I am currently reviewing the above referenced project and the following items require clarification or additional
information:
1. Avoidance & Minimization for Buffer Impact 1 in Zone 1- Please provide more details regarding the Zone 1
Impact of 139 square feet for this project. Impacts to Zone 1 must be avoided to the greatest extent practicable.
Please provide written justification and documentation of why this impact cannot be avoided [15A NCAC 02H
.0506(f) and (g)].
• The topography begins to steepen on the landward side of the Zone 1 buffer into Zone 2. The trail was placed in
the flatter portion of the area as far from the stream to prevent erosion on the slope. See attached zoom in of
Figure 1 B with the topography turned on.

2. Page 7 of 7 of the Buffer authorization depicts the signature of Heather Smith. The application package requires
an agent authorization letter signed by the applicants. A sample agent authorization letter has been attached to
this letter. Please e-mail a signed agent authorization form to Stephanie Goss at
[e-mail] [15A NCAC 02H .0502(f)]
• Attached is the agent authorization I included with the buffer authorization request. It is authorized by Town of
Clayton which is under an agreement with State Parks to manage the land, that agreement was attached to the
original application. Please let me know if this is not enough documentation.
