Neuse Basin Rules

Dear Mr. Gradv:
On April 15, 1999, Robert Tankard and Brad Shaver of the Washington Regional Office
investigated a complaint regarding the streamside (riparian) vegetative buffers on the lake within
Hillcrest Farms community in Lenoir County off SR 1552. Mr. Tankard and Mr. Shaver
observed that a portion of the vegetation adjacent to the 22 acre blue line lake had been
decimated due to land clearing activities and fill, which appears to be for development. Two
activities which are not allowable according to this rule are: (1) Land disturbinu activities and
niacement of fill and other materials and (21 New deveionment within either Zone 1 or Zone =.
The aliowabie and non- allowable activities are outlined in the cony of the attacnea rule::.
The impacts to the riparian veuetation referenced above are a violation of the Neuse River
Basin: Nutrient Sensitive Waters Manauement Strateuv: Protection and Maintenance of Kinarian
Areas with Existin_ Forest Veuetation. Administrative Code T15A:0233 which states the
following:
".0233-Existing riparian areas shall be protected and maintained in accoraance with Sub-
Items (3)(a)-(e) of this Rule on all sides of surface waters in the Neuse River Basin
(intermittent streams, perennial streams, lakes, and estuaries) as indicated on the most recent
versions of United States Geological Survey (USGS) 1:24,000 scale (7.5 minute quadrangle)
topographic maps or other site-specific evidence. This rule only applies to riparian areas
where forest vegetation is established {as described in Sub-Item 3(a)} of this Rule as of July
22, 1997. This Rule does not establish new buffers in riparian areas.
Exceptions to the requirements of this Rule for riparian areas are described in Sub-Items
(2)(a-h). Maintenance of the riparian areas should be such that, to the maximum extent
possible, sheet flow of surface water is achieved. This Rule specifies requirements that
shall be implemented in riparian areas to ensure that the pollutant removal functions of
the riparian area are protected and maintained.
'['he removal ot'the riparian buffer along the named tributaries constitutes a violation of'
this Rule promulgated under .0233(3). which states the riparian buffer must be protected in nNo
zones.
(a) "Zone i is intended to be undisturbed forest,...Zone I begins at the top of bani;
for intermittent streams and extends landward a distance of 30 feet on all sides of

pemendicuiar to the watemody. Any forest vegetation, as defined in Rule .0202 of
the Section. in Zone 1 as of July 22, 1997 shall be maintained and protected in
accordance with this rule."
(h) "Zone 2 begins at the outer edge of "Zone 1 and extends landward a minimum oi'
20 feet as measured horizontally on a line perpendicular to the waterbody. The
combined minimum width of Zones 1 and 2 shall be 50 feet on all sides of the
waterbody. Vegetation in Zone 2 shall consist of a dense ground cover composed
of herbaceous or woody species which provides for diffusion and infiltration of
runoff and filtering of pollutants."
The Division of Water Quality requires abatement of the impacts to these riparian zones.
Piease submit vour plan for the restoration of these impacted riparian zones. Your plan should
reflect the restoration of all lost uses not exclusive to but including; erosion control, stream bank
stabilization, filtration, and nutrient uptake.
Thank you for your attention to this matter and be advised that the Washington Regional
Office is considering recommending an enforcement action be pursued for these violations.
