Blevins, Mayor Town of Spruce Pine PO Box 189 Spruce Pine, NC 28777 Subject: NPDES Application No. NCO021423 Town of Spruce Pine Mitchell County Dear Mayor Blevins: Your modification request to delete the 85% TSS removal requirement from the subject permit has been evaluated. As stated in a letter from the Division of Environmental Management dated November 3, 1989, a lower percent removal requirement may be substituted only if a facility meets the requirements of 40 CFR Part 133.103 (d) which are as follows: 1 . The treatment works is consistently meeting its effluent concentration limits but its percent removal requirements cannot be met due to less concentrated influent wastewater. 2. To meet the percent removal 'iequiiements, the treatment works would have to achieve significantly more stringent limitations than would otherwise be required by the concentration-based standards. 3. The less concentrated influent wastewater is not the result of excessive 1/I. Our review has determined that the subject facility does not meet the first above mentioned requirement. .Therefore, your request for an NPDES permit modification is hereby denied. The Division will be glad to reevaluate your request for a reduction in removal efficiency after your facility has been in compliance with the TSS limit for a period of at least twelve months. The request must be in the form of a written petition, conforming to chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P. O. However, a lower percent removal requirement may be substituted only if a facility meets the requirements of 40 CFR Part 133.103 (d) which are as follows: 1. The treatment works is consistently meeting its effluent concentration limits but its percent removal requirements cannot be met due to less concentrated influent wastewater. 2. To meet the percent removal requirements, the treatment works would have to achieve significantly more stringent limitations than would otherwise be required by the concentration-based standards. 3. The less concentrated influent wastewater is not the result of excessive IA. A review of the monitoring data submitted over the last twelve months indicates that there is a consistent problem with meeting the TSS limit. Because the subject facility does not meet the first abovementioned requirement, the TSS percent removal requirement will remain as 85% in the subject permit. After thirty (30) days from receipt of this letter, the Division will send your permit modification request to public notice stating our intent to deny your permit modification request unless you withdraw your request for a modification to the subject NPDES permit. If you wish to withdraw your request for an NPDES permit modification, you may do so by stating that desire in a letter to our office. Your letter must be received by our office within thirty (30) days of your receipt of this letter.
