NARRATIVE DESCRIPTION: Project Setting The applicant owns approximately 1 acre of high ground adjacent to Brown Creek at the terminus of Port Drive off the Straight Road (NCSR 1321) near the Town of Oriental in Pamlico County. The lot is approximately 150 feet wide along the Brown Creek shoreline and is approximately six feet in elevation. The lot is bordered on either side by undeveloped lots. There are wetland areas immediately adjacent to the project site. Additionally, a fringe of coastal marsh parallels the majority of the shoreline. Brown Creek is primarily bordered by individually owned residential parcels with individual docking facilities. There is an existing 10 slip dock almost directly across Brown Creek from this site. In addition there are two other existing 10 slip docks and a marina within a mile downstream of this site. Brown Creek is approximately 415 feet wide and the water depth at the middle of the creek is approximately -5.0 feet below NWL. Water depths in the immediate project area range from -2.8 ft. to -4.5 ft. below NWL. Brown Creek flows into Broad Creek which is tributary to the Neuse River. Brown Creek is designated as a Primary Nursery Area by the NC Division of Marine Fisheries. Brown Creek is currently classified SA NSW by the NC Division of Water Quality and is closed to shell fishing. Project Description The applicant proposes to build a 10 slip community dock for the Brown Creek Development Subdivision. The slips will be located along either side of a 142 ft. by 6 ft. pier. Each slip would run approximately 15 feet wide and 32 feet in length. Six 3 ft. by 16 ft. finger piers would be constructed to provide access to the interior slips. Twelve tie poles (in addition to 12 tie poles connected to the main pier or finger piers) would also be installed. Anticipated Impacts Approximately 8110 ft.2 of Public Trust Area of Brown Creek would be usurped by the installation of the docking facility. Of that total, proposed docks and finger piers would shade approximately 1140 ft.2 of shallow estuarine water habitat. The installation of tie poles and pilings would create some short term, construction related increases in turbidity to the adjacent waters as well as some minor impact to the estuarine bottom habitat. The most obvious question of impact lies on what influence will boats docking in 3 ft. to 4.5 ft. of water have on the primary nursery area. Typically, power boats, shoal draft sailboats, and retractable keel / centerboard sailboats under 30 ft. in length (appropriate for a 32 ft. slip) draw less than 4.0 ft. of water. Consequently, boats of this class should present a minimal impact to the resource. Larger or fixed keel vessels may require more draft thus presenting a greater threat to the resource. Based on the proposed structure, there should be no adverse impacts to navigation in the area (proposed pier length < 1/4 distance across creek). NARRATIVE DESCRIPTION: Project Setting The applicant owns approximately 1 acre of high ground adjacent to Brown Creek at the terminus of Port Drive off the Straight Road (NCSR 1321) near the Town of Oriental in Pamlico County. The lot is approximately 150 feet wide along the Brown Creek shoreline and is approximately six feet in elevation. The lot is bordered on either side by undeveloped lots. There are wetland areas immediately adjacent to the project site. Additionally, a fringe of coastal marsh parallels the majority of the shoreline. Brown Creek is primarily bordered by individually owned residential parcels with individual docking facilities. There is an existing 10 slip dock almost directly across Brown Creek from this site. In addition there are two other existing 10 slip docks and a marina within a mile downstream of this site. Brown Creek is approximately 415 feet wide and the water depth at the middle of the creek is approximately -5.0 feet below NWL. Water depths in the immediate project area range from -2.8 ft. to -4.5 ft. below NWL. Brown Creek flows into Broad Creek which is tributary to the Neuse River. Brown Creek is designated as a Primary Nursery Area by the NC Division of Marine Fisheries. Brown Creek is currently classified SA NSW by the NC Division of Water Quality and is closed to shell fishing. Project Description The applicant proposes to build a 10 slip community dock for the Brown Creek Development Subdivision. The slips will be located along either side of a 142 ft. by 6 ft. pier. Each slip would run approximately 15 feet wide and 32 feet in length. Six 3 ft. by 16 ft. finger piers would be constructed to provide access to the interior slips. Twelve tie poles (in addition to 12 tie poles connected to the main pier or finger piers) would also be installed. Anticipated Impacts Approximately 8110 ft.2 of Public Trust Area of Brown Creek would be usurped by the installation of the docking facility. Of that total, proposed docks and finger piers would shade approximately 1140 ft.2 of shallow estuarine water habitat. The installation of tie poles and pilings would create some short term, construction related increases in turbidity to the adjacent waters as well as some minor impact to the estuarine bottom habitat. The most obvious question of impact lies on what influence will boats docking in 3 ft. to 4.5 ft. of water have on the primary nursery area. Typically, power boats, shoal draft sailboats, and retractable keel / centerboard sailboats under 30 ft. in length (appropriate for a 32 ft. slip) draw less than 4.0 ft. of water. Consequently, boats of this class should present a minimal impact to the resource. Larger or fixed keel vessels may require more draft thus presenting a greater threat to the resource.
