1. APPLICANT'S NAME: Ocean Hill Joint Ventures
2. LOCATION OF PROJECT SITE: The project site is in the Villages at Ocean Hill Planned Unit Development and
Ocean Hill Subdivision immediately north of Corolla Village. The subdivisions involved are the last accessible by
NC 12 (Ocean Trail). Bismark Drive and the ocean access to MLW, located at the end of the road are involved
with the project and are located in in Ocean Hill Phase 1. The site is accessed by Coral Drive off NC 12 at the
entrance of the subdivision. The remaining area involved is located along a dirt road accessing a Reverse Osmosis
Plant in Villages at Ocean Hill. The access road is the first dirt road on the left as you enter the subdivision from
Corolla Village, adjacent to Corolla Landscaping.

8. PROJECT SUMMARY: The applicant, Ocean Hill Joint Ventures, would like to install a concentrate waste line

way of Bismark Drive and beach access in Ocean Hill Subdivision, and terminate at mean low water ten feet below
the surface of the beach.

PROJECT SETTING
The applicant's project involves two separate subdivisions, Ocean Hill (a 1 I 1 lot subdivision), and
the Villages at Ocean Hill (a 263 lot Planned Unit Development), located on the Currituck Outer Banks,
north of Corolla Village on Ocean Trail. Both subdivisions are accessed by Ocean Trail (NC 12) at the
northern end of Corolla and are last subdivisions accessed by a paved road system. Development in these
subdivisions are primarily residential, but also includes a large undeveloped commercial parcel in the
Villages at Ocean Hill.
Lots within Ocean Hill obtain water from individual wells, while lots in the Villages at Ocean Hill
are supported by 224,000 gpd reverse osmosis water treatment facility and an 80,000 gpd. waste treatment
facility. The existing water system uses raw water from deep wells located throughout the Villages at
Ocean Hill that is routed through an existing system of pipes to a Reverse Osmosis Treatment Plant. The
process produces approximately 20,000 to 25,000 gallons of concentrate waste. Originally the concentrate
was routed to the waste treatment facility, diluted with the effluent from the waste treatment plant and
pumped to a low pressure subsurface disposal system. Over the years this method of disposal tainted the
existing wastewater disposal system resulting in excessive amounts of chlorides being pumped into the
subsurface system, and putting the facility out of compliance with state groundwater standards. In
December of 1988, a temporary disposal permit was issued by the Division of Environmental
Management, as a result, the concentrate was removed from the effluent stream and rerouted to the
subsurface disposal area as a separate waste stream. Under the terms of the permit, a permanent disposal
system was to be in place by July 1, 1999.
Both the water treatment plant and the wastewater treatment plant are located on the west side of
Ocean Trail in the Villages at Ocean Hill and are access by a dirt service road adjacent to Corolla
Landscaping (Neither of the plants are located within an Area of Environmental Concern). Bismark
Drive, a 60' wide easement terminates at a beach access in the Ocean Hill Subdivision, and will be
involved in the project. The dune within the beach access is an irregularly shaped frontal dune
approximately nine feet at its highest point and is bisected by an existing wooden walkway cuts through the
center of the dune. Vegetation on the dune is sparse and includes seaside panic grass, (Panincum
amarum), sea oats (Uniula paniculata) and seashore elder (Iva imhricata). Existing development within
the easement is limited to a four foot wide walkway, a bicycle rack and a garbage receptacle. The annual
erosion rate for the site is six feet per year, with a 25' recession line, for a 385' Area of Environmental
Concern (AEC).
The Atlantic Ocean is classified as coastal waters by agreement between the Marine Fisheries
Commission and Wildlife Resource Commission. In addition, review indicates that there are no known
archeological sites or geological formations associated with the applicant's property. The area within the
project site, being a public beach access for the subdivisions is heavily used, as well as, the adjacent beach.
The waters adjacent the project site are regularly used for both commercial and recreational fishing.
Existing development within the two subdivisions consists of single-family residences, most of
which are used as vacation homes and seasonal rentals. Approximately 158 lots in the Villages at Ocean
Hill remain undeveloped, and are unable to obtain Building Permits until the effluent disposal problem has
been resolved. Occupancy Certificates are also being withheld on twelve dwellings within the Villages
pending resolution of the problem. In addition the existing Reverse Osmosis System is not sufficient to
supply the Villages at Ocean Hill at build-out. It is important to note that Ocean Hill is a separate
subdivision, with an independent infrastructure.

According to the application all properties involved in the project are the property of the Villages at
Ocean Hill. A letter submitted with the application (Enclosed in the application packet) from Gerald
Friedman, a general partner of Ocean Hill Joint Ventures, states that they are the owners of Bismark Drive
and the ocean access where the project is proposed. A deed dated February 1978, was also submitted with
the application to verify the claim. However, a later deed has been submitted by the Vice President of the
Ocean Hill, Section 1, Property Owners Association (OHIPOA), Russ Barnes, dated March 2, 1993.
According to the document Ocean Hill Joint Ventures recorded a quitclaim of all rights to the roads and
easements, to the mean high water mark (under and over) within Ocean Hil, and assigned title to the
OH 1 POA. A conversation with Jim Bickford, with Ocean Hill Joint Ventures, prior to receiving the new
document indicated that the partnership may indeed have dedicated the property to the OH 1 POA (See
Attachment #2).
PROJECT DESCRIPTION
Ocean Hill Joint Ventures, would like to construct an ocean outfall to discharge RO concentrate into the
Atlantic Ocean. The applicant proposes to expand the existing RO facility from its present capacity of
80,000 gpd to 224,000 gpd, which will raise the waste stream from a maximum of 25,000 (gpd to 75,000
gpd. The process will include piping the concentrate from the expanded water treatment facility in a
easterly direction along an unimproved dirt road to the southern property line of the 10.74 acre
commercial phase to Ocean Trail. The pipe will continue across NC 12/Ocean Trail and along the
southern property lines of lot 107 and 108 in the Villages at Ocean Hill. According to the plans the
remaining pipe will be placed within the right-of-way of Bismark Drive and a beach access to the puhlic
beach in Ocean Hill Subdivision. The pipe will run along the north side of Bismark Drive and turn south
(for approximately 25') along Atlantic Avenue adjacent to the beach access. The pipe will turn east again
and run along the south side of the wooden walkway, in the beach access, to the First Line of Stable
Natural Vegetation (FLSNV). Approximately 410' of pipe will be placed within the 385' Ocean Hazard
AEC within the right-of-way and access easement.
The final section of the effluent pipe will run 161' east from the FLSNV and terminate at a "T" head at
approximate mean low water (MLW). The "T" head of the pipe will be a 4"x 40', 20 slot well screen
packed in two feet of gravel, and encased in a porous fabric mesh to prevent the gravel from migrating
through the sand.
The proposed pipe will be four inches in diameter and will be placed in a three foot wide by three
foot deep trench along Bismark Drive and the beach access, resulting in 1,230 square feet of high ground
disturbance within the Ocean hazard AEC. From the FLSNV the pipe will run in an easterly direction in
the Ocean Erodible Area for 161' and terminate at a 40' long 20 slot well screen pipe placed horizontal to
the ocean at approximate MLW. The trench for the pipe on the beach will he 10' wide and 10' deep,
terminating approximately 156' seaward of the FLSNV. Remaining excavation will be confined to a 10'x
60'x 10' trench to install a 40' (20) slot well screen pipe. The area to be excavated for the installation of
the pipes seaward of the FLSNV is approximately 2,160 square feet. The screen pipe will he encased with
gravel, resulting in the placement of approximately 26 cubic yards Of gravel fill.
Based on the plans it appears that the trench for the well screen pipe will actually involve excavation
and till gravel below MLW. The four inch pipe is shown as terminating at MLW, but excavation for
installation will extend an additional 4'-8", resulting in disturbance in 300 square feet below MLW.

A breakdown of the areas of excavation within the Ocean Hazard AEC are as follows:
High ground excavation landward of the FLSNV = 1,230 sf
High ground excavation seaward of the FLSNV,
but landward of mean high water = 960 sf
Excavation between mean high water to approximate mean low water = 900 sf
Excavation below MLW to place gravel fill = 300 sf
Total Disturbance within the Ocean Hazard AEC = 3,390 sf
The applicant submitted an Environmental Assessment (EA) which is currently going through the State
clearinghouse for review. It is also important to note that the EA states that the disposal system being
proposed is the first of its kind.
ANTICIPATED IMPACTS
• Release of 12 dwellings for occupancy that have already been constructed in the
Villages at Ocean Hill that have no water source.
• Release of the remaining residential 158 lots within the Villages at Ocean Hill for
development.
• Release of the 10+commercial section for development.
• Excavation and backfill of 1,230 square feet of high ground within the Ocean Hazard
AEC.
• Excavation and backfill of 1,860 square feet of beach area including the placement of
13 cubic yards of gravel till.
• Excavation and backfill of shallow water bottom in the Atlantic Ocean, as well as the
placement of 13 cubic yards of gravel fill.
• Temporary increase in turbidity along the surf zone (luring installation of the diffuser
pipe.
• Based on average erosion rate of six feet per year, the structure will have to be
replaced in the future.
• At this time additional impacts cannot be documented since this is the first application
of the diffuser system in the Atlantic Ocean.

adjacent waterfront (riparian) landowners and
sipped return receipts as proof tint such owners have

they have 30 days in which to submit comments on the
proposed project to the Division of Coastal
Management. Upon signing this form, the applicant
further certifies that such notice has been provided.
