I have discussed this permit renewal application and the associated request for a
pump & haul permit from Coastal Regional Solid Waste Management Authority
(CRSWMA) with Steve Tedder.
Due to the variability ofIthe wastestreams associated with transfer stations and the
construction schedule CRWMA is under, Steve and I recommend that we proceed
with the standard renewal of the Town of Newport's NPDES permit. Upon
commencement of operation of the pump & haul activities, we will require
CRWMA to monitor both the wastestream from the pump & haul activity and the
effluent from the town's wastewater treatment facility in accordance with Farrell
Keough's March 30, 1993 letter to CRSWMA. This information will then be
evaluated to determine whether or not the Town of Newport's NPDES permit
should be modified, or if a pretreatment permit is necessary, or if any additional
pretreatment, in addition to the aerated equalization basin, is necessary. These
monitoring requirements will be incorporated into WQ0007600 when a
modification is requested to specify the Town of Newport as the receiving facility for
the pump & haul activities.

I am writing on behalf of the Technical Support Branch within the Water Quality Section of the Division of Environmental
Management (DEM). I was recently informed that the Newport Wastewater Treatment Plant has requested a modification in its
permit to include the addition of transfer station washdown water. To facilitate the construction approval at the local level for
the transfer station, a Pump and Haul Permit (WQ0007600) was issued, for disposal of this waste to the Environmental
Compliance Corporation, industrial pretreatment facility in Winston-Salem, and/or Terradyne Environmental Services, Inc.
pretreatment facility in Fayetteville. Before the modification to the Newport Wastewater Treatment Plant NPDES permit to
allow the acceptance of this wastewater can be processed additional information on the wash down wastewater characteristics is
required. Very little is known of the pollutants generated at domestic waste transfer stations. Therefore, to determine
conditions for a proposed permit allowing disposal of this Transfer Station Wastewater to, the Newport Wastewater Treatment
Plant, the following monitoring information is required to be submitted:
- During five discrete events, the following parameters should be collected (either within a three month
period of Pump. and Haul Permit WQ0007600 initiation, or collected from "similar" operations - the
results should be in mg/1) ,
BOD5 , COD, Total Suspended Solids MS), NH3-N (Ammonia),
Arsenic (As), Cadmium (Cd), Chromium (Cr), Copper (Cu), Cyanide (CN),
Lead (Pb), Mercury (Hg), Nickel (Ni), Silver (Ag), Zinc (Zn)

If the Coastal Waste Regional Management Authority chooses, it may obtain this information from another Transfer Station
that is representative of the types of wastes to be found in the Coastal Regional Solid Waste Management Authority Transfer
Station Washdown Wastewater. A letter detailing the facility chosen would be necessary; i.e. name of facility, location, (if it
is in North Carolina, the Permit No.), average retention time of wastewater, average quantity of wastewater, approximate size
of community served, etc.
The Water Quality Section of the DEM has chosen this approach so as not to over -regulate the initiative your community is
taking in dealing with its waste management. Our mandate is to "protect the waters of the State"; by working in conjunction
with community initiatives like Newport's, we can accomplish this to everyones' benefit. Please provide us with a schedule to
complete the above information collection. If this schedule is not received by April 30, 1993, we will complete the reissuance
process for the Newport NPDES permit without taking into consideration this additional wastestream. If the reissuance occurs
without the transfer station washdown water being taken into consideration, a permit modification of the Newport NPDES
permit will be required before the Town can accept this additional waste stream at the wastewater treatment facility.

Dear Mr. Safrit:
With reference to our meeting of February 16, 1993, it is my
understanding that DEM would establish monitoring requirements for
the first 12-18 months of disposal at the Newport Wastewater
Treatment Facility and propose them to us as soon as possible.
Such monitoring was to be in lieu of pretreatment.
To date the only communication we have had with DEM has been a
March 29, 1993 telephone conversation initiated by Malcolm Pirnie,
our technical consultant, with Randy Jones in which Randy indicated
our situation had received some consideration but no decisions had
been reached. He also indicated, for the first time, that test
results from five (5) samples would be required to address
Newport's NPDES permit. This conversation was followed by a March
30 letter in which Farrell, Keough formalized the request for
samples.
I respectfully remind you that we are working against an absolute
Federal deadline of October 9, 1993 by which time our system must
be operational. Eight (8) weeks have lapsed since our appeal to
you and it appears that very little has been done to facilitate a
resolution of the monitoring issue identified at our meeting. In
fact, it appears that DEM has raised a new issue that further
exacerbates our already critical situation.

While we do have a Pump and Haul permit to use either Terradyne
Environmental Services; Inc. pretreatment facility in Fayetteville
or Environmental Compliance Corporation industrial pretreatment
facility in Winston-Salem, actual use of either facility would
create a. substantial financial burden which we are trying to avoid.
Furthermore, it is my understanding that DEM understood and agreed
that such permit was sought only for the purpose of obtaining a
local -.building permit.
The other, and primary, cost we are trying to avoid is the cost of
pretreatment. If, however, the monitoring program is to be so
extensive as to be cost prohibitive we need to know that
immediately to permit reassessment of.alternatives.
DEM's decisions relative to this matter are critical to our
impending operations and will have a significant impact on the cost
to residents and businesses throughout our service area.
Therefore, CRSWMA's Board of Directors, at its April 8, 1993
meeting, .directed me to request DEM' s immediate and decisive, action
regarding our pending Pump and Haul permit application to use the
Newport WWTF with monitoring in lieu of pretreatment. We believe
this to be a technically sound and financially responsible solution_
to the problem of washdown water treatment.
I will call you Monday, April 19 to request a follow_up meeting.

In accordance with your application received on February 19, 1993, we are forwarding herewith
'x` ° Permit No. WQ0007600, dated February 23, 1993, to the Coastal Regional Solid Waste Management
Authority for the subject washwater pump and haul operations.
This permit shall be effective from the date of issuance until October 31, 1994, and shall be subject
to the conditions and limitations as specified therein. Please pay particular attention to the monitoring
requirements in this permit. Failure to establish an adequate system for collecting and maintaining the
required operational information will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have
the right to request an adjudicatory hearing upon written request within 30 days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150B of North
Carolina General Statutes, and filed with the Officepf Administrative Hearings, P.O. Drawer 27447,
Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina
as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
operation of washwater (includes the approximately 10 GPD of "gray water" from each transfer station)
pump and haul facilities to serve the Coastal Regional Solid Waste Management Authority's Carteret
County and Pamlico County solid waste transfer stations; the facilities at each transfer station consist of the
construction and operation of a washwater simplex pump station with an audible and visual high water
alarm, the installation of an above ground storage tank (20,000 gallons at Carteret and 10,000 gallons at
Pamlico) with an audible and visual high water alarm, sediment and trash traps, piping, and other
appurtenances with no discharge of wastes to the surface waters, pursuant to the application received on
February 19, 1993, and in conformity with the project plan, specifications, and other supporting data
subsequently filed and approved by the Department of Environment, Health, and Natural Resources and
considered a part of this permit. .
This permit shall be effective from the date of issuance until October 31, 1994, and shall be subject
to the following specified conditions and limitations:
1. This permit shall become voidable unless the subject pump and haul activities are carried
out in a manner which has been approved by this Division.
2. This pemut is effective only with respect to the nature and volume of wastes described in
the application and other supporting data
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits and may or may
not be approved.
5. No type of wastewater other than that from the Coastal Regional Solid Waste Management
Authority's Carteret County and Pamlico County solid waste transfer stations shall be
included in the pump and haul activities.

6. The permit shall become voidable unless the agreement between the Coastal Regional Solid
Waste Management Authority, Environmental Compliance Corporation industrial
pretreatment facility in Winston-Salem, and/or Terradyne Environmental Services, Inc.
pretreatment facility in Fayetteville for the collection, t ansportation, and treatment of the
/ transfer station washwater and the approximately 10 gallons of "gray water" from each
transfer station, is in full force and effect.
7.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall cease operation of all pump and haul activities and
take such immediate corrective action, as may be required by this Division.

8.
The washwater and "gray water" collected by this system shall be treated in either
Environmental Compliance Corporation's industrial pretreatment facility prior to being
discharged into the City of Winston-Salem's sewer collection system or Terradyne
Environmental Services, Inc. industrial pretreatment facility prior to being discharged into
the PWC of the City of Fayetteville's sewer collection system.
9.
The Washington Regional Office, telephone no. 919/946-6481, and the Wilmington
Regional Office, 919/395-3900, shall be notified at least forty-eight (48) hours in advance
of operation of the pump and haul activities so that an in -place inspection can be made.
Such notification to the regional supervisor shall be made during the normal office hours
from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
10.
The Permittee is liable for any damages caused by a spill or failure of the pump and haul
operations. i
11.
Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
12.
The Permittee or his designee shall inspect the washwater collection facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall keep an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken by
the Permittee. This log of inspections shall be maintained by the Permittee for as long as
the pump and haul activities are being conducted and shall be made available upon request
-
to the Division of Avironmental Management or other permitting authority.
13.
Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the washwater collection facilities at any reasonable time
for the purpose of determining compliance with this permit; may inspect or copy any
records that must be kept under the terms and conditions of this permit; and may obtain
samples.
14.
An accurate record of the pump and haul activities must be maintained by the Permittee,
indicating:
a) date washwater is removed from the facility,
b) name of facility from which washwater is removed,

c) name of facility receiving washwater,
d) volume of washwater removed, and
e) status of permanent disposal option.

15.
The permittee is responsible for the sampling and analysis of each load of pumped and
hauled washwater for the first six months of operation of the pump and haul activities for
BODE, TSS, and pH.
16.
The permittee is responsible for the sampling and analysis of every fourth load of pumped
and hauled washwater for the first six months of operation of the pump and haul activities
for zinc and lead.
17.
The permittee shall provide the Division with a copy of any analysis related to the pump
and haul activities that is required by either Environmental Compliance Corporation or
Terradyne Environmental Services, Inc.
18.
The records required in conditions 14, 15, 16, and 17, as well as any other records or
analyses required by the Division, shall be submitted monthly to the following address on
or before the fifteenth (15) day of the following month:

19.
Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
20.
The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
21.
The Permittee shall provide for the installation and maintenance of an audible and visual
highwater alarm on the pump tank(s) and storage tank(s).
22.
A copy of the approved plans and specifications shall be maintained on file by the Pemrittee
for the life of the project
23.
Noncom pliance+Notification :
The Permittee shall report by telephone to the Washington Regional Office (for the Pamlico
County facility), at telephone no. 919/946-6481, or the Wilmington Regional Office (for
the Carteret County facility), at 919/395-3900, and the Fayetteville Regional Office (if the
receiving treatment facility is Terradyne Environmental Services, Inc.) at 919/486-1541, or
the Winston-Salem Regional Office (if the receiving treatment facility is Environmental
Compliance Corporation, Inc.) at 919/896-7007 as soon as possible, but in no case more
than 24 hours or on the next working day following the occurrence or first knowledge of
the occurrence of any of the following:
a. Any process unit failure, due to known or unknown reasons, that render the
facility incapable of adequate wastewater treatment such as mechanical or electrical
failures of pumps, aerators, cofnpressors, etc.
b. Any failure of a pumping station, sewer line, etc. resulting in a by-pass directly to
receiving waters without treatment of all or any portion of the influent to such
station or facility.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.

24.. Upon completion of construction and prior to operation of the subject pump and haul
activities, a certification must be received from a professional engineer certifying that the
permitted facilities have been installed in accordance with this permit and the approved
plans and specifications. Mail the Certification to the Permits and Engineering -Unit, P.O.
Box 29535, Raleigh, NC 27626-0535.
23. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit, as specified by 15A NCAC 2H .0205
(c)(4)•

permit contain a requirement for monthly monitoring.
PART IV - EVALUATION'AND RECOMMENDATIONS
Garbage from .homes and commercial establishments is to be
dumped onto a concrete' floor and pushed into containers to be
taken to a regional landfill. Approximately 2,000 gpd of
wastewater is to be generated during washing of the floor and
equipment. The applicant proposes to provide no pretreatment
prior to hauling the wastewater to the Town of Newport wastewater
treatment facility. Based on a review of the project, the
following comments are offered:
1. The applicant provided data from three similar facilities
to the Washington Regional Office to support an application in
that region. The.data indicates that the wastewater may have more
than 20 times the constituent concentrations found in domestic
strength wastewater. The applicant contends that this data may
not be representative of the wastewater generated in the proposed
project but has provided no evidence to support this claim.
During a meeting in 1this office on September 2, 1992 the
applicant agreed to take samples at several existing facilities
and have them analyze them for heavy metals as well as BOD.
2. The Town of Newport operates a 0.5 MGD wastewater
treatment facility which has an average flow rate of a little
more than half the design capacity. The Town currently receives
no industrial waste and does not have a pretreatment program. The
oxidation ditch system should be able to accept additional
loading and handle shock loads fairly well. An evaluation should
be done, however, by the Town using available data to determine
if the system can handle the proposed wastewater. A determination
must be made if the, properties of the proposed waste would
classify it as a significant industrial user which would require
the town to have a pretreatment program. - cation of the
town's NPDES permit may also be necessary in order to monitor for
parameters such as heavy metals. The town must also be made aware
that constituents of.the proposed wastewater may effect the
application rate for land application of residual solids.
3. Plans indicate a simplex pump station to transfer the
wastewater to a 20,000 gallon storage tank. The consultant
indicates that a spare pump will be kept on site. The permit
should state that,a spare pump must be kept on site in order to
avoid the need for a duplex system.
4. The design flow rate is 2,010 GPD. The application
indicates that waste will be stored in the storage tank and
f hauled to the Town of Newport facility several times per week.
The impact on the treatment facility would be lessened if it were
I hauled daily. It may be necessary to further equalize the flow to
! the plant by installing an equalization tank at the treatment
facility. This should be addressed in the evaluation to be done
by the town.

The subject facility applied for a pump and haul p rmi� to
transport the collected wastewater 1
a ter to the City of New Bern for
treatment. Data provided to the Washington Regional Office
(copies attached) indicates the BOD may as high as 14,000
mg/l, Zinc as high as 20 mg/l, oil and grease as high as 271
mg/l, lead as high as 11 mg/l, and TSS as high as 10, 530 mg/1.
The Authority has indicated they felt this data was not
representative and promised to provide alternate data. No
additional data has-been ,provided. Recent correspondence from Mr.
John Gunian indicates the current plan is to transport the
wastewater to the Town of Newport.
In addition to the standing request from this Office for
data on the constituents of the wastewater; the fact the Town of
Newport is permitted to receive only domestic wastewater must be
considered. Prior to this Office providing positive
recommendations for the collected ;wastewater .to be transported. to
the Town of Newport for treatment; the Town must apply for. anrf.
._receive an amendment to the current NPDE•S Permit which
::establishes effluent, limitations which will protect the receiving
waters.
. Of major concern is the potential for plant upset,
inhibiting the.ability of the plant to -adequately treat the
wastewater, and/or pass through of the waste. Any of the above
consequences may havesignificant adverse impact on the Newport
River
If the above cannot be accomplished within a time schedule so as ..to prevent the application from going statutory;, -it is
recommended that the application.be returned as incomplete. If.
additional comment is needed, p ase advise.
