DWQ staff have reviewed the plans for a revised mining permit for the Spencer
Mine. According to our wetland standards [(15 NCAC 2B .0231 (b) (5) and (6)],
the natural hydrology of the wetland must be maintained. Based on available
information, we believe that ground water pumping to allow dry mining will result in a
cone of depression which will violate these standards. Therefore we believe that wet
mining should be required or alternatively the applicant could demonstrate that pumping
will not affect these wetlands.

permit by including dewatering as an additional option to his mining methods and to expand his active
