APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS and Neuse River Buffer Rules

Dear Mr. Jordan:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.431
acres of wetlands or waters for the purpose of constructing a residential subdivision at SR-1301 and SRI 152, as you described in
your application dated 25 March 1999. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Numbers 3101 and 3108. This certification allows you to use Nationwide Permit Number 12 and 26
when the Corps of Engineers issues these. This approval is also valid for the Neuse River buffer rules (15A NCAC 213 .033). In
addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited
to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval
will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within
50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These
mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later).
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

-a new roars crossing alignment is proposed that will decrease the Previously proposed wetland
impacts of 7020 s.f_ to 4833 s.f. (30% reduction of proposed impacts). This will change the
previously requested NW26 impacts from 0.187 ac, to .136 ac. The total proposed impacts for the
site will be 0.431 ac. The responsible party has also agreed to restore the existing pump station
access road (which crosses the wetland) and plant it with native vegetation- This will larueely restore
the natural hydrology, Also,a tree protection fencing will be installed around the wetland areas to
ensure that no additional impacts other than what is proposed will occur.

The purpose of this letter is to request the use Nationwide Permits 12 & 26 to impact 0.214 acres of
wetlands for the purpose of constructing the proposed residential subdivision (Jordan Property). The
site is located west of Sunset Lake Road (SR 1301) approximately 3,500 feet south of its intersection with
Holly Springs Road (SR 1152)(see site vicinity map)(UTM Coordinates = 3948000 N, 699420 E, Zone
17).
Construction of the subdivision will comply with the general conditions stated within Nationwide Permits
12 & 26. The proposed impacts are necessary for the construction of an access road, minimum lot fill and
a sanitary sewer line. No impacts will occur to the Neuse River Buffers which extend onto the property
from a stream (not indicated on the USGS topo) located off the property. Previous impacts, totaling 0.25
acres under Nationwide Permit 26 (see attached permit), have occurred on the adjacent property (formerly
known as the Pierce Property).
Attached are: (1) the completed Pre-Construction Notification Application, (2) USGS Site Vicinity Map,
(3) Site Map taken from Construction Plans, (4) Previously approved 404 permit for the Pierce Property,
(5) Construction Plans (8'/z" x 11" with match-lines), (6) Neuse River Buffer Stream Evaluation Form,
and (7) Wetland Delineation Forms. Also, included is a check for $200.00 from S&EC, Inc. on the behalf
of the applicant to cover the DWQ 401 Permit Application Fee.

minimal lot fill and to provide sanitary sewer access. Wetlands will remain
untouched in many of the proposed lots. No impacts will occur to the Neuse River
Buffers.

Dear Mr. Pierce:
Reference your application of November 13, 1996, submitted
on your behalf by Soil and Environmental Consultants,
Incorporated, for Department of the Army authorization to
discharge fill material within waters of the United States,
impacting a total of 0.25 acre of wetlands adjacent to, and above
the headwaters of, an unnamed tributary to Sunset Lake, for a
road crossing related to construction of the proposed 58- lot
residential development, on the west side of S.R. 1301 (Sunset
Lake Road), approximately 4,000 feet southeast of Holy Springs
Road (S.R. 1152), northeast of Holly Springs in Wake County,
North Carolina.
For the purposes of the Corps of Engineers' Regulatory
Program, Title 33, Code of Federal Regulations (CFR), Part 3.30.6,
published in the Federal Register on November 22, 1991, lists
nationwide permits. Authorization was provided, pursuant to
Section 404 of the Clean Water Act, for discharges of dredged or
fill material into headwaters and isolated waters.
Your work, causing the loss of 0;25 acre of waters of the
United States, is authorized by this nationwide permit provided
it is accomplished in strict accordance with your submitted plans
and the enclosed conditions. This nationwide permit does not
relieve you of the responsibility to obtain other required State
or local approvals.
Based on your expenditures in reliance on the nationwide
permit, we have determined that you have commenced prior to
January 21, 1997; therefore, you have until January 21, 1998, to
complete the work.

Please note that this authorization is valid for the work
described above only, and impacts of subsequent projects on this
property would have to be considered cumulatively with these
impacts, regardless of future subdivision or ownership of the

The purpose of this letter is to notify you of changes to the proposed site plan for the CY Jordan Property
Subdivision and revisions to the existing 401 Permit Application currently under review by the NC
Division of Water Quality (DWQ). The proposed changes were made in response to concerns brought
about by Mr. Danny Smith of the DWQ on 3/23/99 regarding the proposed entrance road to the property.
Mr. Smith stated that he would like to see the proposed entrance road utilize the existing pump station
access road. Mr. Smith stated that by utilizing the existing access road less square footage of wetlands
will be disturbed, less fragmentation will occur to the wetland area and changes to the existing hydrology
will be minimized.
After working through several alternative designs the project engineer determined that any design
utilizing the existing pump station access road would result in the loss of a lot and an increase in cost in
planning approvals. S&EC, Inc. worked with the project engineer to propose a modification to the road
curvature that will move the proposed alignment to the north (see attached impact maps). This new
alignment will result in decreasing the previously proposed wetland impact of 7020 s.f. to 4833 s.f. (or
approximately a 30% decrease in wetland impact). This will result in a change from the previously
request Nationwide Permit 26 impact from 0.187 acres to 0.136 acres. Total rp onosed impacts (0.136 /
NW26 and 0.027 / NW 12) for the site will then be 0.163 acres. Total impacts [previously approved
(0.25ac) and proposed] will be 0.413 acres. The responsible party has also agreed to restoring the existing
pump station access road back to its original grade (in the area indicated on the attached map) and
planting it with native vegetation in an effort to restore the natural hydrology. Tree protection fencing
will be installed around the wetland areas to ensure that no additional impacts than what are proposed on
the attached plans occur.
We believe that this new proposed site plan has minimized the wetland impacts to the maximum extent
practicable and restored/created wetlands, thereby, minimizing the fragmentation to the wetland area and
changes to its natural hydrology. Please review the attached revised site plan and send written approval or
your comments to both the applicant (CY Jordan) and myself. Please feel free to call myself at 846-5900
if you have any questions or require additional information. Also, attached is the approved 404
Certification (199920520 &199920524). Please make any required changes to this certification.

The property is approximately 10 acres in size and is located on the west side of Sunset Lake Road (SR
1301), approximately 3,500 feet south of Holly Springs Road (SR 1152) in Holly Springs, Wake County,
North Carolina. The site is adjacent to Middle Creek, below headwaters, in the Neuse River Basin.
Description of Activity: This permit authorizes mechanized landclearing, excavation, the installation of
pipes, and the placement of fill associated with the construction of a residential subdivision. Impacts to
wetlands and waters authorized by NWP 12 (AID 199920520) amount to 0.027 acre for installation of a
sewer connector, impacts authorized by NWP 26 (AID 199920524) amount to 0.187 acre for construction
of roads and lot fill. Cumulative impacts within the subdivision, including previous authorization of 0.25
acre under NWP 26 (AID 199700290), total 0.464 acre.
