PO Box 99 Davidson, NC 28036 Dear Sirs: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.09 acres of wetlands or waters for the purpose of constructing a residential subdivision and wet detention pond at tall Oaks subdivision, as you described in your application dated December 9, 1998. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3103 and 3108. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when the Corps of Engineers issues them. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. NC 28801-5006 Mr. John Dorney Reedy Creek Drive gh, NC 27607 The purpose of this letter is to request authorization for wetland impacts under Nationwide Permits 14 and 26 and their general 401 Water Quality Certification for the project known as Tall Oaks Subdivision, Mooresville, NC. The project, as proposed, impacts a total of 725 linear feet of important channel (including 485 linear feet of permanent flooding) and a total of 0.09 acres of fill in jurisdictional wetlands. The proposed activity is located within Iredell County and is within lands owned by William Brewster Co., Inc. The attached site plans and USGS topo quad show the location of the project. The unnamed tributaries to Back Creek are not shown on the USGS topo quad, but are considered to be both perennial and intermittent and important and unimportant (see attached maps). The engineer proposes to fill, excavate, or flood portions of these channels with Nationwide 26 for the construction of permanent wet detention ponds, intended to satisfy DWQ requirements. Although the impacted channels themselves are located above headwaters, it is the opinion of both the consultant and the developer that the permanent wet detention ponds will be beneficial for water quality entering Back Creek, which is classified by DWQ as a WS-H CA The fill will total 240 linear feet, and flooding will include 485 linear feet of channel. A NW Permit 14, for 100 linear feet of intermittent not-important channel, is proposed as a complete and separate project for Road Crossing 1. Included in NW Permit 26 for 30 linear feet of intermittent, not-important channel and 30 linear feet of linear wetland, is proposed for the subdivision at Road Crossing 2. At this time, the surface water of the ponds is offered as mitigation for lost channel, due to the presence of fish or crayfish. The engineer states that all practical minimization has been observed. We feel that the wet detention ponds will create more aquatic habitat, particularly for fish, than currently exists within the existing channels. No fish were found in channels associated with pond 1 or pond 2. Crayfish were assumed present due to the presence of mounds. All possible minimization and avoidance, including headwalls and riparian buffers, has been observed according to engineer. Sincerely, -"? &47?
