4a. Describe the existing conditions on the site and the general land use in the vicinityof the project at the time of this application:*
Existing conditions consist of a wooded parcel with a Colonial Pipeline 50' easement that bisects the property and no structures. Reedy Branch flows onto the property from the
northeast, bisects the property and then continues down along the western portion of the property until it flows off property to the south. Reedy Branch is a perennial stream with
adjacent wetlands and receives the flow from three onsite (3) tributaries with adjacent wetlands, two (2) perennial and one (1) intermittent. General land use within the vicinity of the
project consists of forested land, agricultural land, and rural residential development.

The purpose of the proposed project is to provide access and utilities to construct a residential subdivision.

The overall project consists of the construction of roadway infrastructure, residential lots, low density stormwater control measures, and onsite and offsite utility infrastructure.
Specifically, there are wetland and stream impacts for two road crossings, to sanitary sewer crossings, and one force main easement. Equipment typically used for construction and
earthwork such as backhoes, bulldozers, excavators, graders, pavers, etc. will be utilized for this project.

E. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:

The proposed project includes two (2) road crossings, two (2) sanitary sewer utility crossings adjacent to the road crossings, and one (1) force main
utility crossing. Impact #1 is a proposed road crossing and utility crossing to a perennial stream and wetland. The proposed crossing Will result in
permanent and temporary stream and wetland impacts, in addition to "permanent -no permanent loss" stream impacts which will consist of riprap keyed
into the stream bed (i.e. the top elevation of the riprap post construction will not exceed the pre -construction elevation of the stream bed) for stream
bed stabilization and utility protection at the sanitary sewer crossings, and "permanent -no permanent loss" wetland impacts within the permanent
maintenance corridor. This impact is necessary to access the east and south portions of the property. This road crossing has been designed with
headwalls and wing walls, and to be a perpendicular crossing to minimize stream, wetland and riparian buffer impacts. Impact #2 is a proposed road
crossing and utility crossing to an intermittent stream and wetland. The proposed crossing will result in permanent and temporary stream and wetland
impacts, in addition to "permanent -no permanent loss" stream impacts which will consist of riprap keyed into the stream bed (i.e. the top elevation of
the riprap post construction will not exceed the pre -construction elevation of the stream bed) for stream bed stabilization and utility protection at the
sanitary sewer crossings, and "permanent -no permanent loss" wetland impacts within the permanent maintenance corridor. This impact is necessary
to access the northeast portion of the property. This road crossing has been designed with headwalls and wing walls, and to be a perpendicular
crossing to minimize stream, wetland and riparian buffer impacts. Note additional avoidance of stream and wetland impacts by not accessing the
uplands farther to the north adjacent to Hwy 70. Impact #3 is a proposed force main crossing to a perennial stream and wetlands. This proposed
crossing will result in temporary and "permanent -no permanent loss" wetland impacts, as well as a temporary stream impact. These impacts are
necessary to connect the pump station to an offsite existing manhole and ultimately provide sanitary sewer to the proposed development. The pump
station and utility crossing has been designed in a location to be a perpendicular crossing to minimize impacts, if proposed to the north there would
have been more wetland impacts, to the south and the crossing would have been designed at an angle not likely perpendicular. There is one
additional stream and buffer force main crossing offsite along Little Creek Church Creek Road, this force main crossing will be construction by
directional drill method to avoid stream and buffer impacts.

Standard construction and erosion control practices will be utilized, in addition to coffer dams and pump around dewatering methods.

S&EC reviewed the NCDWR Approved Mitigation Banks in NC list, there were three (3) banks listed within the 03020201 HUC that had riparian wetland
credits available. All three (3) were contacted, two (2) banks had credits available. Attached is a Statement of Availability letter from Resource
Environmental Solutions.

From the project engineer: The projects site is located in the town of Wilson's Mills and contains 183.69 acres. The site is a low density project and the approved plan utilizes the
ebsting drainage patterns that currently exist on the property. The development maintains the impervious limits below the 24 % maximum allowed and 2 units per acre. Impervious areas
are limited to roadway construction, lot improvements and an amenities area.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs' document
prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause
cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural
and silvicultural operations. The Olive Branch Subdivision project is a residential development. Additionally, the project is located within the Town of
Wilsons Mill's and Johnston County's jurisdiction, therefore the adjacent properties that have potential for development will have the following
regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited
development within the riparian buffer area, in addition to "diffuse flow' requirements and could require Best Management Practices that control
nitrogen if diffuse flow cannot be achieved. We anticipate that the DWR will advise us if any additional information is needed.

authorize representatives of the Wilmington District, U.S. Army Corps of Engineers (Corps) and Soil &
Environmental Consultants, PA (S&EC) staff (as my agent) to enter upon the property herein described
for the purpose of conducting on -site investigations and issuing a determination associated with Waters
of the U.S. subject to Federal jurisdiction under Section 404 of the Clean Water Act and/or Section 10 of
the Rivers and Harbors Act of 1899. This document also authorizes S&EC (as my agent) to act on my
behalf and take all actions necessary for the processing, issuance and acceptance of a permit or
certification and any and all associated standard and special conditions. This notification supersedes any
previous correspondence concerning the agent for this project.
NOTICE: This authorization, for liability and professional courtesy reasons, is valid only for government
officials to enter the property when accompanied by S&EC staff. You should call S&EC to arrange a site
meeting prior to visiting the site.

This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected
parties that dispute a determination made by the DWR may request a determination by the Director. An
appeal request must be made within sixty (60) days of date of this letter. A request for a determination by the

This document confirms that Stancil Builders, Inc. (Applicant) for the Olive Branch Subdivision
(Project) has expressed an interest to utilize 0.96 Riparian Wetland Mitigation Credits from the EBX-
Neuse sponsored Neu-Con Wetland & Stream Umbrella Mitigation Bank, specifically 0.96 wetland
credits from the Arrington Bridge III Site, all in the Neuse HUC 03020201. As the official Bank Sponsor,
EBX-Neuse I, LLC, attests to the fact that mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
