Island Lake for the purpose of installing rip rap to stabilize approximately 190 feet of shoreline, as described within your application dated July 7, 2003 and in your updated Duke Power Shoreline Management Plan received February 11, 2004. After reviewing your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3373 (GC3373). The Certification(s) allows you to use Regional General Permit No. 198200030 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0243. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Duke Power regulations and permits. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This Certification replaces the one issued to you on July 22, 2003. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us anew application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. Diffuse Flow An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B .0243(5). The project is located in Mecklenburg County. The requirements that we have voluntarily imposed on this development include: A 100' minimum setback from the lake. A '/z acre minimum lot size A maximum impervious area of 24% per lot. Only plants less than 2" in diameter may be removed from the buffer area. No mechanical clearing is allowed in the buffer area. The project will be served by Charlotte Mecklenburg Utility Department for water and sewer systems. We are planning a total of 14 community boat slips to serve the offwater lots. They will be placed in one location within the project boundary. There. will be no dredging needed for these 14 docks. We have completed a depth survey for.each of the docks. The Corps of Engineers has visited the site with our consultant, Len Rindner. This is a standard part of our development process whether the property has lake front or not. The purpose is to identify wetlands within the entire property. This is done during the preliminary design stages of the project so as to design around any wetland-areas. We have no wetland impacts on this site. Any wetland area on the property will be identified on all record plats as shown on the attached plat, and the owners will know that no disturbance is allowed in these areas. The environmental areas have been identified with environmental flagging and will be restricted in the homeowners association documents stating that no land disturbing activities will be allowed in the environmental areas. After construction of the docks, lighting will be installed. to laminate after dark. Low voltage motion sensor activated lights shielded for glare so as not to intrude upon adjoining property owners will be installed on the community boat slips. There will also be reflective devices on the ends of all docks. The docks will be constructed at the shoreline and floated into place with minimal impact to the lake area. Boating is generally heavier on weekends and holidays during the months of May- August with lighter traffic during the week. From September to April there are more fishing boats than general boat cruising and traffic is substantially lighter. Boat traffic includes some powerboat cruising, jet skis, pontoons, fishing, limited sailing and water skiing. The overall impact of this facility will be minimal to the area. The project will have no effect on adjoining property owners. The public "attractions" near this project are the Riverbend Access Area and The Overlook commercial/residential dock facility. The Riverbend Access Area is over one (1) mile from the site. The Overlook commercial/ residential dock facility is across the cove from the proposed Preservation Pointe piers and has a slow no wake zone established 500' north of the project. Preservation Pointe FERC 1. Float sections are anchored with self driving steel piles. We understand that NCWRC discourages dredging shallow water areas with productive bottom, wetlands, or submerged aquatic vegetation and no dredging will be required for these piers. The total length of piers, floats, and docks shall not exceed 120' or one-third the width of the cove whichever is more restrictive. - Shoreline stabilization shall be dry staked rip rap and will contribute to the erosion control. While installing the rip rap, trees and vegetation: will be left in their natural state whenever possible to maximize the natural beauty of the lakeshore. Any trees and vegetation that must be removed will be replace immediately as per the condition set forth by the Division of Water Quality. See the attached construction drawings that depict the materials and specifications to be used in the installation. The detailed dock layout described in response to question number 2 depicts the layout the docks will conform to. See also the attached site plan. The facility will be used by residents of the adjacent community for access of offwater lots to the lake. • Preservation Pointe FERC 5. A showing that the proposed construction will be designed to avoid or minimize conflict with the natural, historic, and scenic values and resources of the project area. The construction of the proposed floating dock facility is designed to allow access to the lake at controlled points, thereby minimizing disturbance to the natural shoreline. The proposed construction is planned so as not to conflict with the natural, historic, and scenic values of the project. The 100' lake buffer will be identified with continuous environmental flagging. Vegetation and' trees 2" and larger within the buffer will be maintained. Any disturbance near the lake will be protected by having 2 rows of silt fence and the first row will be reinforced with hay. All erosion control will be checked and maintained regularly to prevent any sedimentation and erosion. from taking place. The floating docks will be assembled on shore, floated into place and held in place by telescoping, self- driving pipe piles. Throughout the construction of the pier(s), North Carolina Sedimentation Control Law shall be observed by exercising standard erosion control and sedimentation practices. The shoreline along the pier facility may be stabilized with rip rap as necessary to reduce shoreline erosion from any ripple wave activity associated with piers. Soil stabilization will be provided at pier connection points. Bio- engineering will be used to replace any vegetation removed or impacted as a result of the onshore pier connection points. Shoreline stabilization shall be dry staked rip rap and will contribute to the erosion control. -While installing the rip rap, trees and vegetation will be left in their natural state whenever possible to maximize the natural beauty of the Lakeshore. We understand that NCWRC discourages dredging shallow water areas with productive bottom, wetlands, or submerged aquatic vegetation and no dredging will be required for these piers. Additionally, we understand it is the US Army Corps of Engineers determination if a 404 permit is required for this project or if a. 401 Certification is necessary. We do not anticipate permits being required as we have no dredging associated with these piers. While we do not have any dredging associated with these piers we do understand that any excavation activities would have to follow Duke Power Excavation Guidelines and any special conditions specified by the NC Department of Environment and Natural Resources. Shoreline vegetation for enhanced habitat and shoreline erosion control will be utilized, as well as Duke Power's Fish Friendly Pier construction practices. Fish baskets will be provided to reduce pressure on aquatic wildlife in the vicinity of the piers. Natural and scenic values and resources shall receive little or no impact. Low voltage motion sensor activated lights shielded. for glare so as not to intrude upon adjoining property owners will be installed on the community boat slips. The docks have been located inside the project confines and erosion control measures will be implemented throughout the construction process. The Covenants, Conditions and Restrictions for the Community allow for the removal of trees with a caliper of less than four inches. The pathway to the docks-will meander around mature trees to minimize impact. Preservation Pointe FFRC Enviromnental Safety The residents of Preservation Pointe will be provided with training material to teach them how to properly handle gasoline containers. The training material will also address additional safety and enviromnental concerns and will be similar to the attached pages. Boating Safety Each pier, slip, and ramp shall be constructed off site and floated into place. This will be scheduled during the week while boat traffic is minimal. Lighting and reflectors will be in place around the slip area for safety. The Overlook Common Pier Facility is across the lake and has a no wake zone established 'approximately 500' north of our project. We will continue to observe the no wake zone. This situation will eliminate a large amount of traffic from our area. Boat Traffic The location of the proposed slip area does not extend into the main traffic area of Mountain Island Lake. These facilities will be used by the residents of Preservation Pointe and should decrease the amount of traffic at other public landings. There are no historic values or resources in this particular location that may be adversely impacted, as confirmed by the attached letters from various commenting agencies. In addition, the area southwest of the piers that has been redesignated as environmental area by Duke Power will be preserved in its natural state until such time as Duke Power amends its Shoreline Managernent Plan. Mountain Island Lake with its 3235 acres of water, provides drinking water for over 600,000 residents of Mecklenburg County. against the law. These products contain toxic compounds which are harmful to humans as well as wildlife, including fish. Used oil should be stored in a clean plastic container with a tight lid.. Used oil and oil- covered rags should not be placed in with household garbage. Properly dispose of oil and rags at either of the following household hazardous waste recycling centers. N. Mecklenburg: 875-1563 Hickory Grove Recycling Center: 535-3781 2. Do not "top-off' your boat's gas tank when refueling. If your gas tank overflows, wipe up spill immediately with a rag. Do not hose it off with water or use detergents (petroleum products will adhere to the detergent and sink to the bottom of the lake causing additional damage to the environment.) 3. Install a fuel/air separator on your boat to prevent accidental overflows from the tank vent line. Rinse your boat with fresh water after each use. Avoid the use of degreasers and other strong chemicals. If you are using detergents to clean your boat/ car, do so in a place where the soapy water run off will not flow into a storm drain or directly into the lake. Leave a buffer of natural vegetation between the shoreline or the lake and the grassed portion of your yard. Natural buffers provide stability to the shoreline, filter out pollutants, sediment, excess nutrients and provide important wildlife habitat. Contact the Mecklenburg County Department of Environmental Protection for information on creating natural Stream Buffers. In addition to being a source of drinking water for Mecklenburg County residents, Mountain Island Lake provides: ? Recreational opportunities for fishermen, boating, and outdoor enthusiasts. ? Water, food and habitat for a great diversity of wildlife species. ? Beautiful scenery and scenic sunsets. ? A boost to the local economy. Everyone living in Mecklenburg County has an impact, direct or indirect, on the water quality of Mountain Island Lake. Residents living along the shoreline and using the lake for recreational purposes have an even greater responsibility to protect surface water quality. Non-point source pollution rs one of the biggest threats to the water quality in Mountain Island Lake. Oil, residual pesticides and fertilizers, bacteria and sediment are picked up by storm water as it flows over streets, lawns, and the general landscape. This type of pollution increases as population and impervious surfaces (streets, parking lots, driveways) increases. TVPKI? OV SU FACE' WATER POLLUTION PETROLEUM PRODUCTS Discharge of petroleum products such as oil and g as directly into the lake, storm drains or on the ground is LITTER Trash directly enters the lake when it is thrown off docks or boats. When careless individuals throw trash out their car window or leave their garbage on the side of the road, it can enter the storm drain system and eventually the creek or lake. Trash ruins the scenic nature of the lake and proves hazardous to wildlife. FERTILIZERS AND PESTICIDES Many, pesticides contain a variety of toxic compounds and heavy metals which are harmful to the environment. Fertilizers contain large amounts of nutrients which stimulate plant growth. When either of these are applied improperly or in excess, they can enter our lakes or creeks, contaminating the water and killing fish and other aquatic wildlife. Report any spills or pollution problems to the Water Quality Section of the Mecklenburg County Department of Environmental Protection (MCIDEP) at 336-5500. The construction and utilization of the boat slips will have no effect and will not require changes in the project operation. 11 Preservation Pointe FERC 7. Discussions of any adverse environmental effects, which cannot be avoided should the proposal be implemented and how such adverse effects, are proposed to be minimized. The only environmental effects that may be realized would be shoreline-based. These areas will be minimized and will adhere to North Carolina erosion control guidelines to control sediment from entering the lake. The shoreline along-the pier facility does not require stabilization. Soil stabilization will be provided at pier connection points. Bio-engineering will be used to replace any vegetation removed or impacted as a result of the onshore pier connection points. Additionally, enhancements, i.e., structures or revegetation, for fish habitats will be provided to replace or enhance any vegetative fish habitat that maybe impacted. A no-wake zone will be established per the Mountain Island Lake Marine Commission ordinance to limit the impacts to fish habitat and shoreline from wave action. Construction Minimal disturbance should occur during the construction of the proposed project. Rip Rap will be place by hand and transported to its location with a low-pressure rubber track machine. The slips, piers, and ramps shall be constructed off-site and floated into place. Sedimentation and erosion control measures shall be in place and maintained during the construction period. The 100' lake buffer will be identified by placement of a continuous line of environmental flagging. Trees, 2" and larger within the 100' lake buffer will be preserved and protected. No trees larger than 2 inch caliper are to be removed except for dead or diseased trees. Shoreline Disturbance within 100 feet of the Project Boundary There shall be no disturbance within the 100 feet buffer that has been established. Access to the three piers shall be a mulched foot path approximately 4'-6' wide. The mulched footpath will meander through the existing trees, and trees 2" and larger will be preserved and protected. There will be a dry storage area for boats and RV's on the property approximately 1500' from the lake boundary. This will be a pervious surface surrounded by a fence with no building or dry stack storage. This pervious surface will be approved by Mecklenburg County LUESA prior to installation. Einviromnental Effects As shown on the attached maps, we are preserving in its natural state the area redefined as environmental area until such time as it is shown on Duke Power Lake Management Map. All precautions will be taken to minimize any adverse effects on the environrient. Minimal disturbance of the placement of Rip Rap shall occur. The docks will be constructed off-site and floated into place. This will minimize any possible impact to the natural vegetation and marine life. These methods of construction will minimize the adverse effects,to the shoreline, vegetation, and marine life. Preservation Pointe FERC • 8. A statement as to why the proposed action is in the public interest. The public interest will be served by providing a safe area for boating activities for numerous individuals of this community in a relatively small space. Additionally, with the placement of low voltage motion sensor activated lights shielded for glare, the public will be better served with this community slip than with multiple individual piers having their own individual lighting sources that may be more intrusive upon the adjoining owners. The public interests will also be protected by limiting the number of shoreline connections and their potential for soil, vegetation, and fish habitat impacts. 0 • Preservation Pointe FERC . • 9. Describe what measures will be used to insure boating safety in the vicinity of the proposal during and after construction activity. A slow no wake zone has already been established approximately 500' North of our project. We, will continue to have slow no wake zones which will be established prior to commencement of construction and construction limit buoys will be installed during construction. No more than one third the cove will be used for construction. A boat lane will be maintained for safe passage of watercraft. Night navigational safety devices & low voltage motion sensor activated lights; shielded for glare will provide boaters with visual location of piers at night. The proposed project is located off the main channel. The contractor that will build and install the facility will be an appropriate licensed and bonded dock construction company. The floating ® docks will be constructed at the contractors designated site and floated into the proposed site. There will be escort boats, along with the necessary lighting to insure a safe installation. This work will be done during the weekdays while boating traffic is light. Preservation Pointe FERC 12. Describe the magnitude and pattern of existing boat traffic in the area, including any existing recreational uses (public or private) at and near the proposal, including areas of attraction such as marine, gas facilities, restaurants, and mooring areas. Describe the effect of increased boat traffic, associated with the proposed facilities, on the existing boat traffic in the area. Existing boat traffic in the area comes from the few private piers used by adjoining owners. Boat traffic associated with this proposed facility will not have any detrimental effect. A no wake zone will be established for this facility which will limit, the impact of any wave action upon the adjoining owners and their private facilities. Waters President Preservation Pointe FERC C7 Preservation Pointe Summary Preservation Pointe is a restricted 77 lot single family residential subdivision situated on 93.34 acres of land along the shoreline of Mountain Island Lake. The project is located in Mecklenburg County. The requirements that we have voluntarily imposed on this development include: A 100' minimum setback from the lake. A'/2 acre minimum lot size A maximum impervious area of 24% per lot. Only plants less than 2" in diameter may be removed from the buffer area. No mechanical clearing is allowed in the buffer area. The project will be served by Charlotte Mecklenburg Utility Department for water and sewer systems. We are planning a total of 14 community boat slips to serve the offwater lots. They will be placed in one location within the project boundary. There will be no dredging needed for these 14 docks. We have completed a depth survey for each of the docks. The Corps of Engineers has visited the site with our consultant, Len Rindner. This is a standard part of our development process whether the property has lake front or not. The purpose is to identify wetlands within the entire property. This is done during the preliminary design stages of • the project so as to design around any wetland areas. We have no wetland impacts on this site. Any wetland area on the property will be identified on all record plats as shown on the attached plat, and the owners will know that no disturbance is allowed in these areas. The environmental areas have been identified with environmental flagging and will be restricted in the homeowners association documents stating that no land disturbing activities will be allowed in the environmental areas. After construction of the docks, lighting will be installed to luminate after dark. Low voltage motion sensor activated lights shielded for glare so as not to intrude upon adjoining property owners will be installed on the community boat slips. There will also be reflective devices on the ends of all docks. The docks will be constructed at the shoreline and floated into place with minimal impact to the lake area. Boating is generally heavier on weekends and holidays during the months of May- August with lighter traffic during the week. From September to April there are more fishing boats than general boat cruising and traffic is substantially lighter. Boat traffic includes some powerboat cruising, jet skis, pontoons, fishing, limited sailing and water skiing. The overall impact of this facility will be minimal to the area. The project will have no effect on adjoining property owners. The public "attractions" near this project are the Riverbend Access Area and The Overlook commercial/residential dock facility. . The Riverbend Access Area is over one (1) mile from the site. The Overlook commercial/ residential dock facility is across the cove from the proposed Preservation Pointe piers and has a slow no wake zone established 500' north of the project. 0 Preservation Pointe FERC • 1. The North Carolina Wildlife Resources Commission (NCWRC) is authorized to comment and make recommendations which relate to the impacts of this project on fish and wildlife through.the Federal License of:Water;Res.ource.Project Act (Federal PowPx'Act 16U S.C. 791a et sethe`Clean.Water.Act of 1977, and the Fish and Wildlife Coordnlation Act' (48 S.-tat: 401, as amended; 16 U.S.C. 1-667d). The proj ect will provide fourteen (14) boat slips for non-waterfront lots.. No dredging or shoreline stabilization is proposed. The area is"located in an area indicated on Duke Power Shoreline Management maps as suitable for this type of activity. The NCWRC has no objection to the project provided the following general dock recommendations are implemented: 1) Boat docks should not be placed so as to impede or block navigation or create a navigational hazard for -recreational vessels. 2) If dredging is necessary, it should be done in the dry if possible when the lake level is low. The construction of the proposed floating dock facility is designed to allow access to the lake at controlled points, thereby minimizing disturbance to the natural shoreline. The proposed construction is planned so as not to conflict with the natural, historic, and scenic values of the project. The 100' lake buffer will be.identified with continuous environmental flagging. Vegetation and trees 2" and larger within the buffer will be maintained. Any disturbance near the lake will be protected by having 2 rows of silt fence and the first row will be reinforced with hay. All erosion control will be checked and maintained regularly to prevent any sedimentation and erosion from taking place. The floating docks will be assembled on shore, floated into place and held in place by telescoping, self- driving pipe piles. Throughout the construction of the pier(s), North Carolina Sedimentation Control Law shall be observed by exercising standard erosion control and sedimentation practices. The shoreline along the pier facility may be stabilized with rip rap as necessary to reduce shoreline erosion from any ripple . wave activity associated with piers. Soil stabilization will be provided at pier connection points. Bio-- engineering will be used to replace any vegetation removed or impacted as a result of the onshore pier connection points. The Covenants, Conditions and • Restrictions for the Community allow for the removal of trees with a caliper of less than four inches. The pathway to the docks will meander around mature trees to minimize impact. Preservation Pointe FERC Environmental Safety The residents of Preservation Pointe will be provided with training material to teach them how to properly handle gasoline containers. The training material will also address additional safety and environmental concerns and will be similar to the attached pages. Boating Safety Each pier, slip, and ramp shall be constructed off site and floated into place. This will be scheduled during the week while boat traffic is minimal. Lighting and reflectors will be in place around the slip area for safety. The Overlook Common Pier Facility is across the lake and has a no wake zone established approximately 500' north of our project. We will continue to observe the no wake zone. This situation will eliminate a large amount of traffic from our area. Boat Traffic • The location of the proposed slip area does not extend into the main traffic area of Mountain Island Lake. These facilities will be used by the residents of Preservation Pointe and should decrease the amount of traffic at other public landings. There are no historic values or resources in this particular location that may be adversely impacted, as confirmed by the attached letters from various commenting agencies. When careless individuals throw trash out their car window or leave their garbage on the side of the road, it can enter the storm drain system and eventually the creek or lake. Do not hose. it off with water or use detergents (petroleum products will adhere to the detergent and sink to the bottom of the lake causing additional damage to the environment.) 3. Install a fuel/air separator on your boat to prevent accidental overflows from the tank vent line. 4. Rinse your boat with flesh water after each use. Avoid the use of degreasers and other strong chemicals. If you are using detergents to clean your boat/ car, do so in.a place where the soapy water run off will not flow into a storm drain or directly into the lake. 5. Leave a buffer of natural vegetation between the shoreline or the lake and the grassed portion of your yard. Natural buffers provide stability to the shoreline, filter out pollutants, sediment, excess nutrients and provide important wildlife habitat. Contact the Mecklenburg County Department of Environmental Protection for information on creating natural Stream Buffers. ? Beautiful scenery and scenic sunsets ? A boost to the local economy. Everyone living in Mecklenburg County has an impact, direct or indirect, on the water quality of Mountain Island Lake. Residents living along the shoreline and using the lake for recreational purposes have an even greater responsibility to protect surface water quality. Non-point source pollution is one of the biggest threats to the water quality in Mountain Island Lake. Oil, residual pesticides and fertilizers, bacteria and sediment are picked up by storm water as it flows over streets, lawns, and the general landscape. This type of pollution increases as population and impervious surfaces (streets, parking lots, driveways) increases. TYPES OF SURFACE WATER POLLUTION PETROLEUM PRODUCTS Discharge of petroleum products such as oil and g as directly into the lake, storm drains or on the ground is FERTILIZERS AND PESTICIDES Many pesticides contain a variety of toxic compounds and heavy metals which are harmful to the enviromment. Fertilizers contain large amounts of nutrients which stimulate plant growth. When either of these are applied improperly or in excess, they can enter our lakes or creeks, contaminating the water and killing fish and other aquatic wildlife. Report any spills or pollution problems to the Water Quality Section of the Mecklenburg County Department of Environmental Protection (MCDEP) at 336-5500. The construction and utilization of the boat slips will have no effect and will not require changes in the project operation. Preservation Pointe PERC 7. Discussions of any adverse environmental effects, which cannot be avoided should the proposal be implemented and how such adverse effects, are proposed to be minimized. The only environmental effects that may be realized would be shoreline-based. These areas will be minimized and will adhere to North Carolina erosion control guidelines to control sediment from entering the lake. The shoreline along the pier facility does not require stabilization. Soil stabilization will be provided at pier connection points. Bio-engineering will be used to replace any vegetation removed or impacted as a result of the onshore pier connection points. Additionally, enhancements, i.e. structures or revegetation, for fish habitats will be provided to replace or enhance any vegetative fish habitat that maybe impacted. A no-wake zone will be established per the Mountain Island Lake Marine Commission ordinance to limit the impacts to fish habitat and shoreline from wave action. Construction • Minimal disturbance should occur during the construction of the proposed project. Rip Rap will be place by hand and transported to its location with a low-pressure rubber track machine. The slips, piers, and ramps shall be constructed off-site and floated into place. Sedimentation and erosion control measures shall be in place and maintained during the construction period. The 100' lake buffer will be identified by placement of a continuous line of environmental flagging. Trees, 2" and larger within the 100' lake buffer will be preserved and protected. No trees larger than 2 inch caliper are to be removed except for dead or diseased trees. Shoreline Disturbance within 100 feet of the Project Boundary There shall be no disturbance within the 100 feet buffer that has been established. Access to the three piers shall be a mulched foot path approximately 4'-6' wide. The mulched footpath will meander through the existing trees, and trees 2" and larger will be preserved and protected. There will be a dry storage area for boats and RV's on the property approximately 1500' from the lake boundary. This will be a pervious surface surrounded by a fence with no building or dry stack storage. This pervious surface will be approved by Mecklenburg County LUESA prior to installation. Environmental Effects As shown on the attached maps, we are preserving in its natural state the area redefined as environmental area until such time as it is shown on Duke Power Lake Management Map. All precautions will be taken to minimize any adverse effects on the environment. Minimal disturbance of the placement of Rip Rap shall occur. The docks will be constructed off-site and floated into place. This will minimize any possible • impact to the natural vegetation and marine life. These methods of construction will minimize the adverse effects to the shoreline, vegetation, and marine life. Preservation Pointe FERC 8. A statement as to why the proposed action is in the public interest. The public interest will be served by providing a safe area for boating activities for numerous individuals of this community in a relatively small space. Additionally, with the placement of low voltage motion sensor activated lights shielded for glare, the public will be better served with this community slip than with multiple individual piers having their own individual lighting sources that may be more intrusive upon the adjoining owners. The.public interests will also be protected . by limiting the number of shoreline connections and their potential for soil, vegetation, and fish habitat impacts. Preservation Pointe rERC 9. Describe what measures will be used to insure boating safety in the vicinity of the proposal during and after construction activity. A slow no wake zone has already been established approximately 500' North of our project. We will continue to have slow no wake zones which will be established prior to commencement of construction and construction limit buoys will be installed during construction. No more than one third the cove will be used for construction. A boat lane will be maintained for safe passage of watercraft. Night navigational safety devices & low voltage motion sensor activated lights, shielded for glare will provide boaters with visual location of piers at night. The proposed project is located off the main channel. The contractor that will build and install the facility will be an appropriate licensed and bonded dock construction company. The floating docks will be constructed at the contractors designated site and floated into the proposed site. There will be escort boats, along with the necessary lighting to insure a safe installation. This work will be done during the weekdays while boating traffic is light. • Preservation Pointe FERC 12. Describe the magnitude and pattern of existing boat traffic in the area, including any existing recreational uses (public or private) at and near the proposal, including areas of attraction such. as marine, gas facilities, restaurants, and mooring areas. Describe the effect of increased boat traffic, associated with the proposed facilities, on the existing boat traffic in the area. Existing boat traffic in the area comes from the few private piers used by adjoining owners. Boat traffic associated with this proposed facility will not have any detrimental effect. A no wake zone will be established for this facility which will limit the impact of any wave action upon the adjoining owners and their private facilities. The effect of any additional boat traffic associated with this proposed facility will be to slow the speed of all watercraft in this area. Preservation Pointe FERC ¦ 13. For projects that include water withdrawals, a complete description of the design and construction of the water pipeline intake structure (including elevation data), intake screen size, intake velocities, proposed water withdrawal rates, and maximum pumping capacities must be included along with a description of measures proposed to mitigate the potential entrainment of fish or aquatic organisms. Note: this item is only included for projects that will have water withdrawal facilities as part of the proposal. There will be no water withdrawal associated with the proposed facility. Describe any shoreline disturbance that may occur as a result of the proposed (e.g. ramps, pipeline trenches, etc.) especially land disturbances within 100 feet of the project boundary. Natural and scenic values and resources shall receive little or no impact. Shoreline disturbance and land disturbance activity within one hundred feet of the project boundary shall receive little or no impact. Throughout the construction of the pier(s), North Carolina Sedimentation Control Law shall be observed by exercising standard erosion control and sedimentation practices. The docks have been located inside the project confines and erosion control measures will be implemented throughout the construction process. The Covenants, Conditions and Restrictions for the Community allow for the removal of trees with a caliper of less than 2 inches. The pathway to the docks will meander around mature trees to minimize impact. The shoreline along the pier facility may be stabilized with rip rap as necessary to reduce shoreline erosion from any ripple wave activity associated with piers. Soil stabilization will be provided at pier connection points. Bio-engineering will be used to replace any vegetation removed or impacted as a result of the onshore pier connection points. The proposed construction is planned so as not to conflict with the natural, historic, and scenic values of the project. The 100' lake buffer will be identified with continuous environmental flagging. Vegetation and trees 2" and larger within the buffer will be maintained. No trees larger than 2 inch caliper are to be removed except for dead or diseased trees. Any disturbance near the lake will be protected by having 2 rows of silt fence and the first row will be reinforced with hay. All erosion control will be checked and maintained regularly to prevent any sedimentation and erosion from taking place. Shoreline stabilization shall be dry staked rip rap and will contribute to the erosion control. While installing the rip rap, trees and vegetation will be left in their natural state whenever possible to maximize the natural beauty of the lakeshore. Any trees and vegetation that must be removed will be replaced immediately as per the condition set forth by the Division of Water Quality. There will be a small trench dug to install the electric line to each pier connector point. This will be done with a small trenching machine and no trees will have to be disturbed. There will be a natural walking path leading to each pier connector point.
