Thank you for your letters concerning your project which were received on 13 October
1999. We have been unable to locate a copy of your earlier letter (dated 1 August 1999).
Thank you for the second copy of this letter. However, your letter does not answer our
concerns stated in our 5 May 1999 letter which are restated below:
1) Can you construct your project such that it is shallower at the upper end than
the lower level? This will help prevent low dissolved oxygen levels in the
upper basin. A revised site plan to this end will be needed.
2) A dissolved oxygen model will need to be analyzed for the entire project to
ensure us that DWQ's dissolved oxygen standard of 5.0 mg/l will not be
violated.
This project will remain or hold as incomplete until these issues are addressed.

On February 24, 1999, you requested a 401 Water Quality Certification from the
Division of Water Quality for your project (to construct a marina) located near SR 1166
in Beaufort County. We wrote to you on May 5, 1999 discussing concerns that we have
regarding the design of the project and placing it on hold until those concerns are
addressed. As of today, we have not received a response to our earlier letter. Unless we
receive a written response from you by September 28, 1999, we will consider that you
have withdrawn this application and are not interested in pursuing the project at this time.

Dear Mr. Whichard:
The Division of Water Quality has reviewed your plans for the discharge of fill material into
26,238 square feet of streams and/or wetlands located at SR 1166 in Beaufort County for marina
development. Insufficient evidence is present in our files to conclude that your project must be built as
planned in waters and/or wetlands in accordance with 15A NCAC 211 .0506. Therefore, unless
modifications of the proposal are made as described below, we will have to move toward denial of your 401
Certification as required by 15A NCAC 2H.0507(e) and will place this project on hold as incomplete until
we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army Corps
of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you construct your marina in such a manner that it is shallower in the upper end
than in the outlet? We are concerned that the 4' MWL design for the entire basin will result in water with
low dissolved oxygen. Similarly a dissolved oxygen model will need to be run for this expanded marina to
ensure DWQ that our dissolved oxygen standard (5 ppm) is met in the basin. Any documentation such as
maps and narrative that you can supply to address alternative designs for your project may be helpful in our
review of your 401 Certification.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and one copy to Mr. Brad Shaver, Washington Regional Office at 1424 Carolina Avenue Washington
NC 27889. If we do not hear from you in three weeks of the date of this letter, we will assume that you no
longer want to pursue this project and we will consider the project as withdrawn. I can be reached at 919-

On March 1, 1999, your application for a 401 Water Quality Certification for a e-
boat ramp in Beaufort County was received by the N.C. Division of Water Quality. The
Division will begin to review the project for eventual decision. However, please be
aware that beginning January 1, 1999 that the N.C. General Assembly passed legislation
requiring payment of a fee of $475.00 for this project. The 401 Certification cannot be

Dear Mr. Donley:
Please reference the application of Warren Whichard for Department of the Army (DA)
authorization and a State Water Quality Certification to place fill material within wetlands,
dredge an access channel and connect an existing man-made pond to Chocowinity Bay, and
construct a bu khead, a boatramp, a community dock, and install mooring pilings, on property
located off State Road 1166, adjacent to Chocowinity Bay, near the Town of Chocowinity, in
Beaufort County, North Carolina. Your receipt of this letter verifies your acceptance of a valid
request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the
Clean Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be granted
until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of a
request for certification is a reasonable time for State action. Therefore, if you have not acted on
the request, or asked for an extension of time, by April 23, 1999, the District Engineer will deem
that waiver has occurred.

PROJECT SUMMARY: The applicant proposes to maintain an existing pond, connect the pond into a
manmade canal and undertake maintenance excavation of the canal and entrance channel into
Chocowinity Bay, and bulkhead the high ground portion of the pond, construct a boat ramp, 6 docks,
and 16 mooring pilings in the pond. An existing canal is to be filled in to create coastal wetlands. A
40' by 50' parking area is proposed.

Project setting
The project is located off SR 1166 on Chocowinity Bay near the Town of Chocowinity in
Beaufort County, North Carolina. The project site is bordered on both sides by a large expanse of
coastal wetlands dominated by Spartina cynosuroides. The project site consist of an existing pond,
an existing basin and canal which connect into Chocowinity Bay by an access channel, and a second
existing canal which connects into Chocowinity Bay. The pond is ±180' long by ±90' wide with a
center depth of -5' below the NWL. The pond is separated from the existing canal and basin by a
small wetland area vegetated with carex spp., Juncus effusus, pennywort, upland grasses, and a
fringe of S. cynosuroides along the canal bank. An existing gravel road gives access to the site and
terminates at the existing basin on the east side of the pond. The area adjacent the downstream
(east) side of the pond is vegetated with upland grasses. The basin is ±100' by ±100' with an
existing depth of -2.5' below the NWL. The cannel connecting the basin to the bay is ±360' long
by ±30' wide with an existing depth of -2.5' below the NWL. The existing access channel is ±35'
long by ±30' wide with a current depth of -3.5' below the NWL. The second canal is ±80' east of
the aforementioned canal and is ±395' long by ±20' wide and has an existing depth of -1.6' below
the NWL.
The site elevation is 2-3' above the NWL. Chocowinity Bay is classified as SC-NSW by the
Environmental Management Commission. Chocowinity Bay at the project site is inland water and
is not open to shell fishing.
Project description
The applicant proposes to fill the center portion of the existing ±180' by ±90' by -5' pond to
create a finished depth of -4' below the NWL. The pond will be connected to the existing basin and
canal by a proposed ±40' wide by ±90' long by -4' deep canal which is in wetlands. The applicant
proposes to undertake maintenance excavation of the existing basin and canal for a finished depth
of -4' below the NWL, from the existing depth of -2.5' below the NWL. The existing ±30' wide by
±35' long entrance channel in Chocowinity Bay is proposed to be maintained to a depth of -4' below
the NWL from the existing depth of -3.5' below the NWL.
The applicant proposes to take the spoil derived from the excavation activities and fill in an
existing ±20' wide by ±395' long canal from the existing depth of -1.6' below the NWL to a finished
grade equal to that of the adjacent S. cynosuroides marsh. The purpose of this fill is to provide a
suitable substrate for the adjacent S. c)amsuroides marsh to overgrow the area. The additional spoil
will be taken to a upland disposal site on the applicant's property.
The applicant proposes to construct ±138 of bulkhead adjacent the high ground on the east side
of the `pond' and install a ±20' wide by ±15' long boat ramp into the pond. Six docks (3' by 20') are

proposed adjacent the newly bulkheaded east side of the `pond'. Sixteen mooring pilings are
proposed in the pond creating 10 defined slips. A 50' wide by 40' deep parking area is proposed in
the wetland area to the east side of the `pond'.
Anticipated impacts
The project as proposed will result in the excavation of ±3,600 ftz of wetlands
(approximately 360 ftz is coastal wetlands) and ±22,150 ft' of bay, canal and basin bottom. The
filling activity associated with filling in the existing canal as well as the bulkhead construction and
`pond' filling will result in the filling of ±24,238 ftz of `pond' and canal bottom. The creation of
the parking area will result in the filling of ±2,000 ftz of wetlands. The filling in of the canal should
result in the creation of ±7,900 ftz of coastal wetlands. The construction of the docks will result in
shading ±180 ftz of `pond' bottom. The project as proposed will result in localized turbidity as a
result of the construction activities.

Spoil from the excavation of the access canal will be placed by dragline
into a shallow canal that lies approximately 80' from, and parallel to, the
access canal. The filling of this shallow canal to existing ground level will
allow the surrounding coastal wetlands to cover the area where the spoil is
placed.
The excavation of the access canal will end approximately 50' from
(beyond) the shore into Chocowinity Bay, where the receiving water depth
is 4' deep. Mr. Whichard would like to accomplish the proposed canal
work in late February to mid March, because strong westerly winds usually
blow water out of Chocowinity Bay at this time, thus allowing a window of
opportunity to do the work while the canals are dry. Mats will be used
under the dragline so the coastal wetlands will not be disturbed during the
dredging and filling work.
The pond is generally 4' deep in all but the center section, where the water
deepens to 6'. The proposal calls for the filling of this deeper part of the
pond so that the entire pond is no deeper than 4'. Spoil from the canal
excavation will be used as fill for this work. Mr. Whichard would like to
construct a treated wood bulkhead that will run along the eastern edge of
the pond. Less than 2' of backfill will be needed to create a straight-line

alignment of the bulkhead. From the proposed bulkhead, six 3'x20' finger
piers are to be constructed to moor boats using the facility. Mooring pilings
are proposed to tie the boats to.
The 404 wetlands shown on the plats were taken from a Wetlands Survey
made by Mr. Hood Richardson, registered surveyor, dated July 27, 1994.
The purpose of this application is to provide area residents a safe place to
moor their boats, particularly during hurricane events. All excess spoil
from the project will be trucked to a highground site.
