Stevens, Director 1?• NCDENR NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES June 10, 1999 Dare County DWQ Project # 990562 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Basil Hooper PO Box 112 Avon, NC 27915 Dear Mr. Hooper: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.1 acres of wetlands or waters for the purpose of residential fill, as you described in your application dated June 2, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3106. This certification allows you to use Nationwide Permit Number 18 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786. Please note that the design should include an "emergency" drain that is capable drawing down the permanent pool. 2. Forebay All stormwater wet detention basins are required to have a forebay to facilitate TSS removal. The forebay should be approximately 20% of the total basin volume. NCDENR Stormwater Best Management Practices Manual, November 1995, page 4, item Le. Please revise the engineering plans to meet this requirement. 3. Vegetated Side Slopes The basin side slopes above the permanent pool down to the vegetative shelf must be stabilized with vegetation and side slopes no steeper than 3:1 (horizontal to vertical). Landscape information must be clearly stated on engineering plans. 4. Vegetative Shelf A vegetative shelf around the perimeter of the pond is required. The shelf shall be gently sloped (6:1 or flatter) and shall consist of native vegetation. Please specify this on the engineering plans. 5. Repair eroded areas immediately. III. Every 6 months A. Remove accumulated sediment from the bottom of the outlet structure. B. Check the pond depth at various points in the pond. If the depth is reduced to 75% of original design depth, sediment will be removed to at least the original design depth. IV. General A. Mow the side slopes, not including normally submerged vegetated shelf, according to the season. Maximum grass height will be 6". B. Cattails, and other indigenous wetland plants are encouraged along the pond perimeter; however, they must be removed when they cover the entire surface area of the pond. C. The orifice is designed to draw down the pond in 2 - 5 days. If drawdown is not completed in that time, the system may be clogged. The source of the clogging must be found and eliminated. Y Y D. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This Certification replaces one issued to you 8 July 1999. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. An additional conditions is that a final, written stormwater plan including a wet detention basin be approved by DWQ before wetland (or stream) impacts occur. Also, before any building is occupied at the subject site the approved stormwater treatment facilities shall be constructed and operational and the approved stormwater management plan be implemented. 3. Sufficient flow must be retained in the remaining channel to retain the natural hydrology. We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R .0402, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H.0506(h). According to 15A NCAC 211 .0506(h), feet of restoration will be required. The T&E species survey was conducted to determine the occurrence of or the potential for animal and plant species listed as federally ' threatened or endangered to exist on the proposed site. Completion of this survey was directed by and complies with current state and federal regulations [Federal Endangered Species Act of 1973 (16 USC 1531-1543) and the North Carolina Endangered Species Act (N.C.G.S. Sect. 113 article 25) and North Carolina Plant Protection and Conservation Act of 1979 (N.C.G.S. Sect. 19b 106: 202.12-22). ' The referenced site is located adjacent to Gilead Road approximately 0.7 miles west of Interstate 77 in Mecklenburg County, North Carolina (Figure 1). The site is bounded by Gilead Road to the south, three commercial buildings to the east, undeveloped woodlands ' to the north, and undeveloped abandoned pasture to the west. Access to the is available from Gilead Road. 2.0 Methodology ' A preliminary protected species survey was conducted on April 27, 1999, on the Market Square site by Newkirk Environmental, Inc. to determine potential for occurrences of animal and plant species listed as endangered or threatened by current Federal or State regulations. ' Recent correspondence solicited from The North Carolina Natural Heritage Program dated April 28, 1999, provided existing data concerning the presence or potential occurrence of ' threatened or endangered species in Mecklenburg County, North Carolina (Appendix A). The USFWS lists the following three Federally endangered plant species and one Federally endangered mussel as occurring in Mecklenburg County: Michaux's sumac (Rhus michauxii), ' smooth coneflower (Echinacea laevigata), Schweintz's sunflower (Helianthus schweinitzii), and the Carolina heelsplitter (Lasmigona decorata). As noted, NCDENR has no documentation of any rare, threatened or endangered species or high quality natural habitats ' within the referenced tract (Appendix A). NCDENR also notes that their records are not deemed to be complete and should not be assumed to be comprehensive. Therefore, field surveys should be conducted for thorough evaluations. The species listed above were ' included in the surveys and assessment. During field surveys, site habitats were identified and compared with recognized habitats for each of the four species potentially occurring on the site. Additionally, observed flora and ' fauna were identified to the taxonomic unit level necessary to determine if the observed specimen was a protected species. ' 3.0 Habitat Classification ' During field surveys, four primary habitats: abandoned pasture, upland hardwood, wetland hardwood, and upland shrub thicket, were identified on the property. The following is a description of each of the major habitat types identified on the referenced site and its likelihood to harbor or support listed species. I I H 3.1 Abandoned Pasture Abandoned pasture habitat is located on the central and southern portion of the site. The field contains scattered red cedar and black cherry saplings. The herbaceous layer is dominated by broom sedge (Andropogon virginicus), blackberry (Rubus sp.), Japanese honeysuckle, Panicum spp. and others grasses. This field also contains a few scattered Autumn olive (Elaeagnus umbellata). Kudzu is also well established on the eastern edges of the pasture and observed elsewhere throughout the site. 3.2 Upland Hardwood The upland hardwood community consists of a small area between the pasture and the identified wetland forest. Much of this community is located on the steep banks which transition to from the pasture to the wetland. The overstory of this community is dominated by several large mature trees including white oak (Quercus alba) and sycamore (Platanus occidentalis). The understory is dense and has a greater diversity of plant species; saplings observed include sweetgum (Liquidambar styraciflua), red maple (Acer rubrum), willow oak (Quercus phellos), water oak (Quercus nigra), black cherry (Prunus serotina), and eastern red cedar. Plants observed in the herbaceous layer include Virginia creeper (Parthenocissus quinquefolia), poison ivy (Toxicodendron radicans), Japanese honeysuckle (Lonicera japonica), trumpet creeper (Campsis radicans), and greenbriar (Smilax sp.) The upland hardwood forest is not suitable habitat for any of the listed species. 2 ' 3.3 Upland Shrub Thicket The upland shrub thicket located in the northwest corner of the site is dominated by ' a dense stand Autumn olive (Elaeagnacs umbellata). Other species in the shrub/sapling layer observed include red cedar and red maple. Herbaceous plants observed were poison ivy (Toxicodendron radicans), blackberry (Rubus sp.), and grape (Vitis sp.). The densely vegetated shrub layer is not suitable for any of the listed species. ' 3.4 Wetland Forest - Hardwood Dominated ' This habitat occurs in wetland flat areas associated with the small intermittent stream located in the northern portion of the site and comprises approximately 0.287 acres. The overstory is dominated by yellow poplar, black willow, and ' green ash (Fraxinus pennsylvanica). Plants observed in the herbaceous layer include Virginia creeper, jewel weed (Impatiens capensis) and soft rush (Juncus effusus). Kudzu is also observed climbing onto trees within the wetlands. The wetlands are not suitable for any of the listed species. 3.5 Soils ' Soils mapped by the Natural Resources Conservation Service (MRCS) Mecklenburg County Soil Survey, Map 2, for the Market Square site include: Cecil sandy clay ' loam (8-15 percent slopes) and Davidson sandy clay loam (2-8 percent slopes). These soil types have been classified as medium to strongly acid. i 4.0 Listed Species and Acknowledged Habitats The following is a brief description of each listed species included in the survey, its recognized habitat and comments regarding survey results for that species: 4.1 Michaux's sumac, federally listed as an endangered species, is found in sandy or rocky, open woods in association with basic soils, usually on ridges that have ' been disturbed through clearing. Flowering period: June. Apparently, this plant survives best in areas where some form of disturbance has provided an open area. Eleven of the plant's 16 remaining populations are on highway rights-of ' way, roadsides, or on the edges of artificially maintained clearings. Two other populations are in areas with periodic fires, and two more populations exist on sites undergoing natural succession. One population is situated in a natural opening on the rim of a Carolina bay. The preferred soil of this species is circumneutral. ' 4.2 Smooth coneflower, federally listed as an endangered species, is a rare plant found in meadows open woods, cedar barrens, roadsides, clear-cuts, dry limestone bluffs, and power line rights-of-way, usually on magnesium and - .A -a .'3- M ? Based upon the available habitat, it is the opinion ofNewkirk Environmental, Inc. that federally and state protected species are not present within the site. As such, development of the proposed Market Square site is not likely to cause and adverse impact to any threatened or endangered species or potential habitat for threatened and endangered species. Although no threatened and endangered species were identified during this survey, because of the transitory nature of some of the listed threatened and endangered species and the particular flower/fruiting periods of some plants, it is possible that endangered ' species populations and locations may change over time. Department of Environment and Natural Ifeesources' list of "Significant Natural Heritage Areas" (SNHA) as required by the Nature Preserves Act (NCGS Chapter 113A-164 of Article 9A). The list is based on the program's inventory of the natural diversity in the I tate. SNHA are evaluated on the basis of the occurrences of rare plant and animal species, rare or high quality atural communities and special animal habitats. The global and statewide rarity of these elements and the quality of their occurrence at a natural area relative to other occurrences determine its significance rating. NHAs included on this list are the best known representatives of the natural diversity of the state and therefore ave priority for protection. Nationwide 26 Permit Application Proiect Location, Descrivtion and Purpose 012, 13 & 14 The project site is a 15.79 acre tract of land located near the intersection of Gilead Road and Interstate 77 north of Charlotte, NC. The majority of the tract is a fallow pasture characterized by open grassy field with scattered saplings. Approximately 0.287 acres of freshwater wetlands are located along the northern property line. Wetland boundaries have been surveyed and verified by the US Army Corps of Engineers on April 13, 1999 (see enclosed plat). Within the identified wetland is the upper portion of an small unnamed tributary that drains to Torrence creek which is located approximately 1000 feet northwest of the site. During site reviews conducted with Mr. Samar Bou-Ghazalle, DWQ, the upper 180 feet of the stream was determined to "lack aquatic biological indicators as it is characterized by intermittent gullies. The remaining portions of the wetland/stream are characterized by a narrow (2 foot) shallow stream with associated forested wetlands. The property owner and applicant, AVTEX Partners, plans to construct and develop a multi-use shopping center to include a grocery store and associated small commercial businesses on the property. Economic feasibility, land availability and market area considerations were reviewed in selection of the proposed site. The project engineer, ColeJenest & Stone, has recently completed a master plan for the development (see enclosed plan and drawings). In order to accomplish the stated purpose, AVTEX proposes to impact, by filling, 0.144 acres of freshwater wetlands including 390 feet of stream channel. Impacts to site wetlands are necessary to accomodate building and parking requirements. Every effort to minimize impacts to the wetlands has been made. Impacts have been minimized by relocating on-site stormwater detention areas outside of wetlands and preserving higher value wetland/stream areas. The proposed plan includes impacts only to the upper reaches identified by Mr. Bou-Ghazelle and approximately 210 feet of stream/wetland below the division of these areas. The remaining stream channel and associated forested wetlands will be left in their natural condition. This project is referenced by the Raleigh Regional Office as NBRRO 99-086. It was determined that the feature is the headwaters of Richlands Creek and is indicated on the Wake County Soils and the U.S.G.S. maps as at least an intermittent stream and therefore subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). The stream has been delineated on the map received and the area applicable to protection under the Neuse Buffer Rules begins at NBR Flag 1 at the edge of the property along Trinity Road toward the north to Flag 8. Please be reminded that the riparian buffer is protected in two zones totaling fifty feet of protection. In accordance with the Rule, sheet flow from stormwater must be maintained, to the maximum extent practical, through dispersing concentrated flow and/or re-establishment of vegetation to maintain the efficacy of the riparian area.
