S. Fish and Wildlife Service (Service) on the subject Public Notice (PN), dated November 3, 2004. The applicant, Midway Development Corporation, has applied for a Department of the Army (DA) permit to develop a 10-lot, residential subdivision with infrastructure and a community dock and pier. The proposed work is being considered under Regional General Permit 198000291, a permit/processing agreement for work that has been approved pursuant to the North Carolina Coastal Area Management Act (LAMA). These comments are submitted in accordance with the Fish and Wildlife Coordination Act (FWCA) (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Comments related to the FWCA are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) in relation to the protection of fish and wildlife resources. Additional comments are provided regarding the District. Engineer's determination of project impacts pursuant to section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). Proposed Activities and Anticipated Impacts The proposed work and environmental impacts are presented in the Field Investigation Report (FIR), dated October 8, 2004, of the North Carolina Division of Coastal Management (NCDCM). The current work (on 6.38 acres) represents Phase I in the development of larger tract consisting of 97.27 acres. Infrastructure development includes one small area of wetland impacts. A road crossing would be excavated and backfilled for culvert installation. The FIR states that this work would impact 165 square feet (ft) of 404 wetlands. This total is given as 0.04 of an acre, but should be 0.004 of an acre (165/43,560). Sheet 8 of the project plans indicates that the 48-inch pipe would be installed slightly below the existing grade. No wetland compensatory mitigation has been proposed. 2 The applicant also proposes to construct a 10-slip community dock in the Atlantic Intracoastal Waterway (AIWW) and an access pier from the upland development. The access pier would be 1,070 feet long and cross both federal (404) and coastal wetlands. Water depths at the location of the docking facility are approximately 3.5 feet at mean low water (MLW). Plan drawings (Sheet 7 of 8) show the waterward portion of the pier and dock to be four feet above mean low water (MLW) and 7.5 feet above the bottom. However, the elevation of the access pier across other areas of the wide margin of marsh is unclear. The PN does not discuss whether additional wetland losses would occur as a result of home construction on the ten lots. It is also unclear whether the individual septic system could be built without additional impacts to wetlands. The FIR notes (p. 2) that septic suitability tests are being conducted "on some of the lots." Federally Protected Species The Service has reviewed available information on federally-threatened or endangered species known to occur in Brunswick County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database which contains excellent data on special status species, both federal and state. This database can be accessed by topographic quadrangle (quad) of the U. S. Geological Survey (USGS). Data from USGS quads provide the most project-specific information on species which should be considered in permitting this project. The project area is located in the Holden Beach quad. The occurrence data of special status species within this quad can be obtained on the internet at < http://www.nenhp.org/Pages/heritagedata.html > under the Database Search section. Our review indicates that two federally endangered species, the West Indian manatee (Trichechus manatus) and the wood stork (Mycteria americana), should be considered. These species have been reported in Brunswick County, but not within the Holden Beach quad. Both species have a seasonal occurrence in North Carolina and are highly mobile, i.e., they have no permanent home range within the project area. Manatees are known to occur in the coastal waters of Brunswick County as the animals move along the Atlantic Coast during summer months, primarily from June through October. The species moves extensively when in North Carolina waters and past occurrence records cannot be used to precisely determine the likelihood that it will be presence at a particular construction site. Manatees may use waters one to two meters (3.3 -6.6 feet) deep. The permit application which accompanied the FIR states that water depths at the waterward end of the pier are approximately 3.5 feet at MLW and may be approximately 7.5 feet at NHW (Sheet 7 of 8). To protect manatees in North Carolina, the Service developed guidelines entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina." These guidelines address all types of in-water construction, 3 except blasting, and should produce little, if any, additional expense. The guidelines are intended mainly to ensure that construction personnel are informed that manatees may occur in the work area, that work should cease if a manatee approaches the work area, work should not resume until the manatee leaves the work area, and procedures for reporting the death or injury of a manatee. These guidelines are available on our web site at < htip://nc-es.fws.gov/mammal/manatee guidelines pdf5. The risk to manatees could be reduced to an acceptable level by the implementation of the Service's guidelines. The risk would be further reduced by performing the work during the period of November through May. Wood stocks are not known to nest in North Carolina, but may visit the state during post- breeding dispersals. They feed in freshwater marshes, narrow tidal creeks, or flooded tidal pools. Particularly attractive feeding sites are depressions in marshes or swamps where fish become concentrated during periods of falling water levels. Since most of the proposed development will occur in high ground and no dredging and only minor filling of wetlands are proposed, the project is not likely to adversely affect wood storks. With the inclusion of our manatee conditions, the Service would concur with a determination by the District Engineer that the project is not likely to adversely affect any federally threatened or endangered species, or designated critical habitat for such species. The Corps' requirements of section 7 of the Endangered Species Act would be fulfilled. However, the Corps must reconsider its obligations under section 7 of the ESA if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner which was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. Service Concerns and Recommendations If the proposed culvert would be used in a channel that historically carried natural surface water flows (as opposed to a man-made ditch), this structure should maintain natural water flows and hydraulic regimes without scouring, or impeding fish and wildlife passage.. The culvert should be of sufficient size to allow normal surface water exchange between the wetlands above and below the culvert. The culvert should be buried at least one foot below the natural streambed to promote the passage of aquatic organisms. In addition, the culvert should be situated so that no channel realignment or widening is required. Widening of the channel at the inlet or outlet of structures usually causes a decrease in water velocity. This produces sediment deposition that will require future maintenance. Riprap should not be placed on the streambed. The Service is concerned that low piers could harm marsh vegetation by blocking sunlight. Diagrams with the FIR appear to indicate that the waterward end of the pier would be well elevated above the coastal wetlands. However, the elevations of other sections of the 1,070-foot-long structure are not provided. We recommend that the lowest part of any structure build over vegetated wetlands should be least four feet above 4 the bottom. A minimum elevation of four feet is a special condition of the Corps' Regional General Permit #197800056. The Service recommends that the Corps consider additional wetland losses which could occur as a direct result of this permit. Sheet 4 of the project plans indicates that a portion of some lots include wetlands. The applicant could provide the Corps with a statement that customary building practices would allow for home construction within these 10 lots without additional wetlands losses. The issue of future wetland losses could be addressed by placing a conservation easement on all the wetlands within the area. covered by Phase I of the development. Such an easement would be similar to NCDCM condition one which states that, where appropriate, deed restrictions will be placed on lots having riparian access to prohibit the construction of individual piers and docks. The applicant has indicated that deed restrictions would be placed on lots 3 and 4 to prohibit such future construction over marsh areas. With due consideration of our recommendations and the inclusion of the Service's manatee conditions, we do not believe that the proposed activities will have significant adverse and/or irreversible effects on fish and wildlife resources under our jurisdiction. We also support the seven conditions of the NCDCM. Therefore, the Service has no objection, from the standpoint of fish and wildlife, to the issuance of a permit for the proposed activities. PROJECT DESCRIPTION The proposed project is located on a previously undeveloped piece of land that lies on the mainland side of the AIWW across from Holden Beach in Brunswick County. The property can be reached by traveling NC HWY 17 south towards Holden Beach. Travel straight through the intersection of HWY 17 and NC HWY 211, and continue past Brunswick Community Hospital. Just past the hospital, look for Mt. Pisgah Road and prepare to make a left turn across the highway. This turn appears just about at a veterinary clinic. Travel Mt. Pisgah Road/NC HWY 130 south until the road turns sharply toward the left at a Citgo gas station. Turn right onto Seashore Drive, and then make an immediate left turn onto Sea Aire Drive. Travel down Sea Aire Drive almost to the end and turn left onto Caison's Creek Drive, which is a new road. This road enters the development property. The Sea Air Canal subdivision is straight across the roadway (south) from the gas station. The proposed Caison's Creek property is immediately to the east of Sea Aire. The total project area is 97.27 acres. Phase I, which is considered in this CAMA Permit application, consists of 6.38 acres. High ground elevations range from 4 to 20 feet above MHW. The topography of the site is generally flat, with a moderate slopes leading down to the wetland stream area and the marsh. Vegetation on the upland portions of the tract includes Pine trees (Pinus sp.), LiveOak (Quercus virginiana) and other Oaks, Hickory (Carya sp.), Red Maple (Ater rubrum), Berries (Vaccinium spp.), Red Bay (Persea borbonia), various saplings, grasses, weeds, vines, and ferns (Pteropsidae). Highground soils consist of Wando fine sand; wetland soils consist of Carteret loamy fine sand. Salt Meadow Cordgrass (Spartina alterniflora) and Black Needlerush (Juncus roemarianus) are the predominant coastal wetland species in the project area. Residential lots are currently platted on the western part of the tract closest to the Sea Aire Canal subdivision, and the tract is zoned Residential by Brunswick County. The CAMA Land Use Plan Classification for the project area is Transitional. Currently, there are no permanent man made features on the tract other than a recently constructed double cul de sac in the western portion of the project area. Much of the land for the first phase of the development has been cleared and or has had selected tree removal. Septic suitability tests are currently being conducted on some of the lots. The remainder of the tract appears to remain heavily vegetated. A 404 wetland area runs along the AIWW side of property. Ajacent to this 404 wetland area is a band of black needlerush that marks the beginning of the coastal marsh. From hereto the waters of the AIWW, there is abroad (approximately 750 feet wide) expanse of saltmeadow cordgrass coastal marsh. Within this area, elevation fluctuates so that there are areas of ponding, patches of black needlerush, and even a.72 acre upland island. A wetlands survey has been conducted for the site and has been approved by the Wilmington District Army Corps of Engineers. These waters of the Atlantic Intracoastal Waterway have been classified SA by the NC Division of Water Quality. The AIWW is closed to the taking of shellfish. The area is not considered Primary Nursery Area by the Division of Marine Fisheries. PROPOSED PROJECT The applicant proposes to develop 6.3 8 acres of the 97.27 acre tract into a 10 lot residential subdivision with ten slip docking facility. The surrounding property consists of residential development. The subdivision would consist of lots for single family homes, ranging in size from .30 to .58 acres. Development of the subdivision would include the disturbance and grading of 2 acres of the site for road construction/ infrastructure. The developer proposes on site waste treatment with individual septic. systems for sewage disposal. The county would provide community water service for the subdivision. Midway Development Corp/Caison's Creek October 8 Page 3 Construction of the entrance road itself of the proposed cul de sac would not involve wetland impacts. A previously proposed 404 and coastal wetland impact for a road crossing to provide access for future phases of the development has been removed from this permit application. The roadway now ends in a stub and does not cross into or over the wetlands The applicant proposes to construct a pier from the residential area out to the AIWW, with a 10 slip community dock facility. The pier would be 1070 ft long, crossing from high ground over federal wetlands and coastal wetlands out to the AIWW. The 6 foot wide pier would terminate with a 16 ' x 16' covered deck and al55'x 6' floating dock spine. From the spine, five 25' x 4' finger piers would extend out between a total of 10 boat lifts. Each boat lift would have maximum dimensions of 25' x 15'. Water depths at the location of the proposed docking facility are approximately 3.5 feet MLW. The docking facility would extend out into the water to within approximately 40 feet of the Corps of Engineers AIWW setback line. The pier and covered deck would not encroach upon the 15 foot riparian setback lines for the adjacent properties. The width of the water body in this location is 530'. Sedimentation and Erosion Control Plan approval will be required for this project. A Stormwater Permit will be required as well. Applications for both are being prepared by the applicant for submittal. 10. ANTICIPATED IMPACTS A total of 2 acres of land area would be graded, filled, and or disturbed for this project. Roadway development, with culvert installation, would entail excavation of federal Section 404 jurisdictional wetlands and the backfilling of 165 sf for a 0.04 acre wetland impact. 6.38 acres would become home sites, with 5 of the 10 Phase I lots consisting of 404 wetlands as well as high ground areas. Compensatory mitigation is not proposed for this project The proposed piers would result in the shading of 5718 square feet of coastal wetlands. The docks would incorporate 1686 square feet of Estuarine Waters and Public Trust Area, and the boat lifts would incorporate another 500 s£ The pier would not exceed 1/4 width of the water body. Midway Corporation currently owns all of the lots within the proposed subdivision. Those lots currently platted that have riparian rights over the marsh area (lots 3 and 4) will be prohibited from having piers and docks through deed restrictions. Future development lots would be able to apply for permits to construct piers and docks, however, the total for all projects would be limited to the allowable 12,120 sf for the entire tract. Any necessary Permits must be obtained from the Corps of Engineers. Recommended Conditions 1. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the pier without permit modification. No non-water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. If appropriate, deed restrictions shall be placed on lots having riparian access that prohibit the construction of individual piers and docks. 2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. The authorized structures and associated activity must not cause an unacceptable interference with navigation. 4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. 5. The piers and associated structures shall have a minimum setback distance of 15' between any parts of the structure and the adjacent property owners' areas of riparian access. 6. Boat slips are for the sole use of the property owners, slips shall not be rented, leased, sold, or otherwise used by any party. 7. The permittee must receive a Stormwater Plan approval and a 401 Water Quality Certification, if required, prior to the initiation of any construction activities. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required.
