APPROVAL OF STORMWATER MANAGEMENT PLAN (SMP) MODIFICATION
Dear Mr. Rainer,
On December 5, 2007, the Division of Water Quality (DWQ) issued a revised 401 Water Quality
Certification to Mr. John Price and WLA Garner Retail, LLC for the purpose of constructing the subject
property in Garner, Wake County. The Certification included implementation of an approved written
stormwater management plan (SMP) dated December 19, 2006.
On October 27, 2009 the DWQ received your application along with a modified SMP dated October 26,
2009 from Mr. Michael Ranks, PE, of Freeland and Kauffman, Inc. On October 29, 2009, the DWQ
received additional information including revised plans dated October 28, 2009.
After careful review of the submittal, the DWQ approves the requested modification (revised SMP dated
October 28, 2009) to satisfy the stormwater condition of the 401 Water Quality Certification. You are
required to meet the following conditions:
1. The stormwater management system consisting of a hybrid wetpond/wetland-level spreader-
grassed swale system and all associated appurtenances, stormwater conveyances, and the grading
and drainage patterns depicted on the plans dated December 19, 2006 and October 28, 2009 (as
applicable), as approved by this office must be maintained in perpetuity. No changes to the
structural stormwater practices shall be made without written authorization from the Division of
Water Quality. The stormwater management structures shall have maintenance access and at
least a 10-foot drainage easement on each side to allow for the ability to maintain the structures,
and to perform corrective actions. The stormwater easements shall provide protection of the
structures from potential alterations by future property owners.
2. All operation and maintenance activities shall be followed as stipulated in the notarized O & M
agreements for the entire treatment facility: pond/wetland-level spreader-grass swale system.
3. Notification of Construction: The applicant and/or authorized agent shall contact the DWQ
Express Review Program in writing at the letterhead address within ten (10) days of the
commencement of implementing the proposed modification.
