9. NARRATIVE DESCRIPTION:
The project site is an existing mobile home park adjacent to Sander's Creek off of Bogue Sound
in Carteret County. This 84 acre tract is located at 1463 Highway 24, between Broad and Goose
Creeks, within the community of Ocean. The property ranges from 5' to 25' mean sea level in
elevation, and is mostly cleared. The mobile homes on the site are serviced by a community well
system and individual septic tanks. The tract has been approved by Carteret County for the
installation of 85 mobile homes. The vacant portion of this tract has recently been cleared of
vegetation, and has been considerably ditched, with drain pipes installed.
The property is bordered by the east prong of Sander's Creek to the west, and Sander's Creek
proper to the south. Extending from the eastern border of the property lies an existing channel,
some 2450' through Sander's Creek to the AIWW within Bogue Sound. Sander's Creek contains
a significant amount of coastal marsh, predominantly S artina alterniflora and Juncus
roemerianus with sparse Typha latifolia and Distichlis spicata. There is a visible shellfish
resource within the east prong of Sander's Creek and Sander's Creek proper, and beds of
submerged aquatic vegetation within Sander's Creek and Bogue Sound. The substrate within the
project area is very silty. Soundings within Sander's Creek can be broken into six segments, and
average -2', -2', -1.4', -1.6', -2' and -1.82' within those segments. Approximately 350' north of the
conflux of the east and west prongs of the creek lies a basin area off of the east prong that has
been stabilized with a timber bulkhead wall. The bulkhead was accomplished under the CAMA
General Permit process in 1996. The basin was created prior to the onset of the LAMA, as it
appears on the 1978 photography #27-1013. According to the applicant, this area was excavated
post 1966. No filets exist to document this. Along the southernmost point of this basin is an
unimproved boat ramp. Additionally, there is an existing canal, ±350' x 50', that was excavated
through coastal marsh from Sander's Creek prior to the CAMA. Soundings within the canal
indicate approximately -1.5' to -2' n1w. This feature lies approximately 350' southeast of the
aforementioned basin. Immediately west of the canal is a berm that appears to have been created
with the spoil from the original excavation of this canal. According to the Environmental
Assessment prepared for this project, the soils on the site confirm this. This berm averages from
8' to 10' ms] in elevation, varies from 15' to 80' in width, and has a fringe of coastal wetlands on
the project side.
The Division of Marine Fisheries has not designated Sander's Creek as a Primary Nursery Area;
however, according to the Division, the creek does function as a nursery area. The Division of
Water Quality has classified the waters within Sander's Creek and the adjoining Bogue Sound as
SA-ORW. The area was closed to the taking of shellfish for consumption in March of 1996, and
remains closed today. The Carteret County land use plan places this tract within the Limited
Transition classification, with all areas lying within CAMA Areas of Environmental Concern
classified as Conservation. There is 1.0' to 1.5' of tidal flux within the project area.
This property has a long and complex history, beginning with the issuance of State Permit #176-
84, for the excavation of a high ground basin connected to the existing basin in the east prong by
way of a canal. The new basin was also to be connected to the AIWW within Bogue Sound by
way of access channel through Sander's Creek. This permit included the authorization for a
subdivision and a marina system within the newly excavated high ground basin. There was a
deed dispute at the time, but all indications are that the ownership questions have been settled.
Permit #176-84 remained active through the renewal process until 1995. Upon submittal of the
last renewal request, the agencies opted for a new review of the total project, as many regulations
had changed. The applicant failed to complete submittal of all of the requested information, and
the permit expired. The only development accomplished under the permit before its expiration
was the excavation of the access channel from the AIWW to the mainland area of Sander's
Creek. This channel terminates approximately 90' short of the shoreline at the eastern border of
the applicant's property.
There has been no archaeological assessment performed on this tract.
The applicant is proposing to construct a boat ramp into the created canal, from the spoil berm.
From this ramp the applicant wishes to excavate a channel through the created canal and through
Sander's Creek to connect to the existing channel. This proposal would allow for boating access
to the AIWW within Bogue Sound.
The specific project can be described as follows: There is a 150' x 20' asphalt road proposed to
connect from the existing unimproved roadway to a turning area, approximately 100' x 120'. At
the road terminus, the applicant is proposing to construct a concrete boat ramp, ±80' x 36',
extending to the -2' water contour. This would require the filling of approximately 240 square
feet of S artina alterniflora. A timber bulkhead extending for 30' along either side of the ramp
would stabilize the shoreline cut. A 35' x 6' pier would be constructed within the center of the
ramp. The ramp and pier are aligned at a 45% angle to the shoreline, consequently, the ramp
would extend approximately 55.5' from the shoreline measured at its center line. From the ramp,
the applicant is proposing to excavate a new channel, approximately 1450' in length, with a 20'
wide top cut and a 15' bottom cut. The first ±200' would extend through the created canal, and
the next ±1250' would extend through Sander's Creek to connect to the existing channel. A
finished water depth of -4' nwl is proposed. While there are beds of submerged aquatic
vegetation within Sander's Creek, the applicant claims that there are no beds within the defined
location of the proposed channel. The excavation has been proposed for either clam bucket or
hydraulic method. Due to the fact that the method is not specified, the project must be evaluated
with either method in mind. The project would require the removal of >2000 cubic yards of
material. The proposal is to store the spoil on site within a 12,000 square foot diked spoil
disposal area to be constructed. There are 12 channel marker poles with reflectors proposed
along the newly created channel.
The stated intended use of this proposal is to provide boating access to the residents of the
existing mobile home park. According to Carteret County records, there are approximately 85
mobile homes authorized for this development. The applicant has indicated to this division that
there are no plans for development on the vacant portion of the property. However, there was a
proposal recently with Carteret County for an additional 317 RV spaces on the recently cleared
and ditched portion of this property. The applicant states that he has abandoned this proposal.
Under the proposal, RV spaces extended along the east prong of Sander's Creek, around the
existing basin, and along Sander's Creek. This development would be subject to authorization
under the CAMA major permitting process. There is no request for any such development under
the current proposal.
10. ANTICIPATED IMPACTS:
The project as proposed will require the filling of approximately 240 square feet of coastal
wetlands and 29,604 square feet of high ground. It will usurp approximately 210 square feet of
public trust area. The channel request will require the excavation of approximately 29,000
square feet of silty, shallow bottom habitat. Turbidity impacts can be expected during
construction. The project as proposed will serve the boating needs for 85 existing mobile home
residents. Accepting the assumption that the recent RV park proposal has been shelved, it must
still be anticipated that the large vacant portion of this property will eventually be developed, and
the residents will have access to this facility. There may be indirect impacts from this proposal
exceeding the direct impacts. Sander's Creek is a very shallow habitat, with normal low water
soundings averaging -17. The fine composition of the bottom in this area makes it particularly
susceptible to sediment re-suspension into the water column. The possibility exists that the
addition of what may be hundreds of boats to this system will cause a disturbance to the adjacent
creek areas, increasing turbidity, with the potential to reduce sunlight penetration, reduce
available oxygen, encourage algae growth, smother benthic organisms, discourage SAV growth,
alter water temperatures, and impair overall water quality. Additionally, it can be anticipated that
boaters will travel to the existing basin in the east prong of the creek for offloading convenience,
particularly during times of peak activity. This would require travel through a very shallow
system that has no channel.

Reference the application of Thomas Singleton for Department of the Army
authorization and a State Water Quality Certification to construct a boat ramp
with dock and excavate an access channel in an artificial canal, extending
into Sanders Creek, off Bogue Sound at Holiday Village near the community of
Ocean, Carteret County, North Carolina. Your receipt of this letter verifies
your acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by October 20, 1999, the District Engineer will deem that
waiver has occurred.
