Thank you for your letter dated August 14, 1999, to Carol Browner, Administrator of
the Environmental Protection Agency (EPA), concerning the development of a Wal-Mart
Superstore near the Carolina Power and Light Canal in Southport, North Carolina. Your letter
was forwarded to the EPA Region 4 Office in Atlanta for response.
EPA has not received any specific information on this proposed project, nor have we had
the opportunity to visit the construction site. However, EPA Wetlands Section staff have
discussed the proposed project with a representative of the U.S. Army Corps of Engineers (COE),
Wilmington District. According to the COE representative, an application was submitted by
ATW Enterprises, Inc. for a permit under Section 404 of the Clean Water Act, for the excavation
and fill of less than one acre of wetlands associated with the proposed construction at the site.
The COE issued a general permit under Nationwide Permit No. (NWP) 26 for the proposed
project on May 6, 1999. For NWP 26, the COE is required to provide copies of the Pre-
Construction Notification to EPA and other federal and state resource agencies, if the wetland
impacts are between one and three acres. Because the proposed wetland impacts associated with
this project are less than one acre, no review was required by the other federal and state agencies;
therefore, EPA did not have the opportunity to comment on the project.
Because a permit has been issued under Section 404 of the Clean Water Act, the activities
in wetlands on the site have been authorized. EPA notes that any violations of NWP 26 which
may occur on the site are the responsibility of the COE, Wilmington District office. EPA typically
has the lead only in cases of unauthorized (unpermitted) wetlands activities. Therefore, we
suggest that you contact Mr. Allen Davis of the COE at (910) 251-4466 for any concerns with
possible permit violations at this site. Any sedimentation and erosion control concerns fall under
the put-view of the State of North Carolina's Wilmington Office of the Department of
Environment and Natural Resources. For additional information, please contact Mr. Rick Shiver,
Division of Water Quality at (910) 395-3900.
In your letter, you also mention the unauthorized wetlands drainage activities which were
conducted north of Southport in Brunswick County, and elsewhere in the State. EPA
understands the environmental damage caused by on-going problems associated with excessive

volumes of water and sediment that are introduced downstream. In addition to sediment control
and flood attenuation, natural wetlands also provide water quality benefits, ground water
recharge, and wildlife habitat and food chain maintenance; functions which may be reduced in
impacted systems. Poorly envisioned and managed wetlands dredging, ditching, draining, or
filling activities often result in long-term environmental problems. This forms some of the basis
for the Clean Water Act Section 404 regulations which govern filling in wetlands. EPA has been
conducting inspections at many wetlands construction sites in North Carolina and the Southeast,
and we are working with the State of North Carolina and the COE to address wetlands drainage
issues.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Doss:.
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in0.904
acres of wetlands or waters for the purpose of constructing an expanded Wal-Mart Facility at US 17 and N.C. 130, as you
described in your application dated 5 January 1999. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the
Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the
attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact.
These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later).
2. The applicant is required to contact the Linda Lewis, Wilmington Regional Office of the N.C.
Division of water Quality to determine stormwater management requirements.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

SUBJECT: Review of Shallotte Wal Mart Stormwater Pond
It is my understanding, after a conversation with Linda Lewis, that she cannot require the Wal-Mart to enlarge
the existing stormwater detention pond. Linda has not restricted the expansion of the existing detention pond therefore,
Wal Mart does have this option open. This expansion would most likely require the purchase of a portion the adjacent
property. The property adjacent to the pond is currently being built on, but it only on the section that fronts US
Highway 17.
I still have concerns about the filling in of the run on the back of the property. There may be future issues about
flooding if there is no slough for the water to drain to. Please insert a condition into the 401 Certification that states
that any future flooding of these houses may be the responsibility of Wal Mart and not the State.

I am sending this in regards with your recent conversation with Laura Stasavich
of Land Management Group regarding the above mentioned project. We have been in
consultation with Mr. Charles Garcia of Freeland and Kauffman, Inc. regarding your
questions. Our notes indicate that you had two concerns regarding the stormwater
ponds on the project:
1. You wished to know whether the existing stormwater pond could be
expanded in combination with a dry detention area in back and
2. If that is not possible, whether the drop inlet in the back property corner
could be utilized.
I have enclosed a copy of Mr. GarciWs letter addressing these concerns. Mr.
Garcia has informed that expansion of the storrnwater pond is not possible due to the
2:1 elopes to the north and east and by the property line to the west. Also Mr. Garcia
has informed us that the adjacent property had been purchased and that construction is
currently underway on that property.

Secondly, Mr. Garcia has indicated that the drop inlet option is infeasible as well due to
insufficient gradient.
I have also enclosed a copy of Mr. Garcia's e-mail regarding off-site drainage.
Incidentally, I will forward copy of this correspondence to Joanne as well.
Incur last conversation, you indicated to me that once the engineering questions
were answered, the 401 certification would be issued. If you have questions regarding
the material presented above, please contact Mr. Charles Garcia at 864-233-6497.
Otherwise, we will assume that your concerns have boon satisfied and that the 401
certification will be issued shortly.

Dear Mr. Garcia:
The Division of Water Quality has reviewed your plans for the discharge of fill material into 0.904
acres of streams and/or wetlands located at NC 17 near NC 130 in Shallotte in Brunswick County.
Insufficient evidence is present in our files to conclude that your project must be built as planned in waters
and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal
are made as described below, we will have to move toward denial of your 401 Certification as required by
15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your
project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you construct your expansion with less than one-third acre impact to wetlands?
You also must clearly show the location of all streams on the site plan as well as any impact to them.
Finally your application refers to ongoing attempts too acquire adjacent uplands. Please discuss these
efforts in your response. Any documentation such as maps and narrative that you can supply to address
alternative designs for your project may be helpful in our review of your 401 Certification.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and one copy to Ms. Joanne Steenhuis Wilmington Regional Office at 127 Cardinal Drive Ext.
Wilmington NC 28405. If we do not hear from you in three weeks, we will assume that you no longer want

I am writing regarding the above listed permit application. Our records indicate that

I am sending this in regards with your recent conversation with Laura Stasavich
of Land Management Group regarding the above mentioned project. We have been in
consultation with Mr. Charles Garcia of Freeland and Kauffman, Inc. regarding your
questions. Our notes indicate that you had two concerns regarding the stormwater
ponds on the project:
1. You wished to know whether the existing stormwater pond could be
expanded in combination with a dry detention area in back and
2. If that is not possible, whether the drop inlet in the back property corner
could be utilized.
I have enclosed a copy of Mr. Garcia's letter addressing these concerns. Mr.
Garcia has informed that expansion of the stormwater pond is not possible due to the
2:1 slopes to the north and east and by the property line to the west. Also Mr. Garcia
has informed us that the adjacent property had been purchased and that construction is
currently underway on that property.

Secondly, Mr. Garcia has indicated that the drop inlet option is infeasible as well due to
insufficient gradient.
I have also enclosed a copy of Mr. Garcia's e-mail regarding off-site drainage.

I am to your letter regarding the above project dated March 5, 1999. Thank you
for allowing us to respond to your letter. Please be advised that the applicant does
wish to further pursue the project and therefore requests that you not consider the
project as withdrawn. I will address your listed concerns in the order that these
concerns are presented in your letter. I have also included a copy of a memo written by
Mr. Charles Garcia regarding your letter. Much of my response has been summarized
from his memo.
It is not possible to complete the project with less than one-third acre of wetland
impacts. The site plan has undergone at least two revisions in order to minimize
impacts. The truck loading area was redesigned to eliminate impacts to riverine
wetland on western end of the property, an approximately 506` retaining wall was
added in order to eliminate the need for side slopes which would have impacted
wetlands. The parking area is the minimal amount for a store of this size per Wal Mart
requirements. This amount is below the number of parking spaces required by the
Town of Shallotte. A variance was obtained to accomplish this. A loading bay was
deleted in the truck well.
There are no stream impacts in the project area. I have enclosed a site topo
map for your review: The topo appears to show that riverine wetlands are present near
the western site boundary. The original site plan (copy enclosed) included proposed
impacts to this area but the site plan was revised to eliminate these impacts.
The applicant did purchase a piece of uplands from the Shallotte Baptist Church
which did eliminate the need for some wetland impacts. The Church was willing to sell
the parsonage, but nothing else. No other upland area is available for the project.

Enclosed please find four (4) copies each of the current Site Plan and the previously
pursued Design Civil Site Plan for the above referenced project. I would like to bring your
attention to a few things which caused us to change the design.
1. The original plan called for the prototypical expansion of this store to a
"172-prototype." This is shown on the plan titled "Design Civil Site Plan."
You can see that the prototypical truck loading area would have impacted
the wetlands to a much greater extent in this condition. This caused us to
make the decision to move slightly away from the prototypical plan and add
a dock appendage to the rear of the store." This pushed us further north
into wetlands, but these wetlands are combined with uplands and seem to
be of less quality than those which would be impacted with the prototypical
truck dock.
2. A retaining wall of nearly 500' in length was added to the plan to alleviate
the impact of the fill slope from the parking area into the wetlands.
3. Wal-Mart attempted to purchase the church parcel in order to expand the
building more to the east to eliminate some of the impacts, but this was not
a possible alternative. The church agreed to sell the parsonage, but would
not sell even a piece of their main parcel. This caused us to slightly change
the garden center area as can be seen on the Site Plan.
4. We had to go through a public hearing process in order to obtain a
variance for the parking requirements from the Town of Shallotte, also.

This eliminated any chance of expanding the building to the front of the
existing store. As is, the parking shown is the minimum that Wal-Mart will
allow for a store this size.
5. To help alleviate some.of the impacts also, we deleted one of the loading
bays in the truck well. This change saved an additional twelve 0 2') feet of
wetlands impacts. (A store this size will normally have at least 4 bays.)
6. Finally, we feel that the expansion of the existing store is a better solution
than finding a new site in the Shallotte area. We believe that the
construction of a new store on a vacant piece of property would have a
much greater impact on wetlands.than the expansion of the existing store
due to the abundance of wetlands in the area.
It is our contention that the Site Plan included in this package is the best possible plan
with the least amount of impact on adjacent wetlands. Please let me know if I can be of
further assistance.

I am submitting a Nationwide #26 permit application for Wal-Mart Stores, Inc. at the request of
Freeland and Kauffman, Inc. (engineers). As you may remember from your site visit, the Shallotte
Wal-Mart would like to expand its existing store into a "supercenter". The proposed expansion
would include doubling the size of the current building and providing paved access areas around
the sides and back of the building (site plan enclosed). Stormwater ponds will also be needed.
An attempt has been made to avoid and minimize wetland impacts where practicable, however,
there are two constraining factors. These are the combined lack of undeveloped upland around
the store and the fairly uniform layout and design of Wal-Mart supercenters. Expansion is
prohibited to the south by NC Hwy 17, while residential areas and a church are found to the
northeast and east of the site. An effort is currently being made to acquire some of this upland.
Riparian wetlands are found to the west and along the northwest edge of the site. The expansion
design has been altered from its initial draft to reduce impacts to these wetlands, and proposed
impacts are now limited to 0.904 acres along the northwest comer of the site. Roughly half of
that acreage would be filled and half would be excavated to create stormwater retention ponds.
The details of this proposed project are further described in the application materials enclosed. If

12. DESCRIPTION OF PROPOSED WORK INCLUDING DISCUSSION OF TYPE OF MECHANICAL
EQUIPMENT TO BE USED (ATTACHED PLANS: 8 %" X 11" DRAWINGS ONLY):
The proposed project will include adding 185.883 sq;ft. of building to the existing Wal-Mart, grading and
preparing paved access lots around the expansion, and grading and excavating an area for stormwater
retention ponds. (Engineering plan attached)
13. PURPOSE OF PROPOSED WORK: To expand the existing Wal-Mart.
14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN
WETLANDS. (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS):
Room for expansion is limited at this site, as various business and residential areas surround the exisiting
Wal-Mart. In addition, store designs for a Wal-Mart are fairly uniform and somewhat limit the flexiblity of
design. Hwy 17 prevents expansion to the south, and the Shallotte Babtist Church is located on the
southeast side. Residental areas border the northeastern edge of the property. Some of this upland,
residential property is in the process of being acquired for the expansion. however, additional land to the
northwest is still needed for the placement of stormwater ponds. Wetland impacts have been reduced
from oriainal designs and wetland impacts are now limited to less than 1 acre.
