In review of the remission request and within the constraints as stated in the subject NOV,the remission request is not based upon whether or not the violation occurred or the accuracy of the factual statement that there was a "Sanitary Sewer Overflow resulting in a discharge without a valid permit". The request is based on the five factors outlined in the subject NOV that will be considered. The statements below outline the events following the notification of release and should address those factors. At 10:40 am the Town's Project Administrator, Chris Rowland, contacted our Utility Maintenance Supervisor that maintains Lift Stations, Force Mains, and Sewer outfalls, James Blalock to advise him that the construction crew installing a new gravity sewer line was digging out some unsuitable soil and inadvertently struck the 12" DIP Force Main coming from the NRLS#2 Lift Station. James immediately called his crew to bring the portable by-pass pump to the site. James and Travis Jessup the Operations Supervisor arrived at the site at 11:00 am and the construction crew that damaged the force main had already dug a trench to divert the sewer coming from the force main into the new gravity sewer line therefore ending the SSO event at approximately 10:55 am. James and Travis then began calling their crews to help bring equipment and supplies necessary for clean up, i.e.: sand bags, lime,and hand rakes etc. James and Travis then began investigation of the creek to determine the environmental impact and the distance downstream that appeared to be impacted. Once the stream was evaluated the bypass pump was set up to pump any contaminated stream water back into the Collection System and they began pumping at 12:05 pm. The sandbags arrived and were installed just below the bypass suction pipe to retain and pump the flow coming from upstream starting at 12:30 pm. At approximately 12:35 pm, 2 fire hydrants that flow into the storm drainage k CLxi . PO Box 879•Clayton,NC 27528•919-553-1530 Fax 919-553-1541 •TownofClaytonNC.org system and discharge into the affected creek near the SSO Site were opened and the crews began walking in the creek and using rakes or shovels to stir up and sediment from the SSO that settled out so that it would flow downstream to the bypass pump to be returned to the collection system. The crews walked in the entire 3,400' of the creek from the SSO Site to the by-pass pump site 3 times to be satisfied that as much of the sedimentation as possible was removed from the creek, they finished around 4:00 pm on 6/6/19, the same day. The repair of the damaged force main was complete just before 1:00 pm by the contractor and placed back into service. The by-pass pump was left running overnight as a precaution, when the crews returned the following morning, 6/7/19, they flowed the fire hydrants again and then began to dismantle the by-pass pump set up and remove the sand bags from the creek. They also broadcast pulverized lime on and around the affected area near the SSO site. The entire event used approx. 53 man-hours of labor to include vehicles, the cost of pulverized lime, and the fuel to run the by-pass pump for 22.3 hours, plus the administrative time to collect the data, report the incident, and respond to the NOV/NO1 as well as this response. Labor, Equipment, and materials are shown on the attached work order# 29304 at an approximate cost to the Town of$3,400.00. In addition to these facts the Estimated Flow of the SSO as reported on the initial DWR overflow report, in the amount of 28,285 was reported as worst case scenario calculated on the volume of the 12"force main for the entire upstream length of 4,900', which we believe to be much greater then the actual amount released into the environment because the flow was diverted into the new gravity line as soon as possible after the damage occurred. Based on the facts,the attached pictures,and associated information submitted,the Town is respectfully requesting remission of any Civil Penalties associated with this NOV and Assessment of Civil Penalty for the subject case. Although the amount of the civil penalty is not necessarily a hard ship on the Town, this amount could be applied to the already under funded infrastructure improvements needed. Not to mention the Assessment of a Civil penalty is not something we take lightly as a blemish on the Town excellent record because of our extensive preventive maintenance program which has reduced the number of overflows over the past years. This is a credit to the diligence of our crews in the cleaning and inspecting our sewer system. Sincer B on W. It made it into the creek and run the distance all the way into Bobby Hardee's property. We damned up the creek, placed our bypass pump in and started sucking out of the creek and putting it into the Rollingwoods gravity line to Clayton to Raleigh station. We walked the entire creek stirring it up to force the sediment to the bypass pump. We are leaving the pump running over night in hopes of catching all the sewer in the creek. Hours on bypass pump at start were 737.7.
