After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3351 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 21-1.0506 (h). PROJECT SUMMARY: This project involves the construction of a driveway/bridge approach 141 feet long by 15 feet wide, with a43 feet long by 15 feet wide bridge across a man-made ditch to provide private access to a residential high-ground building site. FIELD INVESTIGATION REPORT: Nathan Rosen, Dare County Page 2 PROJECT SETTING This project is proposed on property owned by Elizabeth E. Lauer. Nathan and Susan Rosen of 450 Fern Lane, King of Prussia, Pennsylvania, have entered into a contract with Ms. Lauer to purchase this parcel provided that the proposed development can be permitted so that the high ground portion of the property can be accessible. The site is located along NC 12 in Frisco, Dare County, and is described as Lot 3, Block A of the C. H. Fulcher Tract. The adjacent riparian properties are owned by Bennie J. Morris to the west and Jennie G. Sharp to the east. The shorelines of these properties have not been stabilized with any hardened structures and a coastal wetland marsh fringe is present near the Normal Water Level (NWL) of the Sharp property. The site consists of a 1.23-acre lot with approximately 92 feet of shoreline along the Pamlico Sound. The lot extends from NC 12 north to the Pamlico Sound and is bisected by a small man-made canal/ditch that eventually connects to the Pamlico Sound to the northeast and northwest. The portion of the ditch, which bisects this property, is not navigable except during high wind tides. A wooden bridge crosses this ditch on a nearby property to the northeast and is visible from the proposal site. The shoreline of this ditch is vegetated with Spartina alterniflora, Spartina patens, and Distichlis spicata, as well as other wetland grasses and shrubs, including Borrichia frutescens, Baccharis halimifolia, and Iva frutescens. The ditch is approximately 25 to 30 feet in width and no more than 1 foot in depth at its deepest portion. According to the permit application, the site is approximately 3.5- feet above the NWL. The topsoils of this property are hydric-organic type soils located within the first 8 to10 inches of the ground level, and are present on the entire front portion of the lot. Most of the front portion of the lot is vegetated in U.S. Army Corp of Engineer (USACOE) 404 wetland plant species. No fish species were observed during the site visits at this site in the ditch area. The access driveway directly to the west has a culvert and this structure has collapsed overtime, allowing little or no water exchange to the canal/ditch portion to the west. The NC Marine Fisheries and Wildlife Resources Commission classify the waters of the Pamlico Sound and waters that directly connect to the Sound as Coastal Waters. The Coastal Resources Commission (CRC) has designated these waters as an Area of Environmental Concern, and this includes Estuarine Waters and Public Trust Area waters. The CRC has also designated this shoreline as Estuarine Shoreline, and this includes a 30-feet wide Coastal Shoreline Buffer. Spartina alterniflora, Spartina patens, and Distichlis spicata wetland marsh areas that receive occasional Estuarine Water flooding are also designated as Coastal Wetlands by the CRC. A preliminary review of archaeological site data for this portion of Hatteras Island indicates that there are cultural resource sites in the vicinity of this project. ` FIELD INVESTIGATION REPORT: Nathan Rosen, Dare County Page 3 PROJECT DESCRIPTION The applicant proposes to construct a 15 feet wide by 53 feet long bridge for private use to provide access to a residential high ground building site adjacent to the Pamlico Sound on Lot 3. The structure will be pile supported, most likely constructed from treated wood. A bulkhead retaining wall will be placed at each bridge abutment to provide stabilization and bridge support. The bridge structure will be a minimum of 3 feet above the wetland substrate to be crossed, and will include less than 25 square feet of coastal wetland fill. This proposal also includes the construction of a 141 feet by 15 feet fill area to provide a driveway approach to the bridge. This approach will result in the filling of approximately 90 square feet of Coastal Wetlands and 370 square feet of 404 type vegetated wetlands. It is anticipated that other work requiring a CAMA Permit, by virtue of its location within the Estuarine Shoreline AEC, will be applied for at a later time. ANTICIPATED IMPACTS The proposed bridge will result in the shading of 60 square feet of Coastal Wetlands, and the bridge approach/driveway will result in the filling of less than 500 square feet of wetlands, mostly 404 type wetlands. The bridge structure over the canal will result in the shading of 450 square feet of Estuarine and Public Trust Area Waters. Navigation in this canal will be no more limited after this project than before: During the construction of the proposed structure, some minor turbidity associated with the installation of bridge pilings may occur. The proposed structure will provide vehicular access to the waterfront portion of Lot 1. An inspection of mapping data on cultural resources revealed that archaeological, or cultural resource findings had been recorded on the available maps in the vicinity of this project. It is important to note that these maps have not been updated in at least 10 years, and Hatteras Island has a rich heritage in cultural resources.
