Division of Water Quality - DEHNR Attn: Mr. John Dorney 4401 Reedy Creek Road Raleigh, NC 27607 The purpose of this letter is to provide a complimentary notification of my client's intent to use Nationwide Permit 26 for the construction of the proposed Lyf-Tym Products Warehouse and Office located on the south side of Bobbitt Drive, Garner, North Carolina (see site vicinity map)(UTM Coordinates; Zone 17, 3954450 N, 0715100 E). Proposed impacts to wetlands will total 0.286 acres. Construction of the subdivision will comply with all of the general conditions stated within Nationwide Permit 26. S&EC, Inc, believes that no mitigation will be required for this project. The total permanent impacts under Nationwide Permit # 26 equal 0.286 acres (i.e., less than 1 acre) and the total linear feet of impacts to streams potentially containing "importance" to significant aquatic function equal zero feet. If for some reason wetland mitigation is required, our client proposes payment into the North Carolina Wetland Restoration Fund. NO IMPACTS WILL OCCUR TO THE NEUSE RIVER BUFFERS THAT EXTEND ONTO THE PROPERTY. The extent of the buffers were verified by Mr. Pete Colwell of the NC Division of Water Quality (see attached letter). A stormwater detention pond will be constructed to help replace some of the lost wetland and buffer functions and help protect the downstream water quality. Included are: (1) a completed Pre-Construction Notification Application, (2) Agent Authorization Form, (3) USES Site Vicinity Map, (3) Construction Plans, (4) Neuse River Buffer Confirmation Letter, (5) Wetland Delineation Forms and (6) a check for $200.00 to cover the permit application fee. After examining the site and doing a stream assessment form, I have agreed with the Neuse River Buffer jurisdictional call made by Mr. Zarzecki. The channel feature through the wetlands on your property had numerical ranking of 14.75 and a ranking of at least 19 is needed to be considered an intermittent stream. The jurisdictional point is located about 30 feet west of the utility crossing. I understand that you plan to construct a stormwater detention pond for your project. The pond will help replace some of the lost wetland and buffer functions and help protect the downstream water quality. Please forward a site map showing the stream determination and riparian buffer so that we can include it with our files.
