In emails sent February 13, 2019 and December 19, 2019, by Christyn Fertenbaugh, P.E., your engineer was asked to provide additional information (copy attached) in accordance with 15A NCAC 02T.0107(e). As of today, this information has not been received, therefore the Division must return your application as incomplete in accordance with 15A NCAC 02T.0107(e)(2). Please be advised that construction and/or operation of wastewater collection,treatment,and/or disposal facilities without a valid permit is a violation of North Carolina General Statute§143-215.1 and may subject the owner/operator to appropriate enforcement actions in accordance with North Carolina General Statute §143-215.6A-6C. Civil penalties of up to$25,000 per day per violation may be assessed for failure to secure a permit required by North Carolina General Statute§143-215.1. When you have obtained the requested information that is needed to make your application package complete,you may submit a new application package with the appropriate permit processing fee. Please provide a complete response to the comments below by Friday,January 10,2020. Failure to respond will result in the application being returned as incomplete and the documents recycled, per 15A NCAC 02T.0107(e)(2). If you have decided to not pursue this permit application, please let me know and I will withdraw the application. Please be advised that operating a non-discharge system (including sewer extensions)without a valid Wastewater Collection Permit may subject the responsible party to a civil penalty of up to$10,000 per day. In accordance with 15A NCAC 02T.0107, please provide the additional or revised information for the following comments: General Review: 1. Please provide a set of revised,final plans,specifications, and supplementary information on digital media (CD or other digital format such as a flash drive)for our records. Application/FTSE: 1. Please provide a complete ASEA application form that lists only the length of line/flow to be included in this permit—including the following items that are missing: a. Section V is blank. b. Please provide the applicable flow reduction approval letter, per Section VI(7)of the application. c. Sections VII(2-8) are blank. d. Section X(1) appears to include line that is indicated to be permitted separately by Charlotte Water's delegated program. Please clarify and/or revise. 2. Please clarify Mr. Hamilton Stolpen's relationship to AMH NC Development, LP,as his name is not listed on the NC Secretary of State's business search as a general partner, per 15A NCACO2T.0106(b). If Mr.Stolpen is not a general partner, please provide a written delegation of authority to sign the permit application, per 15A NCAC 02T.0106(c). 3. Please provide a completed copy of the Developer's Operational agreement, indicating the name of the HOA that shall be formed to take ownership of the permit at the time of certification on Page 1, Item 5; per 15A NCAC 02T.0115. 4. As the provided FTSE document was nearly a year old at the time of submission of this application,and is now over a year old—please provide an updated FTSE with the most recent information for Charlotte Water's downstream facilities. Please be sure to utilize the updated form,dated 10-18, as found on our website HERE. a. Please also clarify the relationship of Santee Land Group to AMH NC Development, LP, as the entity requesting allocation on the FTSE should be the same as the permit applicant. Calculations: 1. Please provide calculations for the following: buoyancy resistance,wet well storage above the pump-on position, and downstream capacity analysis, per 15A NCAC 02T.0305(b)(2). Please note that provision of the FTSE or a letter from Charlotte Water does not negate the requirement for downstream capacity analysis calculations per 15A NCAC 02T.0304(g). All design calculations must be signed/sealed by a Professional Engineer. Plans/Specifications: 1. Please provide specifications for the low-pressure and gravity sewer portions of this project, including the materials, methods of construction, and quality assurance testing, per 15A NCAC 02T.0305(b)(3).The provided specifications only appeared to include limited information regarding the grinder pumps. 2. Please provide profile views of all sewers to be installed as part of this permit application, depicting their proximity to other utilities and natural features, per 15A NCAC 02T.0305(b)(1). 2 3. Please provide the appropriate detail depictions on the plans for the sanitary sewer, including but not limited to: manholes,tapping fixtures,cleanouts,ARVs,trenching, utility crossings, and other appurtenances/installation requirements. 4. Please provide the appropriate detail depiction(s)for the proposed simplex grinder pump stations on the appropriate plan sheet(s), including but not limited to: pump selection per lot, elevations/dimensions, storage capacity above the pump-on elevation, buoyancy resistance, and the presence of a screened vent,audible and visual high-water alarms, and an emergency contact placard/sticker, per 15A NCAC 02T.03O5. A response to the above comments is considered required in order to proceed with the review of the application and issuance of the permit. If a complete response is not received within 30 days,the application and supporting documents will be returned to you in accordance with 15A NCACO2T.O107(e)(2).
