Subj: BOJANGLES POST CONSTRUCTION STORMWATER PERMIT # 5
Dear Bojangles Restaurants, Inc.,
1. Gaston Natural Resources Department received a complete Stormwater Control Plan
Application Bojangles on November 15, 2007. Staff review of the plans and specifications determined
that the project, as proposed, will comply with Gaston County's Stormwater Ordinance. This
Stormwater Permit is Approved, contingent upon submission of the following documents:
a) A surety performance bond for 125% of the total construction costs of the system and devices. A
bond may be funded through an insurance company, as a letter of credit from a bank, or cash.
Construction estimates are required from three independent parties. One must be a Professional
Engineer, a General Contractor, and a second Professional Engineer or General Contractor. The
highest bid amount should be bonded, payable to Gaston County, with a term set to expire twenty-
four months following the completion of construction.
b) An electronic file of the stormwater outfalls that is readable by GIS systems, geo-referenced to the
NC State Plane 1983 (Feet) or latitude and longitude of outlet structure.
2. Your Stormwater Permit shall be effective from the date of issuance and shall be subject to the
conditions and limitations as specified therein. Please pay special attention to your Operation and
Maintenance requirements. Failure to establish an adequate system for operation and maintenance
of the stormwater management system will result in future compliance problems.
3. Section 11, As -built Plans and Specifications, of the Stormwater Ordinance shall be validated at
completion of the project. Note that a Certificate of Compliance or Occupancy will not be issued
without as -built plans or certification of previously submitted plans.
4. Be advised of the annual inspection report, maintenance agreement/restrictive covenant, and
record easements for access, maintenance, and inspections required under Section 18, Assurance
that Improvements will be Maintained, in Gaston County's Stormwater Ordinance.
5. If any parts, requirements, or limitations contained in this permit are unacceptable, or you need
