Dear Mr. Bryan:
You have our approval, in accordance with the attached conditions, to dredge 1275 square feet of wetlands and fill
620 square feet of wetlands for the purpose of stabilizing a shoreline and excavating a canal as you described in your
application dated July 7, 1999. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you
go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or
CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of
this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. This
approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General
Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Site Description
The applicant's property is a 90 ft. x 200 ft. urban lot located at 507 Croatan Avenue,
Town of Manteo, Dare County and adjacent to Dough's Creek. The property is developed
with a single family dwelling with outbuilding, a canal and basin, a bulkhead and dock located
in the basin and relic riprap along the canal and creek shoreline. The property has an elevation
of approximately 4 ft. at its highest point near Croatan Avenue and slopes downward toward
the water to an elevation of approximately 1 ft. The property is vegetated with yard grasses
and ornamental shrubs over most of the area with a fringe, averaging 2 ft. wide, of coastal
wetland vegetation, including Spartina alternaflora and Juncus roemerianus located along the
Dough's Creek shoreline and the canal shoreline. It appears, that prior to 1978, the canal was
cut through an existing marsh and the basin was cut into high ground with the spoil being
placed on the applicant's property along the north side of the canal. This relic spoil area has
been mowed and maintained and is vegetated with yard grasses as. well as Distichlis spicata.
This area appears to have 404 wetland characteristics.
The adjacent property to the north has a coastal marsh area beside the creek and the lot
elevation slopes upward toward Croatan Avenue in a manner similar to the applicant's
property. The adjacent property to the south is similar in characteristics but has a larger marsh
area beginning at the basin and ending at the creek shoreline. Other than regular yard
mowing, the property does not appear to have been maintained. The bulkhead and dock are in
poor condition and the canal appears to have shoaled. The basin has an existing water depth of
-4 ft. with the canal having a water depth of -2 ft. The connecting water depths in Dough's
Creek exceed -5 ft. Dough's Creek is designated a Primary Nursery Area by the Division of
Marine Fisheries. The waters of Dough's Creek are classified as SC HQW by the Division of
Environmental Management and are closed to the taking of shellfish.
In order to stabilize the shoreline, to prevent upland flooding and provide better boating
access the applicant proposes to undertake several development activities on the property. The
applicant proposes removing the existing old bulkhead and riprap and to construct 286 ft. of
treated wood bulkhead a distance of 0 - 5 ft. waterward of NWL (average of 2') along the
shoreline of the canal off Dough's Creek. The existing dock in the basin will be removed and
a 44 ft. long and 8 ft. wide parallel dock is proposed along Dough's Creek. One finger pier 3'
x 12' is proposed to be connected to the dock and six mooring pilings are proposed to provide
two boat slips on Dough's Creek. A 4 ft. wide wooden walkway or boardwalk is proposed to
be constructed landward of the bulkhead and to follow the applicant's shoreline along the canal
and all of the basin with the exception of the south shoreline which lies in close proximity to
the property line. The boardwalk will be approximately 240 ft. long.

The applicant proposes to conduct maintenance excavation within the canal in an area up
to 20 ft. wide x 100 ft. long in order to increase the existing water depth from -2 ft. to -4 ft.
An approximate 135' x 3' area of coastal wetlands would also be excavated to facilitate
bulkhead construction and boating access. The applicant proposes to dispose of the spoil from
the excavation on the relic spoil site adjacent to the canal which will increase the elevation of
this area to + 4' MSL. The old bulkhead and riprap rubble will be disposed off site, at the
county landfill. The spoil from the maintenance excavation will be contained onsite by means
of a silt fence system, the proposed bulkhead and by seeding.
Anticipated Impacts
The construction of the new bulkhead will result in approximately 570 sq. ft. of Public
Trust and Estuarine Waters being filled as well as approximately 275 sq. ft. of Coastal
Wetlands. The proposed dock and finger pier will shade approximately 370 sq. ft. of
Estuarine and Public Trust waters. Approximately 960 sq. ft. of Estuarine Shoreline will be
covered by the walkway. The excavation will impact approximately 1125 sq. ft. of Estuarine
and Public Trust waters as well as approximately 150 sq. ft. of Coastal Wetlands.
Approximately 100 cubic yards of silty bottom material is proposed to be removed and
deposited on shore at the relic spoil site. (The USACOE has not made a determination at this
time whether this is an area under 404 jurisdiction.) It is anticipated that additional fill
material will be required to raise the yard to the final desired elevation of +4 ft. All fill
activity will occur within the Estuarine Shoreline and cover a total of approximately 11,555
sq. ft. The excavation of the canal may promote better water flushing of the basin and will
allow improved boating access for the applicant. Temporary water turbidity will occur during
construction and excavation activities. A portion of the dock and a boat slip are proposed
within the riparian setback corridor and a waiver from the adjacent property owner has been
obtained. A CAMA Minor Permit #99-007 was issued to the applicant on January 21, 1999 to
move, remodel and add an addition to the existing single family dwelling.

On June 29, 1999, your application for a 401 Water Quality Certification for
constructing a bulkhead was received by the N.C. Division of Water Quality. The
Division will begin to review the project for eventual decision. However, please be
aware that beginning January 1, 1999 that the N.C. General Assembly passed legislation
requiring payment of-a fee of $200.00 for this project. The 401 Certification cannot be
issued until this fee'ii,paid. Until ttrut time, your application will remain on hold as
incomplete.

constructing a bulkhead was received by the N.C. Division of Water Quality. The
Division will begin to review the project for eventual decision. However, please be
aware that beginning January 1, 1999 that the N.C. General Assembly passed legislation
requiring payment of a fee of $200.00 for this project. The 401 Certification cannot be
issued until this fee is paid. Until that time, your application will remain on hold as
incomplete.

I got on my computer after all. The Joe Bryan Jr project has been
commented on in the filemakerpro system. The application was
incorrect according to the COE. The actual wetland fill was less
than .008 acres. This office recommends issuance of this permit.
