Please let this also serve as notice that use of the lot at the south end (shown on the Figure 8 project plans) for beach access is also authorized as an existing access, provided that the area is restored to pre -project condition immediately upon project completion, in accordance with Condition #16 of the New Hanover County permit and Condition #14 of the Figure 8 permit. Green Meadows Dr. Wilmington, NC 28405 Dear Mr. Pratt: This is with reference to your pre -construction plan submittal for State Permit No. 139-04, acting as agent for Figure 8 Island HOA. The permit was originally issued on September 23, 2004, with a Major Modification for channel width expansion issued on September 24, 2019. The permit expires on December 31, 2022. The action proposed in your submittal is to dredge an additional area at the entrance to the T-canal not previously shown on the plans approved in the Major Modification issued on September 24. In reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original footprint of the permitted project area. This Letter of Refinement serves as approval of the expanded area shown on plans received December 6, 2019. All permit conditions remain in effect. Please note this authorization does not authorize any work not expressly described above, nor does it eliminate the need to obtain any other additional state, federal or local permits, approvals or authorizations that may be required. By copy of this letter we are also notifying the U. S. Army Corps of Engineers of our action. If you have any questions concerning the above or if I can be of any other assistance, please advise.
