enr.state.nc.us/su/Fonns_Documents.htm. 6. Deed Notifications Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to I Mark Ellington DWQ Project No. 03-1524 Page 3 of 3 impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. On October 6, 2004, the Raleigh Regional Office of the Division of Water Quality issued a Notice of Violation for an unauthorized stream impacts from culverting, excavation, relocation of the stream. Accordingly, the riparian buffer restoration, as depicted in Pre-construction application, attachments, and the plans labeled Oxford Estates Subdivision, Lots # 16 -22 City of Oxford, Granville County, North Carolina and dated 11/12/03 (received with your letter dated May 6, 2004) must be implemented and stabilized by January 31, 2005. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. The authorization to conduct work in waters that is authorized by the Certification shall expire upon expiration of the 404 or CAMA permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the Tar-Pamlico riparian buffer protection rule as described within 15A NCAC 2B .0259. Mr. Ellington has been instructed to reinstall the 66" metal culvert pipe to a depth of at least one foot below the grade of the streambed to meet USACE compliance. The second culvert pipe requested has been denied due to the 300' stream impact limit for NWP 14 regulations. We have revised the plan to show the location of the proposed reinstalled pipe and the full riparian buffer as requested in you letter of 14 January 2004. In addition, this office received a file copy of the October 6, 2003, Notice of Violation issued to you from the Raleigh Regional Office of the Division of Water Quality. After review of this information, we believe that your project should be place on hold. We will require you to address the following items in order to allow processing of your project to continue pursuant to 15A NCAC 2B .0500. 1) You have proposed a total of 330 feet of stream impacts in your application (290 feet of "after-the-fact" stream impacts and 40 additional feet of proposed stream impacts). However, you have not indicated what type of 404 Permit you are going to secure from the US Army Corps of Engineers. In order for the Wetlands/401 Unit of the Division of Water Quality to proceed with review of your project, you must determine from the US Army Corps of Engineers [(919) 876-8441] what type of permit can be used for this project. Specifically, DWQ needs to understand whether a Nationwide Permit (e.g. NW 39 or NW 32) or an Individual Permit may be issued by USACE. Please respond to this matter in writing (Attention Danny Smith, Wetlands/401 Unit, 2321 Crabtree Blvd., Raleigh NC 27604-2260). 2) Also, please provide plans that completely depicts the footprint of the riparian buffer. That is, the plans should clearly show the entire buffer (even along the areas immediately parallel to Dove Road). A Notice of Violation from the Raleigh Regional Office has been issued for this project. It is the understanding of this office that the subject 401Water Quality Certification request represents your efforts to abate violations and stem or minimize the possibility of a Civil Penalty Assessment. As explained in the October 6, 2003, Notice of Violation, penalties of up to $25,000.00 per day for each violation may be assessed. Also, Ms. Edwards conducted a follow up site visit on September 8, 2003 accompanied by Mr. Danny Smith from the Central Office. During these site visits, the investigators took photographs, measurements, and made observations of the respective stream impacts along an unnamed tributary to Fishing Creek, a Class C Nutrient Sensitive Waters in the Tar-Pamlico River Basin. Approximately, 500 linear feet of stream has been channelized and diverted, this includes approximately 50 linear feet of stream that has been piped. Riparian Zone (stream-side) impacts from fill material was observed. These impacts took place in lots # 16, 17, 18, 19, 20 and 21 on the east side of Dove Road within the Oxford Estates Subdivision. A DWQ file review confirms that impacts to the stream and riparian zone had occurred prior to the submission of a Pre-Construction Notification (PCN) or any authorization, permit or 401 Water Quality Certification from the DWQ. As a result of the site inspections and file review, the following violations are noted: 1) failure to properly secure a 401 Water Quality Certification; 2) Riparian Buffer Zone violations; and 3) Removal of best usage. Violation 1: 401 Water Quality Certification A DWQ site visit and file review confirmed that approximately 500 linear feet of stream (which includes 50 feet of piped stream) had been channelized and diverted prior to the proper securing of a Nationwide Permit from the United States Army Corps of Engineers (USACOE). A file review indicates that the USACOE has not authorized use of a Nationwide Permit for this activity or has notification been provided by the USACOE for this activity. The review confirmed that a Pre-construction Notification had not been received by DWQ for this project and a 401 Water Quality Certification had not been issued, nor is the activity covered by a General 401 Water Quality Certification. A 401 Water Quality Certification is required for the above-mentioned impacts pursuant to 15A NCAC 2H.0500. The purpose of these Rules is to protect and preserve riparian buffers in the Tar-Pamlico River Basin, such that riparian communities may maintain their nutrient removal functions to waters that are nutrient sensitive. Specifically, this Rule applies to the 50-foot wide riparian buffers directly adjacent to surface waters (intermittent streams, perennial streams, lakes, ponds, and estuaries). The protected riparian buffer has two zones as follows: (a) Zone 1 [measured from stream bank landward for 30 feet] shall consist of a vegetated area that is undisturbed except for uses provided for in Subparagraph (6) of 15A NCAC 213 .0259 and (b) Zone 2 [the outer 20 feet, landward from the outer 30 foot edge of zone I ] shall consist of stable vegetated area that is undisturbed except for activities and uses provided for in Subparagraphs (4) and (6) of 15A NCAC 2B .0259. A DWQ file review was performed and confirmed that there was not a Pre-Construction Notification Application (PCN) received for this project. Also, no request, or a DWQ practical alternative determination, variance or authorization had been issued for the impacts to the riparian zone. As a result the following riparian buffer rule violations are noted: Tar-Pamlico River Buffer Rule 15A NCAC 2B .0259 Deposition of fill, grading and excavation has occurred in the riparian zone, a violation of the requirement that Zone I and Zone II consist of stable, vegetated area that is undisturbed except for activities and uses provided for in Item (6) of the Rule. Further, notification was not provided to DWQ prior to the riparian zone impacts and no Variance or Practical Alternative Request was received prior to the Riparian Zone impacts, for the respective excavation and the deposition of fill. Violation 3: Preclusion of Best Usage A DWQ site visit and file review confirmed that approximately 500 linear feet of stream impacts occurred to an unnamed tributary to Fishing Creek. Further, these impacts occurred prior to the proper securing of a Permit from the USACOE and a 401 Water Quality Certification from DWQ. The impacts resulted in the removal of the respective stream bed substrate, and the channel footprint. These impacts have resulted in a stream standard violation. Specifically, 15A NCAC 2B .0211 (2) states that the preclusion of best usage, which include aquatic life propagation, biological integrity, wildlife, and secondary recreation, and agriculture represent a water quality standard violation. This Office requires that violations, as detailed above, be abated immediately. Also please note, these violations and any future violations are subject to civil penalty assessment of up to $25,000.00 per day for each violation. This Office requests that you respond to this letter, in writing, within 20 days of receipt of this Notice. Your response should address the following items: 1) Please explain why no authorization was sought for these impacts. 2) Please provide a map that exactly details the number of linear feet of stream impacts that have occurred. You should also indicate the amount of streamside buffer impacts (area) in your response. 3) Please provide a restoration plan detailing how material will be removed from the buffer zone. As a part of this plan, you should provide an account of the site that indicates the length of streamside area and the amount in linear feet of the streamside buffer area that was impacted. This information should be depicted on the map you provide. 4) Your restoration plan should clearly depict how diffuse flow of stormwater will be maintained. Also, any materials to be removed from the buffered areas should be place in uplands outside of the riparian zone. 5) Please indicate in your response a schedule with dates detailing when streamside area will be restored. r Marts tinngcon 10/062003 6) If you believe that the impacts to the stream and riparian zone cannot be resolved, please explain why. This explanation must accompany a Pre-Construction Notification form (attached). This explanation and form are necessary for a DWQ review of an after-the-fact Authorization request for the modified stream. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Page 9 of 12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
