Dear Mr. Cabe:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 2520
square feet of wetlands and dredge 378 square feet wetlands acres of wetlands acres of wetlands or waters for the purpose of
constructing boat ramps, docks and shoreline stabilization under NC 130 bridge in Holden Beach as, described in your application
dated 8 June, 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact.
These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later).
2. DWQ shall be sent three copies of the wetland mitigation monitoring report.
Monitoring shall be for a five (5) year period after construction.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

ramps and five floating dock units at 8' X 16' each and extending perpendicularly to the shore between
the proposed ramps. Also proposes vinyl sheet piling wall on each side of the ramps.

The project site is located under NC Hwy 130 Holden Beach High Rise Bridge on the south side of the
AIWW. The site is on South Shore Drive immediately west of Capt. Pete's Seafood on Holden Beach in
Brunswick County, NC. It is an existing public boat launching facility with associated parking.
The size of the entire tract is 0.55 acres and it consists mostly of a gravel parking lot with very little
vegetation. Manmade features on the tract include the single concrete boat ramp with a fixed dock and
a wooden bulkhead along the waterward boundary of the property. The area waterward of the bulkhead
and on both sides of the existing boat ramp is sparsely inundated with Spartina altem flora.
The adjacent waters of the Atlantic Intracoastal Waterway are open to the harvest of shellfish and
classified as SA waters by the NC Division of Environmental Management. It is not a primary nursery
area.
The NC Wildlife Resource Commission proposes to replace the single boat ramp and fixed dock with two
14' X 100' concrete boat ramps. The applicant proposes an eight-foot wide area between the length of
the ramps in which a concrete walkway and floating dock system are planned. The concrete walkway will
extend from mean high water to 14 feet landward whereas the floating dock system will extend from mean
high water to eighty feet waterward to the end of the proposed ramps. The floating dock system will
consist of five units with dimensions of 16' long by 8' wide. The applicant proposes to remove the
existing boat ramp before constructing the news ramps and to also subgrade'the area in preparation for
the proposed new ramps. The subgrading and construction of the new ramps will involve the excavation
of approximately 436 cu. yds. of material from below mean high water and approximately 118 cu. yds.
from above mean high water. It will also involve the placement of approximately 200 cu. yds. of fill
below mean high water. These actions will result in the loss of approximately 378 square feet of Spartina
alter flora marsh area (14' X 27'). The applicant has secured a 50' X 50' site from the Town of Holden
Beach for the disposal of the excavated material. The disposal site is a completely high ground site located
approximately 0.5 miles from the project area. The spoil, which is expected to be clean sand, concrete
and stone, will be contained within a silt fence enclosure.
The applicant is proposing no upland development except the grading of the existing 21,600 sq. ft.
parking lot. In order to lessen runoff from the parking lot, the applicant is proposing a-grassed area
between the parldng lot and the bulkhead which will allow for seepage of the runoff into a sand and stone
backfill area landward of the bulkhead. The runoff will then be allowed to pass through weep holes within
the bulkhead.
Since construction of ramps and floating docks will involve the filling of approximately 378 square feet
of coastal wetlands, an act which is contrary to the rules and regulations of the Coastal Area Management
Act, the applicant is proposing to mitigate the loss of wetlands by creating new vegetated wetlands at a
nearby site. The site is owned by the NC Department of Transportation and is located adjacent to the
AIWW in their right of way under the old drawbridge. In consultation with Kelly Williams, Wetland
Restoration Specialist for the Division, a plan has been developed whereas:
1. The area in the vicinity of the boat ramp will be planted with newly purchased Spartina
altem flora sprigs in an attempt to create at least a one to one ratio of wetland loss versus wetland
gain. In addition, plants from the disturbed area will be transplanted to the fullest extent
practicable.
2. A nearby stormwater culvert which has created a scouring effect will be lengthened and
lowered so as to discharge below mean low water. The scoured area will also be repaired.
3.1he applicant will monitor the replanted area for success at least once a year for a minimum of ,
three years or until success occurs (whichever is longer). A coverage of at least 85 % of a
reference area of the planted species would be considered successful re-vegetation.
4. Applicant will submit an annual monitoring report to DCM which will provide information on
the success of the planted area and stormwater outfall culvert. Photo documentation should be
included.
In order to achieve: best planting results, a site visit with Tracy Skrabel with the NC Coastal Federation
was conducted on May 28, 1999, whereas, she provided specific information on planting methods, plant
sources and monitoring techniques. The applicant has agreed to utilize the information supplied by Ms.
Skrabel. The applicant has also obtained permission from the Town of Holden Beach to rework the
stormwater outfall culvert and from the NC DOT to utilize their right of way beneath the old drawbridge
for mitigation.
10. AhMCIPA D MWA T
The new boat ramps and floating docks will incorporate approximately 2,520 sq. ft. of estuarine and
public trust waters, an increase of approximately 1400 sq. ft. of what the existing structures now
incorporate. As proposed, the project will cause the excavation of approximately 436 cu. yds. of material
below water level and approximately 118 cu. yds. of high ground excavation. There would be some short
term turbidity associated with the removal and installation of the ramps and docks and vinyl sheet piling
retaining wall, but no long term impacts are anticipated. The project will also involve the placement of
approximately 200 cu. yds. of fill below mean high water and the loss of approximately 378 square feet
of a Spartina alterniflora wetland. Because of the projected public benefit of the project, the applicant
has been allowed to propose mffigation for the loss of wetland by presenting a plan to create vegetated
wetlands at a nearby site and to correct a scouring problem created by a stormwater outfall culvert. If
properly conducted and maintained, the mitigation activities should provide at least a one to one ratio of
wetland loss to wetland creation. The project as proposed is consistent with the Holden Beach Land Use
Plan. Since the existing site is the only public boat ramp within miles of Holden Beach, the facility
should provide a much needed community and public boating access to estuarine waters and should
decrease the need for private boat ramps.
