Dear Mr. and Ms. Pryor.
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.009
acres of wetlands or waters for the purpose of constructing a home at lot 13, Indigo Plantation, Southport, as you described in
your application dated October 11, 1999. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3106. This certification allows you to use Nationwide Permit Number 18 when the Corps of
Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed
regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed
in the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact.
These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water 'Act. If you have any

I have enclosed information regarding A::1vfmor Water Quality Certification for Lot 13, Indigo
Plantation, in Southport, N. C. (Brunswick Co.). The rear of this lot abuts tidal marsh along
Dutchman Creek Additional 404 wediinds are found behind the CAMA marsh and along the
eastern property boundary. Due to subdivision setbacks and the shape of the lot, the owners
requested permission from Allen Davis -to place a small portion of the house over 404 wetland.
The enclosed site plan shows the lot nmows towards the road and widens at the rear, and the
house location represents the only areaUhich allows a reasonably organized house design. The
owners and their architect have minimred impacts to the wetlands and natural landscape as much
as practicable. The enclosed design is the final result of several revisions which followed our
recommendations for impact minimizat1on. Only a small portion of the house itself extends over
the 404 wetland and will be piling suppDrted. The bottom of the house will be 6' above the
wetland surface and no lattice work will be used around this portion.
Following review of a sjuMn package Men Davis issued a Nationwide # 18 permit for the
project, A NW #18 was issued rather than a "No Permit Needed" letter, as Allen feltthe solid
flooring of the house would affect wetland functions through increased shading and decreased
precipitation inputs. The decks, having,, slatted flooring, were considered exempt and the NW #18
was issued for a total of 0.009 acres. 44en has approved the 404 wetland delineation. Jerry
Parker, NC DCM, has visited the site and has approved a MHW line based on vegetation There
is no coastal shoreline AEC on the lot.

of the application were not received although: sseven copies of the snaps and site plan were received. Please provide
information regarding the location of your project. This information is needed by DWQ in order for us to decide
whether this project is approvable.
Please respond with three week5!of the date of this letter by sending us the appropriate information. If
we do not hear from you in three weeks, we drill assume that you no longer want to pursue this project and we will
consider the project as withdrawn.

The Division of Water Quality has reviewed your submittal for a 404/401 Permit for residential lot fill at
Lot 13, Indigo Plantation in Southport in Brunswick County. Your application was not complete since seven copies
of the application were not received although seven copies of the maps and site plan were received. Please provide
information regarding the location of your project. This information is needed by DWQ in order for us to decide
whether this project is approvable.
Please respond with three weeks of the date of this letter by sending us the appropriate information. If
we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and we will
consider the project as withdrawn.
I can be reached at 919-733-1786 if you have any questions. Until this information is received, I will
request (by copy of this letter) that the Corps of Engineers place this project on hold. Also, the project will be placed
on hold for our processing due to incomplete information (15A NCAC 2H .0507(a)(4)). Your processing time will

Dear Mr. Dorney:
I have enclosed information regarding a Minor Water Quality Certification for Lot 13, Indigo
Plantation, in Southport, N. C. (Brunswick Co.). The rear of this lot abuts tidal marsh along
Dutchman Creek. Additional 404 wetlands are found behind the CAMA marsh and along the
eastern property boundary. Due to subdivision setbacks and the shape of the lot, the owners
requested permission from Allen Davis to place a small portion of the house over 404 wetland.
The enclosed site plan shows the lot narrows towards the road and widens at the rear, and the
house location represents the only area which allows a reasonably organized house design. The
owners and their architect have minimized impacts to the wetlands and natural landscape as much
as practicable. The enclosed design is the final result of several revisions which followed our
recommendations for impact minimisation. Only a small portion of the house itself extends over
the 404 wetland and will be piling supported. The bottom of the house will be 6' above the
wetland surface and no lattice work will be used around this portion.
Following review of a similar package Allen Davis issued a Nationwide # 18 permit for the
project. A NW #18 was issued rather than a "No Permit Needed" letter, as Allen felt the solid
flooring of the house would affect wetland functions through increased shading and decreased
precipitation inputs. The decks, having slatted flooring, were considered exempt and the NW #18
was issued for a total of 0.009 acres. Allen has approved the 404 wetland delineation. Jerry
Parker, NC DCM, has visited the site and has approved a MHW line based on vegetation. There
is no coastal shoreline AEC on the lot.
Enclosed are vicinity maps, site plan with wetland survey, and two cross sections of the house
