After reviewing your application, we have decided that this project is covered by the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this approval letter and is thereby responsible for complying with all conditions. If you do not accept any of the conditions of this approval, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, NC 27611-7447. This approval and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the Neuse River buffer rules. JOYNER, P.E. J. MICHAEL STOCKS, P.E. Appian Consulting Engineers, PA (Appian) conducted a detailed wetland delineation of the subject site on June 22, 1999. The site is located on Huntley Street between US 301 South and the Johnston County Wastewater Treatment Plant (WWTP) about 1200 ft. southeast of the Neuse River. The access road to the WWTP crosses Cusset Gut Branch about 200-ft. from the existing asphalt pavement. The area evaluated consists of approximately 50 ft. on each side of the centerline of Huntley Street and approximately 800 to 1000 ft. long The purpose of the study is to identify the wetland areas to be impacted by raising Huntley Street about 4.8 ft. or to an elevation of 126.42 ft.. above the 100-year flood elevation. This work is necessary to provide continual uninterrupted access to the WWTP for servicing and maintenance during periods of high flow from the Neuse River. The wetlands were delineated with flagging and surveyed by the Titan Atlantic Group. The wetland areas to be impacted appear to be above the headwaters of an unnamed tributary locally known as Cusset Gut Branch. These wetlands are classified under the Cowardin Classification System as Riverine, semipermanently flooded to intermittently exposed. Primarily the vegetation consisted of water primrose, which is an emergent. Soft rushes however lined the bank. According to the USGS topographic quadrangle (Four Oaks, NC, 1986) Cusset Gut Branch does not become a perennial stream until it passes on the downstream side of the proposed site. Presently, the access road has not been redesigned however we are proposing to add about 48 ft. to, the existing 48 inch, 52 ft. long Reinforced Concrete Pipe (RCP) under the road connecting Cusset Gut Branch. An additional 40-ft. of rip rap (20 ft. on each side at the end of the pipe) may be needed to stabilize the slope. The proposed wetland areas to be affected consist of approximately 3213 sq. ft. or 0.073 acres. The proposed wetland fill east of the road is about 841 South Wesleyan Blvd. Rocky Mount, NC 27803 P.O. Once the road improvement is designed and constructed the overall length should actually be less than 140 ft. from toeslope to toeslope.
