JAY ZIMMERMAN September 19, 2016 Director Subject: Pretreatment Review of Industrial Waste Survey (IWS) Program: City.of Burlington; Alamance County NPDES #: NC0023876/South WWTP & NC0023868/East WWTP Dear Mr. Patterson. - The Pretreatment, Emergency Response and Collection Systems (PERCS) Unit of the Division of Water Resources has reviewed the Industrial Waste Survey (IWS) submitted by the City of Burlington. This submission was received by the Division on August 2, 2016. Additional information was requested and was received on September 19, 2016. The review indicates that with the additional information received, the IWS is adequate and meets the minimum requirements of 40 CFR 403.8 (f)(2). A sufficient number of sources were used and the City has a satisfactory method for staying informed of new Users of the collection system. Proper completion of an Industrial Waste Survey is also required by Section IV (D) of your NPDES permit. Please refer to the Comprehensive Guidance for North Carolina Pretreatment Programs (Comprehensive Guide) for additional information and examples. The next IWS summary will be due July 2, 2021. For Jet Hot, how are their coatings different from those covered under 40 CFR 433? Below is the definition for covered coatings. Immersion can also mean spraying a product on. Any wash water/rinse afterward would also be covered under 40 CFR 433. Coatings include chromating, phosphating; metal coloring and passivating. Pollutants associated with these processes enter the wastestream through rinsing and batch dumping of process baths. The process baths usually contain metal salts, acids, bases, and dissolved basis materials. In chromating, a portion of the base metal is converted to a component of the protective film formed by the coating solutions containing hexavalent chromium and active organic or inorganic compounds. Phosphate coatings are formed by the immersion of steel, iron, or zinc plated steel in a dilute solution of phosphoric acid plus other reagents to condition the surfaces for cold forming operations, prolong the life of organic coatings, provide good paint bonding and improve corrosion resistance. Metal coloring involves the chemical method of converting the metal surface into an oxide or similar metallic compound to produce a decorative finish. A variety of solutions utilizing many metals may contribute to the wastestream. Passivating is the process of forming a protective film on metals by immersion in an acid solution, usually nitric acid or nitric acid with sodium dichromate. • • No process wastewater. All items are hand painted. Only drain in the facility is in the polishing room. Sa a Extrusions: Could a copy of the MOU be provided? I am curious as to any documentation of why the facility did not qualify for 40 CFR 467. See attached correspondence in regard to facility being non -categorical. Advanced Powder Coating: Just to confirm, the facility was planning to add phosphating to their process, but will not at this time. There is no wastewater (rinse or other) associated with 40 CFR 433 coating (see above) at this facility, correct? Closed loop system, no process wastewater discharge. No phosphating performed onsite. Mount Vernon Chemical: The facility does not discharge process wastewater; however, has it been confirmed that the facility is not covered under 40 CFR 414 or 415 (may be subject according to their SIU codes)? No process wastewater, dying business. I'm glad she remembered it from the Town of Graham. The Pretreatment Unit concurs with you that the regulation does not make sense, however a discussion with my colleagues yielded a decision to abide with the regulation as written. The Luxfer Company in Graham also extrudes aluminum and in 1998 it was allowed to drop its categorical designation but was required to remain an SIU to protect the POTW. This was because Luxfer had an off pounds production rate exceeding 3M#/Year and a flow exceeding 0.025 MGD. The'ultimate decision to drop the categorical status of Indalex will be made by the POTW. I hope that dropping the categorical classification and maintaining the IUP would be a reasonable compromise for Indalex. The request to rescind S.I.U. permit # 0059 at Indalex Aluminum Solutions is granted with the following stipulations: 1) An authorized representative of Indalex Aluminum Solutions will certify in writing, semi-annually, that there have been no changes in your process that would alter the wastewater discharge properties at your facility. This certification must contain the following statement signed by an authorized representative of Indalex Aluminum Solutions. Indalex Aluminum Solutions hereby certifies that there have been no changes in our process that would have altered the properties of our wastewater discharge. I certify under penalty of law that this statement is true, accurate and complete based on the information gathered by me or provided to me by the person or persons responsible for this system. 2) Indalex Aluminum Solutions agrees to grant access to inspect facilities for verification of certification statement. 3) Indalex Aluminum Solutions agrees to grant access for the purpose of sampling the total discharge from its facility at any time to the City of Burlington or its designate. 4) Indalex Aluminum Solutions will have an oil and grease analysis performed prior to any discharge from the oil and water separator. No more than one analysis per quarter is required. 5) Indalex Aluminum Solutions agrees to inform the City of Burlington of all process changes, including new start-up of machinery. 6) It is understood that the City of Burlington reserves the right to modify or rescind this Memorandum at any time and require permitting if conditions warrant. The City's previous Industrial Waste Survey was approved August 18, 2011. The initial list was developed using the 2014 NC Manufacturers Register, water billing records, Telephone Book review, 2015 Alamance Chamber Manufacturing, Production & Wholesale Directory and the 2012 Alamance County Manufacturers Directory. A "snapshot approach" was taken to identify industries, which may be discharging more than 25,000 gpd process wastewater to the subject POTW or may be covered by categorical pretreatment regulations. A total of 120 Industrial Waste Survey short forms were mailed on January 4, 2016 with a due date of February 4, 2016, 69 were returned completed and 6 were returned with labels titled unclaimed or unable to forward. These addresses were confirmed to be either vacant or wrong mailing address. Site visits were completed to confirm the specific site was either vacant or another industry had moved in. A second request for completion of the survey form was mailed on May 31, 2016 with a return deadline date of June 30, 2016 and 24 forms were returned completed. For the remaining twenty-four forms that were not returned, the facilities were contacted by phone and e-mailed forms for completion. Four of the facilities were outside the City of Burlington's service area and four of the facilities had gone out of business. Annual inspections for 2015 were completed. Annual inspections for 2016 will be completed prior to new permits being issued. There were two Industrial User Wastewater Survey & permit Applications sent as a result of the City of Burlington's ongoing survey. The information obtained from these users and the determination of how they will be controlled is summarized below. When this project is completed this industry will have a zero process wastewater discharge to the City's POTW. Indulor America This will be a new categorical No Categorical Yes, industry. Start-up very likely September, 2016. Additional Inspections Apollo chemical This industry was inspected and No N/A Yes dba Mount Vernon findings concurred with short Chemical form summary. Jet -Hot This industry was inspected due No N/A Yes to a complaint to EPA. George Smith and Deborah Gore asked for an inspection, there were no irregularities observed and found no evidence that this industry be permitted. As a result of this survey, the City will be permitting one additional industry presumably during the fourth quarter of 2016 as they have had issues with construction. Please find enclosed a copy of the initial list of industries using the above mentioned references and a list of facilities that were eliminated from being sent Industrial Waste Surveys due to having no discharge to the City of Burlington's POTW or having no manufacturing process flow. Additionally, please find the Industrial Waste Survey Checklist. The City of Burlington uses the following methods for implementing the continuous Industrial Waste Survey requirements and staying aware of new or changed users. 1. The Director of Water Resources attends bi-weekly meetings where request for new development, redevelopment, and facility expansions are reviewed and sewer taps are discussed. Through these meetings and direct contact the Building inspections Division informs us of potential industrial expansion. 2. Monthly water consumption reports are reviewed. 3. Weekly report consisting of new Business Privilege License is reviewed. 4. The City of Burlington has a good working relationship with the adjacent communities concerning the Control Authority responsibilities under the pretreatment program. The satellite communities are small, and the City has a close working relationship with the municipal staff in these jurisdictions. Both short and/or long application forms are sent to businesses that may require permitting from information supplied by above -mentioned reviews.
