It is the understanding of the Division that the subject facility no longer requires coverage by a
stormwater permit since it has been determined there is no potential for discharge from Solid Waste
Management Unit (SWMU) 13. In accordance with this information, NPDES General Permit
NCG030316 is rescinded, effectively immediately.
Please be advised that this permit rescission is based wholly upon the activities which would require
general permit coverage at the site have ceased or been eliminated. Division staff has not visited the site
to obtain independent verification. Operating a treatment facility, discharging wastewater or discharging
stormwater to waters of the State without a valid NPDES Permit will subject the responsible party to a
civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have
voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in
retrospect, you feel the site still requires permit coverage, you should notify this office immediately.
Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first
apply for and receive a new NPDES Permit.

Enclosed please find the invoice for the Annual Permit Fee for the referenced NPDES
Permit for the period 2/l/2002 to 1/31/2003, a copy of a letter to Robert Farmer of the
Division of Water Quality requesting that this permit be rescinded, and a copy of the
Rescission Request Form that accompanied the letter to Mr. Farmer. Per my phone
conversation of March 20, 2002 with your office, I was instructed to return these items in
the invoice's return envelope so that the Division of Water Quality could take the
appropriate action pending rescission of the permit. Since the rescission is expected to be
granted, the payment of the permit fee for 2002 should be waived.

This annual fee is required by the North Carolina Administrative Code. It covers the administrative costs
associated with your permit. It is required of any person holding a permit for any time during the annual fee
period, regardless of the facility's operating status. Failure to pay the fee by the due date will subject the
permit to revocation. Operating without a valid permit is a violation and is subject to a $10,000 per day fine.
If the permit is revoked and you later decide a permit is needed, you must reapply, with the understanding
the permit request may be denied due to changes in environmental, regulatory, or modeling conditions.

Dear W. Farmer:
As the managing consultant for Ingersoll-Rand at the former Schlage Lock Plant in
Rocky Mount, North Carolina, Capsule Environmental Engineering is requesting that you
rescind this facility from coverage under the General Storm Water Permit #NCG030000.
Coverage of this facility under the General Permit was requested and granted through a
Notice of Intent submitted in July 1994. The storm Water Permit was renewed in
September 1997. The requirement for coverage was based on a finding from a July 21,
1993, final RCRA Facility Assessment Report (RFA) by the Solid Waste Hazardous
Waste Section. The RFA indicated that Solid Waste Management Unit (SWMU) 13, the
NPDES Discharge Ditch, had a high potential for releases to surface water. All of the
other SWMUs and Areas of Concern (AOC) were assessed to be of low potential for
releases to surface water in the RFA. Coverage under the Storm Water Permit was
obtained as an interim measure until a determination of no further action could be made
for S WMU 13. After eight years of operation under the storm water permit, no
indications of any releases to this SWMU have been evident. The analyses performed on
the storm water have not indicated any significant impurities. It is logical to conclude
that no additional action on SWMU 13 as it pertains to storm water is warranted.
Ingersoll-Rand sold this site to the Godley Management Company in February 1996 and
is only involved at the site through its continued operation and maintenance of a ground
water treatment plant designed to remove chlorinated solvents from the ground water.
This treatment plant discharges treated groundwater from an air stripper to the NPDES
'Discharge Ditch under NPDES Permit Number NC0079227. The permit expires October
31, 2004. Quarterly sampling and analysis of this discharge, including aquatic toxicity,
are performed, and there have been no rrijor excursions from permit limits. A full time
Site Manager is on site during the working day and is on call on a 24/7 basis. The Site
Manager is a certified Grade 1 Wastewater Treatment Operator.

Based on these facts, coverage by the General Permit is no longer required, and the
coverage of the site should be rescinded. The Permit Coverage Rescission Request Form

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 3l, 2002. The Division staff is currently in the process of rcwriting this permit and is scheduled to have
the permit reissued by ]ale summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may he assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 Per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the l I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

is reissued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the

■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your

■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program with outlines program components
and addresses frequently asked questions.
• A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
