The Town mfFuquay-Varna Staff have approved with the above -referenced erosion control plan. This
approval is only for erosion control and does not constitute approval of site improvements as defined in the Town
ofFuquoy-VahnaLand Development Ordinance. Anapproved erosion and sedimentation control plan isvalid for
one (1) calendar year from the date of approval. If a land disturbance permit has not been obtained within the one
(1) year period, the erosion control and sedimentation plan approval becomes null and void.
By acceptance of these approved pbana. the owner, owner's aganto, heim, successors and anakgns, agree to be
bound to and comply with the Town of Fuquay-Varina's Code of Ordinances and the Town's Standard Specifications
and Construction Details as promulgated and amended by the Town.
The ortheir representative must meet the following obligations ompart ofthis approval:
° Apre-constmction meeting is required prior tocommencement of any construction. Approval ofsite
improvements imrequired prior hoscheduling apre-construction meeting. Afee sheet for required permit
fees will be provided with site improvement approval.
° (3radinQ, other than for installation of soil erosion and sedimentation uonbn| measuren, in prohibited prior
to completion of an approved compliance inspection.
° EC plan approval shall be prominently displayed until all construction is complete, all permanent
sedimentation and erosion control measures are installed, and the site has been stabilized.Acopy ofthe
approved plan shall bekept onfile sdthe job site.
° Agents, officials, or other qualified persons authorized by the Town, have the right to periodically inspect
land disturbing activities to ensure compliance and to determine whether the measures required in the
plan are effective in controlling erosion and sedimentation resulting from land disturbing activity.
° As of April 1, 2019, all new construction activities are required to complete and submit an electronic
Notice ofIntent (N0)form requesting aCertificate ufCoverage (COC)under the NCG01OOOO

correct NOI Form, a COC will be emailed to you within three business days. Initially, DEMLR will not
charge a fee for coverage under the NCGO1 permit. However, on or after May 1, 2019, a $100 fee will be
charged annually. This fee is to be sent to the DEMLR Stormwater Central Office staff in Raleigh.
Title 15A NCAC 4B .01 18(a) and the NCGO1 permit require that the following documentation be kepton

3. Records cfinspections made during the previous 3Udays.
The Town of Fuquay-Varina is not responsible for subject approvals of other Local, State or Federal Agencies. The
subject approvals are (but not limited to) Federal Emergency Management Area Flood reguladono/roquirementa.
Division of Water Ouo|hy under ebonnwater or other water quality regulations/requirements, U.S. Army Corps of
Engineers under Article 404/4U1 (Wetlands/Streams) jurisdiction/requirements, any provisions of the North Carolina
State Building Code or any structural design plans as conducted by the Fuquay-Varina Inspections Department ,
and/or any Fodaro|' State. County and Local municipal nogu|adnnm or permit requirements. These permits and
approvals are separate from this approval and the m*ner, owner's agents, heira, successors and assigns any
responsible for investigating the need, and obtaining these other permits if required.
Approval of these plans does not supersede, in any manner, the Town of Fuquay-Varina's Code of Ordinances or
the Town's Standard Specifications and Construct�on Details. All construction shall be implemented in accordance
with the Code of Ordinances and the Standard Specifications and Construction Details as now promulgated and as
hereafter amended by the Town ofFuquay'Varina. Any deviations from the Town'o Code ofOrdinances and
Standard Specifications and Construction Details shall be called to the attention of the Town before such deviations
are implemented.
To the extent these approved plans vary or conflict with the Town of Fuquay-Varina's Code of Ordinances and/or
the Town's Standard Specifications and Construction Details, said Code and Standard Specifications and
Construction Details shall control irrespective of approval of subject plans. The ovvner, owner agentm, heira,
nunoeenom and ossignm, agree the Town shall not be responsible for any claims, damages, |osaen, cnmte,
engineering fees, attorney's fees or other professional fees whatsoever, incurred by the owner or the owners agents
occasioned by relying upon the subject plans approved by the Town in the event that the subject plans any
inconsistent or in conflict with the Tmwn's Code of Ordinances or the Town'e Standard Specifications and
Construction Details.
