Dear Mr. Dorney:
This letter is to advise that we have a small creek on the above noted property. V 60w&'
informed by the City of Raleigh during a recent plat review to have the creek reviewed by the
NC Division of Water Quality as to possible requirements according to the Neuse Basin Riparian
Buffer Rule.
This letter is to request that our property be subject to vesture or that I have vested rights to
continue to develop my property without complying with the riparian rule because of the
following points:
• We have owned this property over forty years and have been developing it since ownership.
Please see a copy of my original survey and plat recorded back in 1959.
• The subject property has a small creek running through it, however, the creek area has very
little forested vegetation along the creek h we have delineated'on our enclosed
survey:` 'Fhis'forested"aiea will not be distur
• 'The subject property already has been graded, with roads, curbs, drains, utilities and other
infrastructure for many years, prior to this new rule.
• The City of Raleigh had approved a site plan to develop out the remaining portion of our
project on May 14, 1996, subject to a 100 foot greenway at the end of the property. We have
since been working with the City of Raleigh to find an acceptable greenway arrangement,
having most recently agreed to a greenway less than 100 feet as noted on our revised survey
dated March 4, 1999.
Thank you for your help with this matter. For your information, we completed a site visit
with Mr. Steve Mitchell of the NC Division of Water Quality on May 26, 1999. Mr. Mitchell
indicated that the creek is subject to the Neuse River Buffer protection, however, only to the
extent of the forested vegetation which has been indicated as noted above. We look forward to
hearing from you as to the next step in continuing our project.

I have reviewed your request for a vested rights review to exempt you from the Neuse River riparian
buffer rules. Your request has been forwarded to Jill Hickey in our Attorney General's office for a
determination.
From a site visit on June 14,1999, I also concluded that a narrow forested buffer does exist along the.
stream crossing your property. The forested buffer varies in width but averages about 15 feet along
most of the stream reach in question. The area outside the forested buffer on the east side is
maintained in mowed grass. The area outside the forested buffer on the west side is currently a
mixture of weeds and eroding soil. The stream is an entrenched urban channel carrying a lot of
untreated stormwater runoff. There are existing apartment buildings on lots 4 and 10 and across
Broadwell Drive. You may also have forested buffer along Walnut Creek on Lot 13.
In your proposed development plans to construct five additional apartment buildings you indicated
that the existing forested buffer will be left undisturbed and lawn would be established between the
forested buffer and the buildings. Your project as currently designed, shows Unit 3 located mostly in
Zone 2 of the riparian buffer area (25 to 30 feet off the stream) and the southeastern corner of Unit 4
appears to be only 15 to 20 feet off stream.
Under the existing the Neuse River riparian buffer rules you can proceed with the development, even
without vesture, as long as you maintain the existing forested buffer and "diffuse flow" of any
stormwater into it. However, under the new Neuse River riparian buffer rules which will go into
effect June 22, 1999, you would have to move the proposed buildings out of the 50 foot wide buffer
area and maintain the riparian buffer zone in vegetation.

Jill Hickey with the Attorney Generals Office has reviewed your request for a vested rights and has
determined that you have acquired vested rights to develop Lots 4-13 of Martin Homes Subdivision
according to the plan approved by the City of Raleigh on 5/14/96. These plans do not show any
impacts to streams or wetlands, however, if your plans should change to include impacts to the
stream, authorization under the 401 Water Quality Certification program may be needed.
