S T OR.N.1 SEWER 1rdFR.OVv-2M'ENTS PROJECT NO. 1513-7C
ACTION ID #199830937
Dear Mr. Dorney:
Just wanted to inform you that at a recent meeting of the Board for the Rowan County
Housing Authority, it was decided that the plans for renovating and improving the Storm
Sewer located at W. 22nd Street and Running Brook Road in Kannapolis be discontinued.
The Board has voted to pursue a permanent bridge at this site, in lieu of the renovation.
You may, therefore, consider the project withdrawn.
If you have any questions, please do not hesitate to call.
Sincerely,

DWQ Project # 981200
Rowan County
The Division of Water Quality has reviewed your plans for the discharge of fill material into 700
feet of streams (150 feet of culvert and the remainder being riprap) located at your site north of W. 22nd
street in Kannapolis in Rowan County. Based on this review, we have identified significant uses, which
would be removed or degraded by this project. These uses are aquatic life uses in the stream. Furthermore,
insufficient evidence is present in our files to conclude that your project must be built as planned in waters
and/or wetlands in accordance with 15A NCAC 2H.0506. Therefore, unless modifications of the proposal
are made as described below, we will have to move toward denial of your 401 Certification as required by
15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your
project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you construct your access and site development with less than 150 feet of impact
(culvert and riprap) to the stream? Bridging should be seriously considered to reduce this impact. Any
documentation such as maps and narrative that you can supply to address alternative designs for your
project may be helpful in our review of your 401 Certification. Also this project will require compensatory
mitigation as described in 15A NCAC 2H .0506(h). Your mitigation proposal is insufficient because none
was proposed.
Please respond with three weeks of the date of this letter by sending a copy of this information to
me and one copy to Mr. Mike Parker Mooresville Regional Office at 919 North Main Street Mooresville
NC 28115. If we do not hear from you in three weeks, we will assume that you no longer want to pursue
this project and we will consider the project as withdrawn. I can be reached at 919-733-1786 id you have
any questions.

Applicant proposes to im paet approx. 141' of stream channel wit h the installation of a 6 6" RCP
culvert for the purpose of rop viding pe destrian access across an U.T. to Irish Buffalo Cr eek. Also
imposed in this application is the inst allation of approx. 100 fee t of rip-rap both above and below the

additional rip-rap is not assoc iated wit h the proposed culvert, ho wever, it is proposed fo r this site and
should be included in this rev iew. This additional rip-rap amount s to a total stream chan nel im acp t of
roughly 700'. Any impact to th e chann el will require mitigation si nce aquatic activity was found in the
channel (crayfish). The ap
olic ant's arc hitect (Mr. Rich Larson) a s well as the applicant's engineer (Mr.
?
Darryl Wagoner) were contac ted rega rding this proposal, and w ere informed that mitiga tion will be
necessary if impacts exceeds 150'. Mr . Larson indicated that a b ridge had been consid ered,
however, costs favored the in stallation of the culvert. Based on our review of the site, it is
recommended that the applic ant be in formed that the use of 500 + feet of riprap, withou t
consideration for the use of b ioengine ering .hn ues for chann el stabilization, is unac ceptable,
