Description of Activity: This permit authorizes mechanized landclearing, excavation, the installation of culverts, and the placement of fill associated with the construction of two road crossings and a parking area. Impacts to wetlands and waters authorized by this permit include 0.30 acre of wetlands and waters of the U.S., to include 325 linear feet of channel. This permit replaces the previous authorization of January 4, 1999. Compensatory mitigation for these impacts, to be accomplished by payment into the North Carolina Wetland Restoration Program as described in the February 17, 1999 letter requesting permit revision, shall be implemented in its entirety prior to or concurrent with construction within jurisdictional areas on site. Atlanta, GA.30339 Dear Sirs: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.03 and 325 feet of streams for the purpose of constructing road crossing for an office building complex atSR1 121 and SRI 959, as you described in your application dated 30 March 1999. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. An additional condition is that a final, written storm plan including wet or dry detention basin must be approved by DWQ before wetland (or stream) impacts occur. Also before any building is occupied at the subject site the stormwater treatment facilities shall be constructed and operational and the stormwater management plan be implemented. We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R .0402, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H .0506(h). According to 15A NCAC 2H .0506(h), 325 feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check (made payable to: DEHNR - Wetland Restoration Program), wetland or stream fill shall not occur. The proposed work must be carried out in wetlands because the lot is so configured that its access dictates impacting wetlands and/or storm channels. Flattening of the site to accommodate access, building construction, and local regulations for set backs and storm drainage controls dictate some disturbance to wetlands. Access to the site and conformance to FEMA regulations dictate stream disturbance in excess of 150 FT. To minimize impacts to wetlands and storm channels, the building is sited and grading is designed to impact the minimum amount of Jurisdictional Area. Surface parking and storm drainage is designed to follow existing contours. Stormwater discharges have been designed to discharge outside of regulated buffers and into areas that will be beneficial to the remaining wetlands. All of these minimize the effects to the stream and wetlands. The actual crossings are designed to keep filling of channels to a minimum. Culvert sizes, headwall configurations, and finished grades were designed to reduce the length and profiles of the crossings. Utility crossings are located within the road crossing sections to further reduce impact to the channel. Only after initial FEMA review did it become necessary to disturb more than 150' of the channel. FEMA requirements dictate improving the entrance and exit channels at the culverts to accommodate a minimal rise in flood level at the southern crossing and a "No Rise" condition at the northern crossing. 15.
