Good morning gents,
The City of Charlotte, Engineering and Property Management, is requesting a permit modification for the above
reference project in order to conduct bank stabilization activities along 75 If of McMullen Creek. Stabilization activities
consist of minor bank grading, matting, and seeding. No hard armoring or the placement of rip -rap is proposed and the
activities do not include greater than 1 cubic yard per running foot of material placed below OWHM. Discharges into a
special aquatic site (riffle/pool complex) will not occur in the project area or within the immediate vicinity of the project
area, however, a detailed reach assessment for special aquatic sites was not conducted. Please find the attached
modification request document and review it at your convenience. Please advise whether the work is permitted with no
notification or if a formal permit modification is necessary. If you have any questions or concerns please let me know.

Dear Mr. Shaeffer and Mr. Johnson:
On behalf of our client, The City of Charlotte, Engineering and Property Management (City or E&PM),
Kimley-Horn (KH) is requesting a modification to the Pre -Construction Notification application
submitted on August 8, 2018, for the above referenced project. The modification is requested to
include bank stabilization (NWP 13) along both banks of McMullen Creek in the project area. The
City has identified that both banks along McMullen Creek, in the vicinity of the pedestrian bridge,
demonstrate evidence of active erosion and propose to conduct bank stabilization activities including
minor grading, matting and seeding. No hard armoring along the bridge abutments or within the
existing channel banks is proposed. The proposed activity will create bank angles and hydraulic
geometry that will promote vegetation and root mass to extend from the water's edge up to the top of
the channel banks while reducing bank source sediment from eroding banks.

Project Location: The proposed project corridor is located along an existingsanitary sewer easement that extends from
Park Road to McMullen Creek Greenway in Pineville, NC.
Site Description: The project area includes a maintained sanitary sewer easement throughout the entirety of the project
area and is bound by I-485 on the east and a water treatment plant, including some undeveloped forested areas to the west.
Impact Summary (if applicable): The project will result in 98 linear feet of permanent impacts to potential non -wetland
waters of the US. The project will result in permanent impacts to 0.009 acres of potential wetland waters of the US. 40
linear feet of temporary impacts to potential non -wetland waters and 0.07 acres of temporary impacts to potential wetland
