You have our approval, to install a sewer line, as you described in your application dated August
24, 1999. After reviewing your application, we have decided that this project is covered by the Neuse
River buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and send us a new application. If the property is sold, the new
owner must be given a copy of this approval letter and is thereby responsible for complying with all
conditions.
If you do not accept any of the conditions of this approval, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, NC 27611-7447. This approval and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River buffer

Dear Mr. Dorney,
S&EC is'submitting on behalf of the City of Raleigh-Public Utilities Department and Withers and Ravenel Engineering
and Surveying, Inc. a Pre-Construction Application (PCN) for proposed impacts to the Neuse Buffer located
approximately 330 feet southwest of Conover Court (see enclosed figure). The intended work includes the mechanical
clearing of an approximate 25-foot wide corridor in which to place an 8-inch sewer line.
On 4 August 1999, Steve N itchell confirmed buffer calls made by S&EC personnel throughout the project corridor.
An intermittent stream and pond were the only features within the sewer line corridor to be declared subject to the
Neuse Buffer Rule. The enclosed figure depicts the pond and stream and includes the sewer line route and subsequent
buffer impacts. The aerial sewer line crossing of the intermittent stream will be perpendicular and less than 40 linear
feet of riparian buffer will be impact; therefore, this impact is exempt based on the "Table of Uses" [15A NCAC 2B.
0233 section (6)]. Because the aerial crossing of the stream will not impact the channel or banks, a nationwide permit
issued by the Corps of Engineers will not be obtained.
The Neuse Buffer impacts are associated with the parallel crossing of the sewer line through Zone 1 and Zone 2 of the
subject pond. Impacts to the buffer will occur below the dam and total 1,311 square feet within Zone 1 and 2,592
square feet within Zone 2.
The placement of the sewer line corridor is limited in this particular area by the steep landscape and the location of the
pond in relation to the intermittent channel. If the sewer line is shifted south, it will impact a greater amount of Zones 1
and .2 of the intermittent channel and the grade south of the pond is significantly steeper, complicating the design the
installation of the sewer line. No practical alternatives are apparent within the existing natural setting.
S&EC proposes that the City of Raleigh pay into the Neuse Riparian Restoration Fund to mitigate for impacted buffers.
Total based on $0.96 per square foot and a multiplier of 3 in Zone 1 and 1.5 in Zone 2 equals 7,508.16.

Mechanical clearing of vegetation within the immediate sewer line corridor
(approximately 25 feet). Installation of gravity 8-inche sanitary sewer line with an
aerial crossing at the intermittent channel located below the pond. Underground
pipe will be installed using open cut excavation. Mechanical equipement will
include excavators and front end loaders.

involves the discharge of excavated or fill material into wetlands:
a. Wetland delineation map showing all wetlands, streams, lakes and ponds on
the property (for Nationwide Permit numbers 14, 18, 21, 26, 29 and 38). All
streams (intermittent and permanent) on the property must be shown on the
map. Map scales should be 1 inch equals 50 feet or 1 inch equals 100 feet or
their equivalent.
b. If available, representative photograph of wetlands to be impacted by project.

to the placement of the delineation line.
d. Attach a copy of the stormwater management plan, if required.
