project was on hold since seven copies of the PCN application was not received. To date,
we have not received the mentioned information regarding this project.
If we do not hear anything from you within two weeks of the date of this letter, we
will be forced to withdraw the project.

The Division of Water Quality has reviewed your submittal for a 404/401 for
boat slips to an existing pier at North Shore II subdivision in Iredell County. Your
application was not complete since seven copies of the PCN application were not
included. Please provide information regarding the location of your project. This
information is needed by DWQ in order for us to decide whether this project is
approvable.
I can be reached at 919-733-1786 if you have any questions. Until this
information is received, I will request (by copy of this letter) that the Corps of Engineers
place this project on hold. Also, the project will be placed on hold for our processing due
to incomplete information (15A NCAC 2H.0507(a)(4)).

Dear Mr. Dorney:
The Homeowners Association of North Shore II is applying for approval from Duke Power
Company to add two additional floating boat slips to an existing pier at the community docks.
These two slips were previously approved but were not constructed. The slips would be added to
a pier that was originally approved for eight slips but now only has six; therefore, none of the
leased area will be changed. No dredging will be necessary. Attached is a map that shows the
existing piers with the two proposed slips highlighted. Also enclosed you will find a copy of the
F.E.R.C. order approving 54 slips.
We ask that you advise us, by return mail, of any comments you may have concerning this matter.
Enclosed is a copy of your original letter commenting on North Shore II. We will comply with
recommendations and Duke's guidelines. Thank you for your cooperation and prompt response.
Please advise if additional information is required.

Re: Water Quality Section comments
Various dock, pier and minor dredging projects on Lake
Norman
Recently Mr. B.K. Barringer sent several plans to DEM, Water
Quality Section for review concerning plans for docks and piers in
Lake Norman specifically (Laurel Pointe Marina and East Shore II
Marina). From conversations with Mooresville Regional Office and
Central Office Staff in his office on 27 July 1993, I understand that
Duke Power requires land owners to contact us regarding water quality
concerns. Also as we discussed, DEM rarely has water quality concerns
with this type of project.
Therefore this letter will provide standing approval for new and
repaired docks and piers in Lake Norman until this letter is recinded.
In all cases you shall continue to notify the appropriate DEM Regional
Office of these proposed changes. If DEM has not responded within 30
days of the date of your letter, I hereby provide approval for these
projects.
In addition if dredging is planned which does not require a 404
PErmit from the U.S. Army Corps of Engineers, then DEM does not need
to be notified since no 401 Water Quality Certification would be
needed. However if an individual or Nationwide Permit (such as NW
Permit 16 for return water from upland diked dispos-al sites) is
required, then a 401 Certification will be needed. I look forward to
our meeting on September 7 in the Mooresville REegional Office to
discuss these matter.

ORDER APPROVING NON-PROJECT UBE OF PROJECT LANDS
(IssNUS4 February s, 1996)
On October 25, 1995 Duke Power Company, licensee for the
Catawba-Wateree Project, filed four applications requesting
Commission authorization to permit Crescent Resources, Inc.
(Crescent) and Monterey Landing L.L.C., to construct private
residential. marinas on Lake James and Lake Norman at four
different subdivisions in North Carolina. Crescent proposes to
construct slips to accommodate 26 boats at East Shore TIS, slips
for 34 boats at Pine Knoll, and slips for 54 boats'at North Shore
II. Monterey Landing L.L.C. proposes to construct slips to
accommodate 26 boats at Monterey Landing, remove 3800 cubism feet
of lake bottom to increase the water depth at the boat dock area,
and to stabilize 260 linear feet of shoreline with rip rap.
Marina construction would not involve fuel facilities. The four
marinas would use 0.59, 0.811, 1.24, and 0.57 acres of project
property (water), respectively. East Shore III is located on
Lake James and the other three subdivisions are located on Lake
Norman.
The proposals are consistent with the approved shoreline
Management ]Plan (Plan) for the prof ect2. All proposed marinas
are located in areas classified by the plan for residential
development which is consistent with private boat docking users.
The Commission has considered the effects this and other types of
development at the project in the environmental assessment (EA)
associated with the Plan. EA findings indicate that,-by adhering
to the EA recommendations for resource protection and existing
federal, state, and local regulations and permitting
requirements, environmental resources would be protected. The EA
recommendations were approved and made part of the project
license.

The Catawba-W4tersee Project Shoreline Management Plan
was approved by Commission Order dated February 2, 1996. An
environmental assessment (EA) of the plan was prepared prior to
commission approval of the plan. The final EA, issued on
February 2, 1996, analyses potential environmental effects of
implementing the plan, including marina development. Duke Power
and the Commission will use the plan as baseline information to
evaluate future development proposals and recreational needs at
the project.

The Flan identifies,Lake James and Lake Norman as lakes that
are not projectedto reach thei
near future. r capacity for boating use in the
Lake James and Lake Norman presently reacts
approximately 29 and 36 percent of boating capacity on weekends,
respectively.
The four applications include letters of consultation with
appropriate local, state, and Federal agencies, Copies of
applicable permits are included with the application. Section
404 of the clean water Act certifications (Nationwide permits)
were issued by the U.S. Corps of Engineers where necessary. No
objections to granting the permits were identified.
Ground-disturbed activities are limited to the installation
of pier pilings and manor localized dredge activity and shoreline
rip rap. The North Carolina State Historic Preservation officer
reviewed each proposal and indicates by letters dated March 23,
1994 (Monterey), May 4, 1993 (North shore II and Pine Knoll), and
June 15, 1993 (East Shore. III), that it is aware of no properties
of architectural, historic or archaeological significance which
would be affected by the proposals.
The proposed lease contains the necessary covenants required
by the Commission for the purposes of protecting and enhancing
the scenic, recreational, and other environmental values of the
project. The proposal will not conflict with the operation or
recreational uses of the project. Environmental eff6cts of the
proposed project as proposed, including those to water quality,
should be negligible. The licensee's proposal should be granted.
The Director Orders:
(A) The licensee's
authorization filing of October 25, 1995, for

boat slips to accommodate 26 boats at the Eatst Shores
subdivision on Lake James, and slips to accommodate 34 andIII54
boats att Pine Knoll and North Shore II on Lake Norman,
respectively, is approved.
